Abstract

Coronavirus pandemic 2019-2020 or known as Covid-19, which spread throughout the world, including Indonesia, has caused casualties and disrupted the economy. Various attempts were made by the government to overcome the increasingly massive impact of the spread of Covid-19. One of them is by issuing the Government Regulations in Lieu of Laws No. 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling Covid-19 Pandemic. Regarding this assistance provided by the government, it is miserable to have allowed the occurrence of criminal acts of corruption committed by government officials and their instruments. The purpose of this paper is to pay attention to the handling and eradication of corruption of Covid-19 Pandemic aid funds. The method used in this paper is to analyze data qualitatively in relation to this research which is a normative juridical type. The data used are primary and secondary data obtained through the search of legislation and materials related to the issues raised. As a result, this article argues that when there have never been cases of corruption whose actors have been sentenced to death in a normal situation, it might be possible for the misuse of the Covid-19 pandemic aid funds can be sentenced to death.

Abstract

Korupsi adalah merupakan suatu dari kejahatan yang luar biasa (ekstra ordinary crime), hal inidisebabkan karena korupsi terjadi di semua bidang kehidupan, dan dilakukan secara sistematissehingga sangat sulit untuk memberantasnya. Perbuatan korupsi merupakan suatu perbuatanorang yang tidak jujur yang bermula sebagai perbuatan jahat yang memerlukan kemampuanberpikir, dengan pola perbuatan yang demikian itu kemudian paling mudah merangsang untukditiru dan menjalar dalam lapisan masyarakat. Oleh karenanya tidak mengherankan bila korupsiterjadi di semua bidang kehidupan, dan dilakukan oleh semua lapisan masyarakat, baikpemerintah, maupun swasta baik pejabat maupun pegawai rendahan. Berkaitan dengan KPKyang sudah mencanangkan program kerja yang salah satunya adalah melakukan suatu upayapreventif dengan melibatkan semua unsur. Upaya preventif ini adalah dengan melakukanpenanaman nilai-nilai anti korupsi terhadap semua pihak,bahakn KPK meminta sekolah danPerguruan Tinggi dalam mata pelajaran dan mata kuliah dapat disisipkan penanaman nilai-nilaianti korupsi, dengan demikian generasi penerus bangsa diharapkan menjadi generasi antikorupsi. Hal yang sama juga dapat ditanamkan nilai-nilai anti korupsi dapat dilakukan dilingkungan keluarga melalui nilai nilai 18 karakter .Dengan menenanamkan 18 nilai nilaikarakter di keluarga akan menumbuhkan nilai nilai anti korupsi dan menjadi budaya yangditerapkan dalam kehidupan sehari-hari sehingga dengan demikian dapat berpartisipasi dalamprogram pemerintah untuk membenrantas korupsi.

Abstract

Menurut Hamzah (2005:48) Dalam tulisan Helwan Karsa , penegakan hukum disebut dalam bahasa Inggris law enforcement, bahasa Belanda rechtshandhaving. Istilah penegakan hukum dalam bahasa Indonesia membawa kita pada pemikiran bahwa penegakan hukum selalu dengan “force” sehingga ada yang berpendapat, bahwa penegakan hukum hanya bersangkutan dengan hukum pidana saja. Pikiran seperti ini di perkuat dengan kebiasaan kita menyebut penegak hukum itu polisi, jaksa dan hakim. Tidak di sebut pejabat administrasi yang sebenarnya juga menegakan hukum. Andai kata istilah asing tersebut di salin menjadi “penanganan hukum” tentu lebih dengan arti cakupan penegakan hukum yang luas.Penegakan hukum lingkungan dapat dilihat dari 3 aspek yaitu aspek pidana,aspek perdata dan aspek administrasi. Agar penegakan hukum lingkungan hidup dalam 3(tiga) apek tersebut dapat tercapai tentunya tidak hanya dengan penegakan aturan aturan saja tetapi juga diperlukan manusia manusia yang berkarakter sehingga diperlukan penanaman nilai nilai karakter khususnya ke aparat penegakan hukum.Penanaman 18 (delapan Belas) nilai karakter bangsa sangat perlu di pahami dan dilaksanakan. Dengan demikian penegakan hukum lingkungan berbasis karakter diharapkan mampu untuk secara proaktif menerjemahkan atau menafsirkan prinsip-prinsip tersebut kedalam putusan pengadilan.

Abstract

This research aims to analyze the implementation of the restorative justice concept within the law enforcement system by the Indonesian National Police as regulated in Law Number 2 of 2002, the Chief of Police Circular Letter No. SE/8/VII/2018, and Police Regulation No. 8 of 2021. Restorative justice is a criminal case resolution approach that emphasizes restoring the condition of victims, offenders, and the community without undergoing formal judicial processes. However, in practice, inconsistencies often occur, particularly in petty theft cases, where some are resolved through restorative justice while others are processed through formal legal proceedings. This research adopts a normative juridical method supported by an empirical juridical approach and has both prescriptive and descriptive-analytical characteristics. Obstacles identified in the implementation include investigators' lack of understanding of restorative justice, a legalistic work culture among investigators, and limited public acceptance of out-of-court case resolutions. Additionally, Police Regulation No. 8 of 2021 does not specify the threshold of financial loss or consider the offender's motive, leading to varying interpretations. Therefore, regulatory reform, enhanced investigator capacity, and legal education for the public are necessary to ensure a more just and consistent application of restorative justice.

Abstract

This study offers a sociological and normative analysis of the persistent stigmatisation of former drug offenders and its implications for the implementation of restorative justice and Islamic ethical values in the contemporary Indonesian context. Employing a qualitative approach through field research and literature review, the study investigates the socio-cultural dynamics, public perceptions, and institutional obstacles that hinder the effective reintegration of ex-offenders into society. The findings indicate that former drug offenders often face multilayered stigma—manifesting in social exclusion, limited employment opportunities, and distrust within their communities—which significantly undermines the objectives of restorative justice. These challenges prolong the cycle of marginalisation and contradict the restorative principles of reconciliation, rehabilitation, and social healing. Moreover, the study reveals a gap between legal-normative frameworks and community practices, where punitive attitudes prevail over rehabilitative intentions. From the perspective of Islamic ethics, values such as rahmah (compassion), tawbah (repentance), and islah (reconciliation) serve as essential moral foundations that advocate for the acceptance and reintegration of reformed individuals. These values emphasise the potential for personal transformation and the collective responsibility of society to facilitate restorative outcomes. This study recommends a holistic synergy between restorative justice mechanisms, Islamic ethical values, and public education initiatives to dismantle stigma, promote inclusivity, and foster a more humane justice system. The academic contribution of this research lies in its integrative framework that combines socio-legal theory with Islamic moral philosophy to critically assess the structural and cultural barriers to reintegration, offering a contextualised model for human-centred restorative justice in Muslim-majority societies.
