Abstract

Prinsip Notaris Dalam Pengenalan Pelaku Tindak Pidana Pencucian Uang Kartina Pakpahan, Maggie, Christian Agung Prawito, Wico Dwi Pratama Abstract Fakultas Hukum Universitas Prima Indonesia Jalan Sekip Simpang Sikambing, Medan, Sumatera Utara maggielie52@gmail.com Written statutory regulation has given a role to the Notary regarding to eradication of the criminal offence of money laundering. Basically the duties and obligations of a Notary are to make a deed in accordance with the statement made by the parties before the Notary based on what is seen and heard by the Notary. The Notary's capability in implementing its duty related to the truth statements of the parties and testimony of the truth of what is seen and heard by the Notary, it is only confined to the formal truth and not the material truth. Based on its capability, it is difficult for the Notary to seek for the material truths that can prove the existence of a criminal offense of money laundering. The Notary’s role in identifying the perpetrator of money laundry by the Notary as regulated in statutory regulation is still ineffective or not in line with expectations because the regulation has not gone well and cannot yet become an accurate indicator in identifying a crime at the early stage of the perpetrators of money laundering by the Notary. In the future, the Notary in carrying out its duties require an accurate indicator to be able to identify the perpetrators of money laundering crime optimally based on statutory regulations. Intisari Peraturan perundang-undangan secara tertulis telah memberikan peranan terhadap Notaris dalam pemberantasan tindak pidana pencucian uang. Pada dasarnya tugas dan kewajiban Notaris adalah membuat akta sesuai dengan pernyataaan para penghadap dihadapan Notaris atau membuat akta sesuai dengan yang dilihat dan didengar oleh Notaris. Kemampuan Notaris dalam menjalankan tugasnya atas kebenaran pernyataan para penghadap dan kebenaran apa yang dilihat serta didengar oleh Notaris tersebut hanya sampai kebenaran formil tidak sampai kebenaran materiil. Berdasarkan kemampuannya, sulit bagi Notaris untuk mencari kebenaran materiil yang membuktikan adanya tindak pidana pencucian uang. Peran notaris dalam mengenali pelaku pencucian uang oleh Notaris yang diatur dalam peraturan perundang-undangan masih belum efektif atau tidak sesuai dengan harapan karena peraturan tersebut belum berjalan dengan baik dan belum dapat menjadi indikator yang akurat dalam mengenali pelaku kejahatan pencucian uang oleh Notaris. Kedepannya, Notaris dalam menjalankan tugasnya membutuhkan suatu indikator yang akurat untuk dapat mengenali pelaku kejahatan pencucian uang secara optimal berdasarkan peraturan perundang-undangan..

Abstract

ABSTRACT Distributing Imported Horticultural Fresh Products to consumers takes a long time or days so that they have to meet the quality standard and/or food security so that they will be safe to be consumed and will not harm consumers health and social welfare. Article 88 Paragraph 1 and 4 of law No.13/2010 on Horticulture regulate responsibility that everyone who distributing imported horticultural fresh products have to meet quality standard and/or food security. Criminal provision expressly stated in the article 128 and 129 of law No.13/2010 on Horticulture, anyone who distributing imported horticultural fresh products that do not meet the quality standard and/or food security required criminally accountable for his actions because it is very harmful to human health both present and future generations. The Criteria of quality standard and/or food security is stipulated in PP No.28/2004 on Food, Quality and Nutrition. Criminal responsibility, applied to perpetrators in criminal act and implemented in the principle of “no crime without any fault”. Fault aspects can be in the form of taking responsibility, willfulness or negligence and excusing liability. The three aspects cannot be separated since they depend on one to another consecutively, an indispensable element for legal subject to be accountable committing the criminal act distributing imported horticultural fresh products that do not meet the quality standard and/or food security. Legal subjects that anyone can be responsible consist of Individuals,Official Empowered to have autority in giving permit, supervision in distributing imported horticultural fresh products, and corporate comprising legal entity and is not a legal entity.

Abstract

Mayarakat harus dilindungi dari pangan berbahaya Tujuan Penelitian untuk mengetahui dan menganalisis perlindungan hukum, penanggulangan tindak pidana pangan berbahaya saat ini. Penelitian ini bermanfaat secara teoritis dan Praktis. Jenis penelitian Yuridis Normatif, Analisis bahan hukum secara kualitatif diuraikan secara deskriptif analitis dan preskriptif. Bentuk perlindungan hukum terhadap tindak pidana peredaran pangan berbahaya di Indonesia diatur dalam Undang-Undang Perlindungan Konsumen secara umum dan Undang-Undang Pangan secara khusus. Di Tiongkok diatur dalam peraturan perundang-undangan Keamanan Pangan Republik Rakyat Tiongkok. Administrasi Makanan dan Obat-Obatan Negara China SFDA bertanggung jawab mengawasi dan mengoordinasikan lembaga kesehatan, makanan, dan obat-obatan. Tiap negara perlu memperhatikan sistem perlindungan hukum yang diterapkan dan memberi hukuman yang berat kepada pelaku sehingga memberikan efek jera. Upaya Penanggulangan Tindak Pidana Peredaran Pangan Berbahaya di Indonesia dilakukan dengan Upaya Pre-Entif, Preventif dan Represif. Ditiongkok menerapkan hukuman pidana penjara dan denda, dan adanya pengawasan oleh SFDA. Diperlukan upaya memberi pemahaman bagaimana pangan yang berbahaya kepada masyarakat agar dapat mengurangi resiko pangan berbahaya.

Abstract

Perkembangan dunia kecantikan saat ini berkembang sangat pesat di berbagai kalangan. Dunia kecantikan memiliki fungsi dalam bidang kesehatan contohnya rekonstruksi seperti kasus-kasur luka bakar, trauma wajah pada kasus kecelakaan, cacat bawaan lahir (congetinal) dan lain-lain. Oleh karena itu banyak orang yang berbondong-bondong melakukan bedah pelastik karena tergiur dengan banyaknya iklan-iklan yang begitu menjanjikan. semakin tinggi tingkat bedah plastik maka tak bisa di pungkiri akan terjadinya kasus malpraktek. Penelitian ini bertujuan untuk mengetahui dan menganalisis perlindungan hukum, penanggulangan tindak pidana malpraktek bedah plastik yang saat ini berlaku. Penelitian ini bermanfaat secara teoritis dan Praktis berkaitan dengan perlindungan konsumen dalam bidang malpraktek bedah plastik. Jenis penelitian yang digunakan adalah penelitian Yuridis Normatif. Analisis bahan hukum yang dipergunakan menggunakan analisis secara kualitatif dengan menguraikan secara deskriptif analitis dan preskriptif. Berdasarkan penelitian Bentuk perlindungan hukum terhadap tindak pidana malpraktek bedah plastik di Indonesia diatur dalam Undang-Undang Perlindungan Konsumen secara umum dan Undang-Undang kesehatan dan kedokteran secara khusus. Di Korea diatur dalam Konstitusi Korea Selatan yang isinya mengenai keamanan dalam hal malpraktek. Setiap negara mengalami kasus malpraktek yang berbeda, begitu juga dengan cara penanggulanganya berbeda. Tiap negara hanya perlu memperhatikan sistem perlindungan hukum yang diterapkan sehingga memberikan efek jera kepada pelaku malpraktek bedah plastik yang tidak sesuai dengan standar nasionalnya dan juga memberikan arahan dan bimbingan yang cukup kepada masyarakatnya agar dapat memahami bagaimana agar mengurangi resiko malpraktek berbahaya yang terjadi.

Abstract

The state has an obligation to protect, supervise every product that is circulated for consumption by the public. This study aims to identify and analyze the form of legal protection for consumers so that illegal drug and food circulation which is circulated through social media does not occur, analyze the criteria for drugs and food without a distribution permit, and forms of accountability for business actors who commit acts normative juridical research methodology using literature study. The data analysis of this research used a qualitative approach. Law Number 80 of 2017 concerning Drug and Food Control was established to protect the public against any drug product whose registration is not registered based on applicable regulations. Accountability for the distribution of illegal drugs can be subject to criminal sanctions based on Article 196 jo 197 of Law Number 30 of 2009 concerning health if it meets the elements of error and unlawful acts.

Abstract

The role of the state is important in realizing the availability regulation for the fulfillment of safe, quality, nutritious food. This study aims to find out the positive law regarding criminal liability to perpetrators who circulate food without permission and crime prevention efforts. Using library research, normative juridical methods, analyzing qualitative approach data. Packaged, circulated food must have a marketing authorization. Corporations may be liable to include organs from corporations if they have errors as regulated in Article 91. The act of distributing certain processed domestic and foreign processed food products that are marketed in secure packaging without permission with a criminal fine is regulated in Article 142 of the Food Law. Mitigation efforts are carried out through both penal and non-penal policies. Keywords: criminal liability, corporation, food without permission

Abstract

The purpose of this research is to regulate the administration of administrative sanctions in the plantation sector, the application of administrative sanctions for plantation companies and the supervision efforts undertaken by the government as an effort to prevent administrative violations in the plantation sector. Using normative juridical research, namely library research. The source of legal materials used is secondary data. Law Number 18 of 2004 concerning plantations states that realizing the prosperity of the community and welfare in a fair manner, one form of processing natural resources is needed in a responsible, planned, integrated and professional manner.

Abstract

Foreign investment in Indonesia in the plantation sector has a positive impact on national development. The need for encouragement and support in the plantation business by creating policies,which one is able to increase foreign investment in the plantation business. The purpose of this research is to analyze from the perspective of the prevailing law in Indonesia and to find out the factors that hinder the restriction of foreign investment in the plantation sector. This study uses a normative juridical method, namely by using a qualitative approach. The conclusion of this study is that the mechanism for limiting foreign investment in the plantation sector is regulated in Law Number 25 of 2007 concerning Foreign Investment and Law Number 39 of 2014 concerning Plantations, where these regulations must be considered by foreign investment in investing in plantation sector in Indonesia. The factors that hinder foreign investment are the usual business actors bribing State officials, the problem of being limited to opening a business entity because the land acquisition process is too long.

Abstract

The Indonesian country is rich in farmed communities, especially agricultural livelihoods. It is not rare that farm yields fail to meet its quality standards, satisfy the health and safety of masvardized research purposes, which are assessed the form of legal protection to consumers, plantation criteria, punishments that are given to criminal processing, distribution and or or marketing of health and safety estates. Using normatif juridical research methods by studying the major issues based on data obtained. The study USES analytical descriptive properties to give swift response to the objects being examined. The conclusion that the processing, distribution and marketing of plantation products has been established in article 77 Jo 110 of the 2014 section no. 39 on plantation and section no. 8 of 1999 on consumer protection. Food and drug administration regulation no. 28 stages 2019 of food-care agents. The use of additives or helper that is used does not fit security requirements and quality or use that exceeds have adverse effects on human health and safety. At the risk of public health and safety, non-performing consumers will be punished by the da's criminal penalties

Abstract

Standar Mutu dan Keamanan Peredaran Vaksin Covid-19 sangat penting. Berbagai strategi dan pengembangan vaksin Covid-19 telah dilakukan untuk pengendalian pandemi Covid-19. Berbagai vaksin telah menjalani uji klinis dengan hasil yang menjanjikan di berbagai negara. Efektifitas dan keamanan jangka pendek dan jangka panjang dari vaksin menjadi perhatian utama dalam uji klinis di strategi dan pengembangan tersebut. Tujuan penelitian ini untuk mengetahui standar mutu dan keamanan vaksinasi covid-19 sebelum di edarkan dan diberikan kepada masyarakat, serta permasalahan penanganan covid-19 dan juga cara penanggulangan peredaran vaksin covid-19 yang tidak sesuai dengan standar dan mutu. Penelitian ini menggunakan metode yuridis normatif dengan menelaah dan pendekatan perundang-undangan. Pemberian dan peredaran vaksin Covid-19 ini harus sesuai dengan standar mutu WHO dan dapat dipastikan keamanan, khasiat, dan mutu oleh BPOM terhadap seluruh obat yang diedarkan di wilayah Indonesia. Kelemahan dari pengaturan tindak pidana penanganan Covid-19 di Indonesia masih perlu perbaikan karena tidak menimbulkan efek jera kepada warga negara. Penanggulangan kejahatan vaksinasi yang tidak sesuai dengan standar mutu dilakukan dengan cara Penal dan Non Penal.
