Abstract

The BPNT program in Lebak Regency is administered by PT. X. It now has 106,230 Beneficiary Families. PT. X is suspected of engaging in monopoly behavior, infringing Article 25 Paragraph (1) letters a, b, and c regarding Dominant Position, and violating Article 26 about Multiple Positions. The goal of this study is to examine PT. X's alleged monopolistic behavior using a rule of reason approach in accordance with the provisions of Law No. 5 of 1999 prohibiting monopolistic practices and unfair business competition. This research employs a legal-normative approach with a statutory focus. The data are derived from secondary sources such as legislation, books, and periodicals that are regarded as primary legal material. Qualitative methods were used to assess data collected during field research and document studies. The findings indicated that PT. X did not exhibit monopolistic behavior, market control, or the absence of concurrent positions that result in unfair commercial competition. Additionally, PT X does not meet the requirements of Article 25 of Law No. 5 of 1999 prohibiting Monopolistic Practices and Unfair Business Competition in Connection with a Dominant Position because it has not been established that other business actors cannot engage in business competition for identical goods or services, implying that PT. X cannot be said to be engaging in monopolistic practices or unfair business competition in connection with a dominant position. Additionally, PT. X's distribution of BPNT lacks a feeling of justice, which contributes to the absence of welfare. To anticipate and mitigate this, KPPU must supervise companies involved in the BPNT program in Lebak Regency. To avoid regulations that violate business competition law, the government can refer to the OECD Toolkit Regulatory Impact Assessment, a systemic approach for critically assessing the positive and negative effects of existing regulations.Keywords: BPNT; Monopoly; Dominant Position; Well-being  AbstrakProgram BPNT di Kabupaten lebak dengan total 106.230 Keluarga Penerima Manfaat yang dikuasai oleh PT. X.  Penguasaan tunggal tersebut menjadikan PT. X diduga melakukan praktek monopoli, pelanggaran Pasal 25 Ayat (1) huruf a, b, dan c yaitu tentang Posisi Dominan dan pelanggaran pasal 26 tentang Jabatan Rangkap. Tujuan penelitian ini untuk menganalisa dugaan praktek monopoli PT. X melalui pendekatan rule of reason dihubungkan dengan Undang-Undang Nomor 5 tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Metode yang digunakan dalam penelitian ini yaitu yuridis-normatif dengan pendekatan perundang-undangan, data diperoleh dari data sekunder, yang dijadikan bahan hukum primer berupa perundang-undangan, buku dan jurnal. Data diperoleh dari studi lapangan dan studi dokumen kemudian dianalisis menggunakan metode kualitatif. Hasil penelitian menunjukan bahwa PT. X tidak memenuhi unsur praktek monopoli, penguasaan pasar dan tidak adanya rangkap jabatan yang menimbulkan persaingan usaha tidak sehat. Selain itu PT X juga tidak memenuhi unsur Pasal 25 Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat yang terkait dengan Posisi Dominan karena tidak terbukti mengakibatkan pelaku usaha lain tidak dapat masuk ke dalam persaingan usaha barang dan atau jasa yang sama, sehingga PT. X tidak dapat dikatakan melakukan praktek monopoli dan persaingan usaha tidak sehat dengan pengamatan yang sesuai teori rule of reason. Tindakan penyaluran BPNT yang dilakukan PT. X juga tidak memberikan rasa keadilan yang berdampak pada minimnya kesejahteraan. Upaya mengantisipasi dan meminimalisir hal tersebut diantaranya, KPPU perlu mengawasi perusahaan yang terkait dengan program BPNT di Kabupaten Lebak dan sebagai upaya pencegahan peraturan yang bertentangan dengan hukum persaingan usaha, pemerintah dapat mengacu pada OECD Toolkit Regulatory Impact Assessment yaitu pendekatan sistemik untuk menilai secara kritis efek positif dan negatif dari regulasi yang ada.Kata Kunci: BPNT, Monopoli, Posisi Dominan, Kesejahteraan

Abstract

This research was conducted with the aim of knowing the legal issues based on Law No. 8 of 1999, Therefore, From Shopee user reviews it is known that the Shopee application still needs to be improved. For this reason, research was conducted to see public satisfaction with the Shopee application through the e-service quality method. goods purchased by consumers do not reach their hands and are sold conventionally (face-to-face). Consumers are often the subject of losses from online trading activities when the products received by consumers are not as ordered, delays in receiving products and non-delivery of products that have been ordered by consumers. The question that arises then is whether these provisions can apply universally to all cases, or only in certain cases that can create a sense of justice for the parties, With the formulation of the problem how to know the Legal Protection for consumers in online buying and selling transactions related to the Non-conformity of goods offered based on Law Number 8 of 1999 concerning Consumer Protection and how to know the legal consequences if business actors send goods that do not match the specifications of the goods offered in Online Buying and Selling. This study uses an empirical juridical method, namely by examining this research from primary data where data can be obtained directly from the first source through primary data acquisition, namely from field data that can be done through observation, observation, (interviews), or distributing questionnaires. In this study the author uses a statutory approach. The statutory approach is an approach carried out by analyzing rules and regulations related to legal issues. With the aim of getting answers to the problems raised with the conclusion of the use of rules applied in Law Number 8 of 1999 concerning Consumer Protection, legal protection is included in Article 7 paragraphs a, b, c, d. However, for consumers in South Jakarta City, it is not running effectively. Existing laws are not able to protect consumers as they should. Several consumers have filed complaints to demand compensation or redress, but business actors often ignore these complaints and are not responsible. As a result, the legal protection expected by consumers in South Jakarta City cannot be fulfilled.
