Abstract

The Kedung Cowek Fisherman is the largest fish supplier for Surabaya. However, microplastics in the surrounding waters are approximately 1.95 -5.98 ppm, whereas the plastic debris comes from land-based and tidal waste. Consequently, it potentially endangers human health if consumed. The descriptive-analytic methods were used to examine the study. The legal basis for ocean plastic waste management in the intended area is found in Law No. 18 of 2008 concerning Waste Management, Presidential Regulation No. 83 of 2018 concerning Marine Waste Management, and Surabaya Local Regulation No. 5 of 2014 concerning Waste Management and Hygiene. However, the law and regulations have not comprehensively reduced plastic waste on the coast of Kedung Cowek.  Therefore, active community participation by establishing a constructive 'bottom up' idea, action, and critics could contribute to the policy-making process to reduce marine litter and preserve fisheries resources effectively. --- Ancaman sampah plastik di kawasan pesisir pantai Kedung Cowek (mitra) berasal dari sampah darat (land-based) dan sampah yang berasal dari laut (pasang-surut). Berdasarkan hasil temuan,  kadar microplastik di perairan sekitar wilayah pengabdian adalah 1,95 -5,98 ppm. Sehingga, potensi mikroplastik yang tertelan oleh ikan disekitar pesisir Kedung Cowek berpotensi membahayakan Kesehatan apabila dikonsumsi, Padahal kawasan ini adalah penghasil ikan terbesar di Kota Surabaya. Metode yang digunakan dalam pengabdian ini adalah deskriptif-analitif dalam bidang hukum lingkungan laut dan perikanan. Sumber hukum utama pengelolaan sampah laut dikawasan mitra adalah Undang-Undang no 18 tahun 2008 tentang Pengelolaan Sampah, Peraturan Presiden No 83 tahun 2018 tentang Penanganan Sampah Laut, serta Peraturan Daerah Kota Surabaya No.5 tahun 2014 tentang Pengelolaan Sampah Dan Kebersihan. Namun aturan tersebut belum secara komprehensif dapat mengendalikan dan mengurangi sampah plastik di Kawasan mitra. Partisipasi masyarakat dalam bentuk proposal yang berisikan ide, saran, kegiatan adan kritik yang konstruktif dan bersifat botom up dapat menjadi masukan bagi pembuatan kebijakan daerah untuk menanggulangi sampah laut khususnya sampah plastik serta menjaga kelestarian sumber daya perikanan laut.

Abstract

The trade between countries is the main important key to increase people’s prosperity. It is mainly because the prosperity can be measure with nation’s balance of trade. However, the trade has to be adjusted to the national resources and has to think of nation’s souvereignty. In everyt trade between countries, there will be a condition in which souvereinty will be interefered by one of the member of the trade—for example in forms of pure trade or exploitation nation resources. Abstract

The COVID-19 pandemic is described as circumstances often interchangeably in social and medical contexts as non-boundary spread and directly affected a wide range of human life and a non-traditional security threat. The pandemic has had adverse consequences on the economy, and health and psychology have suffered. In 2020, ASEAN  held an extraordinary summit on COVID-19 to accelerate resilience to the pandemic as a regional response; however, a solid commitment and comprehensive foundation are critical focal points for dealing with infectious diseases. Therefore, ASEAN member states should create a permanent mechanism to deal with current and future pandemics by providing a strategic long-term plan, an annual work plan, effective monitoring systems, and quality assurance by strengthening the ASEAN Socio-Cultural Community’s role as an open and dynamic entity within the ASEAN Community. Doctrinal research based on normative legal and conceptual approaches was conducted as methods for this study.

Abstract

Technology development in the maritime industry led to the point where we now have unmanned ships run by automated systems. Therefore, (unmanned) crewless ships that were once only science fiction become real. Maritime Autonomous Surface Ships (MASS) have existed since world war two, and they develop by then. The existence of Maritime autonomous surface ships (MASS) has opened doors to new opportunities and enormous economic benefits for the maritime industry. Even though it will be run in automatic mode, the ship will still be monitored on land by the Shore Control Centre (SCC). This research will describe the aspects of definition, practice, the rule of law, and the use of MASS for seafarers and the maritime industry in general. While maritime regulation has not anticipated this magnitude before, thus not yet fully prepared to accommodate partially or fully automated ships. Consequently, A maritime legal regime still needs to ensure that MASS is safe and can be used sustainably.

Abstract

Madiun has a superior agricultural commodity with a substantial export share, namely Porang. The fundamental problems experienced by Gapoktan partners (Farmers Association) 'Sarwo Asih'  Kepel Village, Kare – Madiun. The farmers' lack of knowledge of the Certificate of Origin (COO) as an export requirement decreased product competitiveness on the global level. Consequently, Madiun’s Porang demand dropped dramatically, which caused financial loss to farmers. This community service will be carried out within two (2) years. The first year of service aims to increase and strengthen partners' knowledge of the registration of agricultural land and the basic knowledge and benefit of having a COO of Porang. In the second year, they were focused on assisting the COO's registration of Porang's product for export. The first-year output targets are Increasing and strengthening the knowledge of the partner (Porang farmer) on the COO of ‘Porang Asli Madiun’ to strengthen the local economy and income, improve their life quality, and register Porang agricultural land.  ---  Kabupaten Madiun memiliki komoditas varietas unggulan pertanian yang memilik pangsa ekspor yang sangat besar yakni Porang. Permasalahan mendasar yang dialami oleh mitra Gapoktan (Gabungan Kelompok Tani) ‘Sarwo Asih’ Desa Kepel Kec. Kecamatan Kare Kabupaten Madiun adalah kurangnya pengetahuan mengenai pentingnya Certificate of Origin (COO) sebagai syarat ekspor untuk meningkatkan daya saing produk ditingkat global. Hal ini berakibat turunnya daya saing harga produk serta terhambatnya kegiatan ekspor.  Pengabdian masyarakat ini direncanakan untuk dilaksanakan dalam waktu dua (2) tahun. Dimana tahun pertama pengabdian ditujukan untuk peningkatan dan penguatan pengetahuan mitra akan pendaftaran lahan pertanian serta pendaftaran COO produk andalan Porang. Kemudian pada tahun kedua, pengabdian di titik beratkan untuk pendampingan pendaftaran COO produk andalan Porang sebagai syarat ekpor. Target luaran tahun pertama pada pengabdian ini adalah: Peningkatan dan penguatan pengetahuan kelompok petani porang mitra tentang COO produk andalan porang asli madiun guna penguatan ekonomi local, peningkatkan kualitas hidup dan ekonomi mitra, serta pendaftaran lahan pertanian Porang.

Abstract

In the last decade, refugee catastrophe has reached an unprecedented level, with women and children comprising a significant portion of displaced population worldwide. In particular for female refugees, they face unique health challenges, including reproductive health problems, mental health issues, and gender-based violence, despite international law’s recognition of the rights to health as fundamental rights under many international conventions. Female refugee often struggles to access healthcare servicesdue to linguistic and cultural barriers, financial constraints, and discriminatory policy. Limited access to health care affects their ability to secure employment, develop social networks, and actively participate in host communities entail as a threat to theircapability forintegration and resettlement in the new country. The study aimsto examinehow current health policies create barriers to successful integration and resettlementfor female refugees. Then, itproposespolicy recommendations for governments, international organizations, and healthcare providers to address these challenges and promote equitable access to healthcare.This research is a doctrinallegalstudy which investigate the impact of the poor health policy on integration and resettlement prospects for female refugees. This research will start by analysesinternational refugee lawand relevant case law pertaining to healthcare access for refugees. Then, it critically examines the gaps and inconsistencies in these legal frameworks and their impact on the lived experiences of female refugees. Good physical and mental health conditions are key to the refugees' successful integration and resettlement into new societies and labourmarkets; otherwise, securing employment, developing social networks, or becoming active members of their host communities will be challenging. Therefore strategy to address the issue are by improving language services, providing social assistance programs, promoting gender-sensitive approach, and establishing responsive and inclusive health care system.

Abstract

In light of the decreasing conventional military threats and the increasing non-military disputes, the need for a comprehensive defence that incorporates diverse national resources is underscored. However, the establishment and integration of a reserve component within the national military framework in Indonesia creates many challenges. The paper examines the context of reserve forces globally then compare with Indonesia’s under Law No. 3/2002 concerning National Defence and Law No. 23/2019 regarding the Management of National Resources for National Defence. It critically analyses the legal, ethical, and operational complexities surrounding the reserve component. highlighting the ambiguities in its role alongside conventional armed forces and the implications for accountability, human rights, and adherence to humanitarian law. It is normative legal research, utilising qualitative analysis to assess current policies, regulations, and the intersection of legal frameworks with ethical considerations. The findings reveal significant gaps in the legal framework governing Indonesia's reserve forces, particularly regarding mobilisation procedures, contract durations, and the dual status of reservists as both civilians and combatants.

Abstract

Tujuan dari artikel ini mendeskripsikan kegiatan pengabdian kepada masyarakat yang berupa edukasi potensi gula aren sebagai produk unggulan desa yang berdaya asing, khususnya gula aren produk Desa Padawa Singaraja Bali. Permintaan gula aren  ke depan akan semakin tinggi sejalan dengan kesadaran masyarakat atas pentingnya hidup sehat. Namun Kelompok Tani Gula Aren Singaraja Bali menghadapi masalah produk dan social ekonomi kemasyarakatan. Hal ini yang melatarbelakangi diadakan pengabdian kepada masyarakat (PKM) di Desa Padawa. Kelompok Tani Gula Aren Padawa berpotensi besar untuk memanfaatkan peluang permintaan pasar atas gula aren. Gula aren Pedawa ini mempunyai karakteristik yang unik terkait dengan cara produksinya yang masih menggunakan cara-cara tradisional, kearifan lokal yang dipertahankan secara turun temurun. Intinya Kelompok petani ingin meningkatkan pengelolaan keorganisasian yang baik dan solid sembari mencari jalan untuk meningkatkan produksi gula arennya. Kegiatan pengabdian Masyarakat ini dilakukan dengan pembanding yaitu petani gula kelapa di Mexico. PKM ini meningkatkan pemahaman tentang potensi gula aren dan pengelolaan kelompok atas keberlanjutan produksi gula aren yang meningkat dan ke depan nanti bisa dijadikan rujukan kelompok sebagai upaya berdaya saing di Indonesia. Hasil dari kegiatan ini ditemukan potensi yang sangat besar bagi gula aren Padawa sebagai produk gula yang sehat karena bisa memanfaatkan turis asing dan lokal yang datang ke Bali sebagai konsumen gula mereka, karena mindset orang asing sudah sangat menghargai dengan baik kehidupan sehat. Oleh karena itu, gula aren Pedawa ini jika dikelola dengan baik akan menjadi sebuah produk unggulan (icon) Desa Pedawa yang dapat bersaing di pasar nasional maupun global.

Abstract

The fundamental problem faced by the partner farmers is the lack of knowledge and skills in fulfilling the trade documentation requirements for the protection of endangered plants and animals as regulated by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) of 1973. Due to limited understanding of export procedures and the requirements for protected plant products under CITES, the partners have resorted to exporting through the black market. As a result, the selling price of their products becomes lower, and the partners’ interests are less protected in case of shipping issues or payment problems. Moreover, sales through the black market can only be conducted on a small scale, which does not support the growth of the partner group’s business. The planned solution to address this problem is to enhance the partners’ knowledge and skills through outreach on CITES and intensive workshops on obtaining CITES permits. The program aims to improve their capability to independently acquire CITES permits, including preparing documents, registration, and fulfilling other technical requirements for future export of their products.
