Abstract

Small Medium Entreprises (SMEs) and Cooperative have not received a proper law protection in facing trade liberation of ASEAN Economic Community (AEC) and economic globalized world. In 2015 AEC has been established that would bring a huge change in Southeast Asia regionS and definitely will have a wide impact to business people in Indonesia. SMEs and Cooperative contribute to more than 90 percent of total Indonesian national economy. However, they are weak on investment and information technology and management skill as well as competition law among ASEAN Member States. Economic policies do not give a sufficient protection to SMEs and Cooperative. This article tries to seek solutions for SMEs problems especially their legal structure in order to enhance their competitiveness. This article argues that the government can provide legal protection by reforming SMEs economic sectors similar to the AEC’s priority sectors by which the Indonesian’ SMEs would become world class corporate. Keywords: Cooperative, AEC, legal reform, SMEs

Abstract

ASEAN Charter 2007 as ‘constitution’ of ASEAN aims to establish ASEAN Community (AC) in 2015 that ASEAN constitutes as a rule-based organization. ASEAN Community consists of three pillars, namely, ASEAN Political Security Community (APSC), ASEAN Economic Community (AEC), and ASEAN Socio Cultural Community (ASCC). AEC will posses as the lead for the Communities. The objective of AEC is to form a single market and production base with some priority sectors. Accordingly, many economic regional organizations provide Dispute Settlement Mechanism (DSM) to resolve disputes that may arise among the member countries. The dispute mechanism aims to provide predictability and security in international trade by providing strict time-frames, and was designed to be mutually agreed by the disputing members, flexible and binding. ASEAN trade DSM is designed as a legalistic mechanism. This paper examines DSM in ASEAN, especially economic disputes in the context of international trade law. In doing so, this paper analyzes DSM provided in the ASEAN Charter by comparing to DSM in the WTO context.

Abstract

A rule-based system of World Trade Organization (WTO) should be supported by effective mechanism of disputes that ensure the Dispute Settlement Body (DSB) rulings toward the respondent could be enforced. The WTO DSM aims to provide predictability and security in international trade by providing strict time-frames, and was designed to be mutually agreed by the disputing members, flexible and binding. For the developing countries in the WTO, they need major effort in terms of training and institutional reform to meet the challenges of participation in the WTODSM. Indonesia has involved in the WTODSM. Sistem perdagangan WTO harus didukung oleh mekanisme penyelesaian sengketa yang efektif. Kepatuhan pada putusan Dispute Settlement Body (DSB) sangat penting agar manfaat perdagangan dapat dirasakan oleh seluruh anggota WTO, termasuk negara-negara berkembang. Dispute Settlement Understanding (DSU) WTO memberikan keamanan dan prediktabilitas atas proses sengketa di WTO yang dibutuhkanoleh seluruh anggota WTO sehingga memberikan kesempatan luas bagi negara-negara anggota WTO untuk berpartisipasi dalam mekanisme penyelesaian sengketa di WTO, termasuk Indonesia.

Abstract

Indonesia is the biggest maritim state in the world as two third of its area are ocean. In order to maximized its fisheries products, Indonesia has some policies regarding to the management of its waters, including eradicating illegal logging and reforming bilateral agreements with some neighbor countries. This policies, however, appear to be not yet optimal. The government in 1985 has ratified the UN Convention on the Law of the Sea (UNCLOS) 1982 with the Act 17/1985. However, up to now, Indonesia has not ratified yet the United Nations Fish Stocks Agreement 1995 and the 1993 Compliance Agreement as the continued arrangements of UNCLOS 1982. Indonesia should conduct such ratification in order to optimize the Indonesian fisheries industry in which its natural resources, whether living or non-living can be explored and exploited. This is crucial as fisheries industries can provide fish stock as alternative healthy food for the people in Indonesia.

Abstract

Artikel ini membahas tentang kekuatan mengikat Piagam ASEAN dan Perkembangan mekanisme penyelesaian sengketa di ASEAN. Dengan berlakunya Piagam ASEAN 2008 maka ASEAN bukan lagi sebagai sebuah organisasi yang longgar (loose association) namun akan menjadi sebuah organisasi yang berlandas hukum (rule-based organization). Piagam mengikat secara hukum bagi negara anggota karena Piagam merupakan dokumen kerangka hukum dan kelembagaan ASEAN. Mekanisme Penyelesaian Sengketa menurut ASEAN lebih bersifat hukum dari pada diplomatik.

Abstract

This article discusses the national sovereignty and regionalism in the context of the membership of a state into regional economic organisations. It concludes that in nowadays-shrinking world the traditional concept of sovereignty is less relevant since states have suffered a loss in their sovereignty. It found that member states of regional economic organisations have to cede a degree of sovereignty, such as in the EU. This phenomenon however is not the case for NAFTA and AFTA.

Abstract

The COVID-19 pandemic is described as circumstances often interchangeably in social and medical contexts as non-boundary spread and directly affected a wide range of human life and a non-traditional security threat. The pandemic has had adverse consequences on the economy, and health and psychology have suffered. In 2020, ASEAN  held an extraordinary summit on COVID-19 to accelerate resilience to the pandemic as a regional response; however, a solid commitment and comprehensive foundation are critical focal points for dealing with infectious diseases. Therefore, ASEAN member states should create a permanent mechanism to deal with current and future pandemics by providing a strategic long-term plan, an annual work plan, effective monitoring systems, and quality assurance by strengthening the ASEAN Socio-Cultural Community’s role as an open and dynamic entity within the ASEAN Community. Doctrinal research based on normative legal and conceptual approaches was conducted as methods for this study.

Abstract

Wilayah Kenjeran Surabaya merupakan daerah masyarakat nelayan yang terkenal di Surabaya sebagai penghasil ikan. Dalam masa Pandemi Covid-19 masyarakat nelayan Kenjeran terkena dampak dari bencana penyakit virus ini yang menyebabkan permasalahan sosial di wilayah tersebut, misalnya meningkatnya angka perceraian sepanjang tahun 2020. Penyebab utama perceraian ini adalah kemiskinan. Masyarakat nelayan secara nasional berada di bawah garis kemiskinan termasuk masyarakat nelayan Kenjeran. Kelompok perempuan dari masyarakat nelayan Kenjeran merupakan kelompok yang tidak produktif secara ekonomi. Tim PPM melakukan praktik dan pelatihan secara langsung pembuatan abon ikan bagi kelompok perempuan masyarakat nelayan Kenjeran Surabaya dengan pendekatan partisipatif. Hasil dari kegiatan PPM ini yaitu kelompok perempuan masyarakat nelayan Kenjeran mampu mengolah ikan menjadi abon ikan yang dengan proses produksi modern didapatkan produk abon ikan yang tekstur dan rasanya lezat dan layak jual. Kelompok perempuan sebagai bagian dari masyarakat nelayan merupakan nilai strategis untuk menggerakkan perekonomian di masa pandemi covid-19 dengan pendekatan gender. Dalam konteks ini, kegiatan PPM ini merupakan sebuah ajakan untuk mobilisasi kelompok perempuan sebagai modal sosial yang nantinya dapat menggerakkan dan memberdayakan ekonomi masyarakat nelayan secara berkelanjutan (sustainability) atas potensi sumber daya laut.

Abstract

The Indonesian government emphasizes the economic potentials of Indonesian micro, small, and medium enterprises (MSMEs) and cooperatives in the Industrial Revolution 0.4 by adopting regulations, policies, and programs that are MSME friendly. This study aims to review the optimization of MSMEs’ digital capability by examining the regulations, the policies, and the programs. It examines the regulatory framework that facilitates the digital MSMEs ecosystem work. Employing a cross-disciplinary approach within law and economics, this legal study adopts a descriptive design, using data from primary and secondary sources on the digitalization of MSMEs in Indonesia. The digital economy necessitates specific managing the adoption of Information Communication and Technology (ICT) across all businesses in Indonesia, including large enterprises, small enterprises, and micro businesses. This study argues that these government measures had a low impact on Indonesian MSMEs. This study concludes that sustainability government support in creating an inclusive digital economy of MSMEs is indispensable. The spirit of gotong royong, Indonesia's culture of community cooperation, should be leveraged to empower MSMEs. The absence of a centralized institution to coordinate policies and programs on the digitalization of MSMEs undermines the effectiveness of the national digital strategies for MSMEs. Indonesia’s plan to become the tenth-largest economy in the world by 2030 may remain unattainable without addressing the gap.

Abstract

Regional Comprehensive Economic Partnership (RCEP) that consist of 15 Asian member countries established in 2021 which to achieve a trade liberalization in the region. The Asian countries have been recognized as the motor of global regionalism and have heightened the Asian region become the center of global economy. This article aims to examine the provisions of RCEP on trade in investment whether it supports sustainability of investment in the region. The region will become a seamlessly market as the region is a market with free flow of goods, services, and investment. While the result of the Pact has not identified yet, this agreement constitutes as a significant effort of ASEAN as one entity, taking the lead of the implementation RCEP, in this current legal regime to gain leverage over its dialogue trade partners. In light of this, the current article’s objective is to observe and evaluate the overall role of ten ASEAN Member States (AMS) which work together to collectively in advancing their part in RCEP by comparing RCEP with International Partnership Economic Framework (IPEF). This study is multidisciplinary research using collected research materials include data and information that have been analyzed from legal and economic perspectives using qualitative descriptive method and found that RCEP investment provisions are utilized to support, realize and attain the ASEAN’ grand strategy to achieve and maintains sustainability of investment in this new Asian regionalism.
