Abstract

The crime of corruption is an extraordinary crime because it is systemic, endemic with a very wide impact which not only harms the state's finances, but also violates the social rights and economic rights of the wider community so that its action needs special efforts. The formulation of the problem in this thesis is how to regulate corruption offenses in Law Number 20 of 2001 concerning the Eradication of Criminal Acts of Corruption, how to qualify offenses and sanctions related to the act of promising to stop case investigations by police officers in the decision Number 01/Pid. Sus/2017/PN. Mdn, what is the basis for the judge's consideration in making a decision against the defendant in the decision Number 01/Pid. Sus/2017/PN. Mdn. The research method used is descriptive analysis that leads to normative juridical legal research, namely research conducted by referring to legal norms, namely researching library materials or secondary materials. Secondary data by processing data from primary legal materials, secondary legal materials and tertiary legal materials. The results of the study indicate that the provisions governing the crime of Corruption Crimes in Indonesia are regulated in Law Number 20 of 2001 concerning the Eradication of Corruption Crimes in conjunction with Law Number 31 of 1999 concerning the Eradication of Corruption Crimes. Qualification of offenses and sanctions related to the act of promising to stop the investigation of cases by police officers in decision Number 01/Pid Sus/2017/PN. Mdn is a defendant who has been legally and convincingly proven to have committed a criminal act of corruption. The basis for the judge's consideration in making a decision against the defendant is in the decision Number 01/Pid. Sus/PN. Mdn is based on legal considerations, the element of receiving a gift or promise has been proven and fulfilled convincingly guilty of committing a criminal act of corruption.

Abstract

Coronavirus pandemic 2019-2020 or known as Covid-19, which spread throughout the world, including Indonesia, has caused casualties and disrupted the economy. Various attempts were made by the government to overcome the increasingly massive impact of the spread of Covid-19. One of them is by issuing the Government Regulations in Lieu of Laws No. 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling Covid-19 Pandemic. Regarding this assistance provided by the government, it is miserable to have allowed the occurrence of criminal acts of corruption committed by government officials and their instruments. The purpose of this paper is to pay attention to the handling and eradication of corruption of Covid-19 Pandemic aid funds. The method used in this paper is to analyze data qualitatively in relation to this research which is a normative juridical type. The data used are primary and secondary data obtained through the search of legislation and materials related to the issues raised. As a result, this article argues that when there have never been cases of corruption whose actors have been sentenced to death in a normal situation, it might be possible for the misuse of the Covid-19 pandemic aid funds can be sentenced to death.

Abstract

Legal aid constitutes the constitutional right of every citizen to the legal protection and equality guarantees before the law stipulated in Law Number 16 of 2011, as a means of recognition of human rights. So far the provision of legal aid we realize has not much touched the poor. Thus, the poor are still difficult to access justice. The problem in this research is how to give free legal aid to increase access of justice for society in Indonesia. Based on the results of research on the implementation of Legal Aid to the poor in North Sumatra, it can be concluded that the implementation of Legal Aid for the poor People in the province is not optimal yet since the aid cannot be felt by all levels of society, especially the poor in the province. Then, the poor still find difficulty to access and to obtain free legal aid so that it becomes homework for the government, the parties providing legal aid and Legal Aid Institute. Providing legal aid to the poor in North Sumatra should be given more attention. The improvements of regulations or legislation in particular that regulate the APBD (Regional Income Budget)  must be re-strengthened to realize equality before law. Keywords: Legal Aid, Justice, The Poor

Abstract

The purpose of correctional is to return the assisted citizens to good ones and to prevent them from repeating the deeds. The legal reform package launched by the Indonesian President, Joko Widodo, begins to run as the reforms in the economic sector. People have great hopes for this reform of law. In the package of legal reform, one of them is strengthening the fostering of prison (LP).                The main problem is the over capacity of the assisted citizens in almost all the prisons (LP)  or correctional institution (Rutan) in Indonesia and the problem of guidance systems for the assisted citizens and for the officers in the prison as well. We all know that the capacity of the prisoners in Indonesia has exceeded, and this becomes the problem; therefore, it is no longer a public secret if a prisoner has a lot of money, he becomes like a king in the prison.                With the inclusion of this issue as part of legal reform package, it is expected that there is a significant improvement. Within the set of criminal justice systems, LP as a sub-system has an equally important role with other sub-systems. The LP can no longer be viewed as a Disposal institution. It has been long enough that LP received less serious attention than other sub-systems; so at the time when news about circulation of drugs controlled from within the LP was spreading over, it gets more serious attention portion.                The high demand for criminal offenses on criminal acts such as narcotics, terrorism, morality, corruption, besides murder, will directly affect the rise of the number of prisoners. Moreover, in recent years the booming arrest of narcotics has led to a dramatic increase in the inhabitants of LP. The inhabitants of LP in Indonesia are mostly filled by narcotics actors, both distributors and users and other criminals.

Abstract

AbstrakPelaksanaan pemberantasan dan penanggulangan oleh kepolisian Banda  Aceh melalui tindakan preventif dan represif. Tindakan preventif dilakukan melalui sosialisasi, penyuluhan, pendekatan dengan keluarga, masyarakat dan lain sebagainya. Upaya tersebut merupakan bentuk pencegahan yang dilakukan secara institusional maupun kerjasama dengan partisipasi masyarakat. Sosialisasi dan penyuluhan tentang bahaya penyalahgunaan narkoba menjadi prioritas bagi kepolisian agar tindakan represif  (tindakan penangkapan) dapat diminimalkan. Criminal justice system di Indonesia dapat dilihat dari berbagai mekanisme dan sistem sebagaimana diatur dalam Undang-Undang Nomor 8 Tahun 1981 tentang Kitab Hukum Acara Pidana. Kelembagaan yang termasuk dalam sistem tersebut adalah: Pertama, Penyelidik dan penyidik (Kepolisian RI), sebagaimana tertuang dalam Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian, selaku Pengemban Fungsi Kepolisian, dibantu oleh Kepolisian Khusus, Penyidik Pegawai Negeri Sipil, dan bentuk-bentuk pengamanan swakarsa. Kedua, Penuntut adalah Kejaksaan sebagaimana tertuang dalam Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan, diberikan wewenang tambahan melakukan penyidikan atas tindak pidana khusus seperti tindak pidana narkotika.  Dalam kesimpulan tesis ini peneliti berharap kepada pihak kepolisian Banda Aceh untuk lebih meningkatkan kinerja dalam mengidentifikasi penyalahgunaan narkoba di lingkungan pelajar dan masyarakat dan memanfaatkan fasilitas yang ada seusai dengan tugas, tanggung jawab, fungsi dan wewenang kepolisian Banda Aceh serta senantiasa aktif dalam menyampaikan kekurangan tenaga ahli/profesional dan sarana prasarana kepada pihak atasan dalam kegiatan pemberantasan dan penanggulangan tindak pidana penyalahgunaan narkoba. Kata Kunci : Narkoba, Putusan Pengadilan Negeri  AbstractThe implementation of eradication and countermeasures by the Banda Aceh police through preventive and repressive measures. Preventive actions are carried out through socialization, counseling, approaches with families, communities and so on. This effort is a form of prevention carried out institutionally and in collaboration with community participation. Socialization and counseling about the dangers of drug abuse are a priority for the police so that repressive actions (actions of arrest) can be minimized. The criminal justice system in Indonesia can be seen from various mechanisms and systems as regulated in Law Number 8 of 1981 concerning the Code of Criminal Procedure. Institutions included in the system are: First, investigators and investigators (Indonesian Police), as stipulated in Law Number 2 of 2002 concerning the Police, as Police Function Bearers, assisted by the Special Police, Civil Servant Investigators, and other forms of self-defense. Second, the Prosecutor is the Prosecutor's Office as stated in Law Number 16 of 2004 concerning the Prosecutor's Office, given additional authority to conduct investigations on special crimes such as narcotics crimes. In the conclusion of this thesis, the researcher hopes that the Banda Aceh police will further improve their performance in identifying drug abuse in students and the community and take advantage of existing facilities in accordance with the duties, responsibilities, functions and authorities of the Banda Aceh police and always be active in conveying the shortage of experts. / professionals and infrastructure to the superiors in the activities of eradicating and overcoming the crime of drug abuse. Keywords: Drugs, District Court Decision

Abstract

Aturan hukum mengenai penyadapan tersebut masih tersebar di dibeberapa Undang-Undang. Hal tersebut dikarenakan tidak ada aturan hukum yang secara khusus mengatur mengenai penyadapan. Dikhawatirkan terjadi ketidakpastian hukum yang memiliki kewenangan melakukan penyadapan dan mengenai pengakuan hasil penyadapan sebagai alat bukti. Terlihat adanya pertentangan antara dua kepentingan negara dalam melindungi hak privasi warga negaranya dan kepentingan negara dalam menegakkan hukum. Berdasarkan pertentangan antara dua kepentingan tersebut menyebabkan ada sebagian warga negara yang merasa haknya konstutisionalnya dilanggar dengan adanya tindakan penyadapan. Masyarakat mengajukan Judicial Review atau pengujian kembali terhadap beberapa aturan yang mengatur mengenai penyadapan di Mahkamah Konstitusi. Putusan mahkamah konstitusi tersebut adalah Putusan Mahkamah Konstitusi Nomor 006/PUU-I/2003, Putusan Mahkamah Konstitusi Nomor 012-016-019/PUU- IV/2006, Putusan Mahkamah Konstitusi Nomor 5/PUU-VIII/2010 dan Putusan Mahkamah Konstitusi Nomor 20/PUU-XIV/2016. Penelitian ini bertujuan untuk menganalisis Racio Decidendi Putusan Mahkamah Konstitusi Nomor 5/PUU- VIII/2010 dan Putusan Mahkamah Konstitusi Nomor 20/PUU-XIV/2016 dan menganalisis kewenangan lembaga pemenegak hukum dalam perolehan alat bukti hasil penyadapan pasca Putusan Mahkamah Konstitusi. Permasalahan dalam penelitian ini adalah Bagaimana Konsep Pengaturan Hukum Penyadapan berbasis Perlindungan Terhadap Hak Privasi Seseorang, kemudian Bagaimana Manfaat terhadap adanya pengaturan Hukum Penyadapan atas pelaku tindak pidana korupsi di Indonesia. Sedangkan penelitian ini adalah dapat dikategorikan menjadi penelitian doktrinal atau disebut juga penelitian hukum normatif. Penelitian doktrinal adalah suatu penelitian hukum yang bersifat peskriptif bukan deskriptif sebagaimana ilmu sosial dan ilmu alam. Pendekatan- pendekatan yang digunakan adalah pendekatan undang-undang (statute approach), pendekatan kasus (statute approach), pendekatan historis (historical approach), pendekatan komparatif (comparative approach), dan pendekatan konseptual (conseptual approach).Kata Kunci : Penyadapan, Tindak pidana korupsi, Kewenangan.

Abstract

KUHP sendiri masih memasukkan pembunuhan mutilasi ke dalam pembunuhan biasa atau pembunuhan berencana. Permasalahan dalam ini adalah bagaimana pengaturan tindak pidana pembunuhan yang dimutilasi di Indonesia, apa faktor penyebab terjadinya kejahatan pembunuhan dengan mutilasi dalam pandangan ilmu krimonologi, bagaimana pertimbangan hukum hakim terhadap tindak pidana pembunuhan yang disertai mutilasi dalam Putusan Nomor 535/Pid.B/2019/PN.Mlg. Penelitian yang dilakukan adalah penelitian normatif yaitu penelitian yang menggunakan peraturan perundang-undangan sebagai dasar pemecahan permasalahan yang dikemukakan. Data yang dipergunakan adalah data sekunder dan metode pengumpulan data yang digunakan dalam penelitian ini adalah Penelitian kepustakaan (library research). Pengaturan tindak pidana pembunuhan yang dimutilasi di Indonesia belum ada undang-undang maupun peraturan yang secara khusus mengatur tentang kejahatan dengan mutilasi. Kitab Undang-Undang Hukum Pidana (KUHP) Indonesia, tidak ada ketentuan khusus tentang tindak pidana mutilasi tetapi yang ada hanya tentang tindak pidana pembunuhan pada umunya saja sesuai yang diatur dalam Pasal 338 KUHP dan Pasal 340 KUHP.Faktor penyebab terjadinya kejahatan pembunuhan dengan mutilasi dalam pandangan ilmu krimonologi dapat dibagi menjadi 2 (dua) faktor, yakin faktor intrinsik (intern) dan faktor ekstrinsik (ekstern). Faktor intrinsik (intern) yaitu: faktor kebutuhan ekonomi yang mendesak, faktor intellegence, faktor usia, dan faktor jenis kelamin. Sedangkan faktor ekstrinsik (ekstern) yaitu: faktor pendidikan, faktor pergaulan, faktor lingkungan, faktor pekerjaan, dan faktor lemahnya sistem keamanan lingkungan masyarakat. Berdasarkan hasil penelitian dipahami bahwa pertimbangan hukum hakim dalam memberikan putusan terhadap pelaku pembunuhan dengan mutilasi adalah perbuatan terdakwa merupakan perbuatan yang sangat keji dan tidak berperikemanusiaan, kejahatan yang mengancam dan membahayakan kehidupan masyarakat.

Abstract

Terjadinya kecelakaan lalu lintas banyak menimbulkan korban, meninggal dunia maka bagi pelaku bisa dijerat dengan pembunuhan karena kealpaan atau kelalaian dalam mengemudikan kendaraan bermotor. Penerapan tersebut diatur dalam Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan. Rumusan masalah adalah bagaimana pengaturan hukum tindak pidana akibat kelalaian pengemudi yang menyebabkan kecelakaan lalu lintas mengakibatkan orang meninggal, bagaimana menentukan kelalaian atas kesengajaan dalam tindak pidana dalam peristiwa kecelakaan lalu lintas, bagaimana pertanggungjawaban pidana akibat kelalaian pengemudi yang menyebabkan kecelakaan lalu lintas mengakibatkan orang meninggal menurut Putusan Pengadilan Negeri Banda Aceh Nomor 28/Pid.Sus/2019/PN Bna.Metode penelitian yang digunakan adalah deskriftif analisis yang mengarah pada penelitian hukum yuridis normatif yakni penelitian yang dilakukan dengan cara mengacu pada norma-norma hukum yaitu meneliti terhadap bahan pustaka atau bahan sekunder. Data sekunder dengan mengolah data dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil penelitian menunjukkan bahwa pengendara yang lalai dalam mengemudi hingga menyebabkan kecelakaan yang mengakibatkan orang lain meninggal dunia, dipidana dengan pidana penjara paling lama enam tahun atau denda. Menentukan kelalaian atas kesengajaan dalam tindak pidana dalam peristiwa kecelakaan lalu lintas yang mengakibatkan kematian terhadap unsur kesengajaan yaitu dengan sengaja mengendarai kendaraan bermotor dengan cara berbahaya dan mengancam keselamatan pengguna jalan. Pertanggungjawaban pidana akibat kelalaian pengemudi yang menyebabkan kecelakaan lalu lintas mengakibatkan orang meninggal menurut Putusan Pengadilan Negeri Banda Aceh Nomor 28/Pid.Sus/2019/PN.Bna adalah menjatuhkan pidana terhadap terdakwa dengan pidana penjara 11 (sebelas) hari. Dasar pertimbangan hakim dalam menjatuhkan pidana terhadap pelaku tindak pidana kelalaian yang mengakibatkan orang lain meninggal dunia adalah perbuatan terdakwa menyebabkan orang meninggal dunia, sedangkan hal-hal yang meringankan adalah terdakwa belum pernah dihukum, terdakwa mengakui secara terus terang perbuatannya di persidangan dan menyesali perbuatannya tersebut. Selain itu terdakwa dengan keluarga korban sudah ada perdamaian.
