Abstract

Indonesia as a state of law has ratified several international human rights instruments, especially the Convention on the Rights of the Child, in which the state should ensure the protection, respect, fulfillment, promotion, and enforcement of children's rights. In fact, many children have been treated unjustly in the fulfillment of their rights when conflicting with the law.  Methods of legal protection of the rights of children conflicting with the law are based on the provision that “every child has the right to survive, grow and develop as well as the right to protection from violence and discrimination”. Other ways to protect children’s rights may also include the policy that children conflicting with the law should be treated humanely in accordance with their dignity and rights; special personnel should be provided for their companion and counseling; sanctions should be appropriated for the best interests of the children; and special facilities and infrastructure for children should be equally provided. This means that appropriate sanctions should hence be supported through the process of resolving cases using the principle of “diverse and restorative justice  The concept of diverse and restorative justice can be applied to the crime of under 7th-year punishments and non-repeated crime. Methods for handling children who have conflicts with the law have hitherto emphasized on normative juridical processes such as investigation, prosecution, and examination of the case by the judge (in court). The processes, however, have not guidelines or technical manuals for law enforcement officers to implement the non-litigation settlement for children cases

Abstract

Penerapan dan perlindungan hukum yang mengatur terhadap perlindungan konsumen sudah diatur didalam undang-undang No.8 Tahun 1999 tentang perlindungan konsumen. Didalam skripsi ini dimana agar konsumen dapat mendapatkan jaminan atau pertanggung jawaban terhadap apa yang dibeli terhadap barang atau jasa dari para penjual pedagang kaki lima, adapun dalam skripsi ini bertujuan agar mengetahu penerapan dan Sanksi UU No.8 Tahun 1999 tentang perlindungan konsumen terhadap pelaku usaha pedagang kaki lima di wilayah semarang Utara.Di dalam Penelitian ini agar untuk mendapatkan data serta infomasi analisa data dilakukan dari hasil mengolahan data yang telah terkumpul dan selanjutanya dianalisis.Penulis menggunakan pendekatan metode kualitatif dengan cara menganalisis data-data serta studi kepustakaan dan sumber data primer berupa wawancara dengan narasumber ketua paguyuban pedagang kaki lima wilayah semarang Utara di lapangan.Berdasarkan hasil dari penelitian yang penulis lakukan dapat diperoleh hasil dan kesimpulan yaitu bahwa para pedagang kaki lima diwilayah semarang utara masih belum banyak yang mengetahui mengenai UU No.8 tahun 1999 tentang perlindungan konsumen serta sanksi apa saja yang dapat diberikan jika para pedagang kaki lima ketahuan melakukan kecurangan atau pelanggaran dalam berjualan.Namun pemerintah sudah melakukan adanya penyuluhan terhadap para penjual pedagang kaki lima, berdasarkan kesimpulan bahwa setiap para pelaku usaha pedagang kaki lima diwilayah semarang utara tetap berupaya menjual barang dagangannya dengan baik dan bertanggung jawab apabila terdapat barang atau produk yang tidak sesuai saat ditawarkan dan dibeli oleh konsumen.

Abstract

The author's research was in writing a thesis entitled Law Enforcement and Sanctions Based on Regional Regulation Number 5 of 2014 on Legal Protection Efforts for Street Children and Their Obstacles in the City of Semarang. This research method involves field surveys, interviews, and qualitative data analysis. The data sources used will produce a description of what will later be described in the form of written or spoken sentences (interviews) by law enforcers who experience exploitation of street children in the city. Semarang, as well as supporting sources such as laws and regulations, books or other literacy. The results of this research highlight the complexity of the reality of street children's lives and offer deeper insight into the efforts that can be made to improve their welfare

Abstract

Waste management is still an unresolved problem to this day. This research aims to examine problems in waste management in Kendal Regency. This research is normative legal research with a statutory approach. Data was collected using literature studies and analyzed qualitatively. Kendal Regency has several laws and regulations related to waste management, especially Regional Regulation Number 13 of 2012 concerning Waste Management and several other laws and regulations. Law enforcement in waste management refers to three legal systems which are a combination of structural, material and cultural components. Apart from that, related to law enforcement in waste management, it can be studied from 2 sides, namely preventive and repressive law enforcement. Even though a strong legal basis has been provided by regional regulations, the implementation of sanctions still faces problems. The main obstacles are low public awareness, limited resources, and technical problems in waste management infrastructure. Sanctions applied for violations of regulations include verbal warnings, written warnings and fines. Sanctions have not been able to provide significant deterrence, according to the evaluation. Therefore, this research provides suggestions for improving the law enforcement system, increasing public awareness, and overcoming technical problems so that Regional Regulation Number 13 of 2012 in Kendal Regency can be better implemented in terms of sustainable waste management. Effective law enforcement can help create a clean, healthy and sustainable environment while ensuring that each party is responsible for waste management.

Abstract

Smoking is the act of inhaling tobacco smoke, which has serious impacts on health and society. Even though reduction efforts have been made, Indonesia has a high smoking prevalence rate. No-Smoking Areas are regulated by Law Number 3 of 2013. Challenges in enforcing the rules arise in public places, with a lack of awareness and supervision. This research highlights the obstacles and effectiveness of law enforcement by Satpol PP in Semarang City regarding Regional Regulation Number 3 of 2013 concerning No-Smoking Areas. This research uses qualitative methods to explain the interactions between researchers and respondents. Research parameters include analysis and description. The data source is secondary data from primary and secondary legal materials. Data collection methods involve interviews, observation, literature study, and documentation. Data is presented in narrative form, and data analysis uses a qualitative normative approach. The research focuses on enforcing no-smoking area rules in the city of Semarang. Semarang, capital of Central Java, Indonesia. The research highlights the enforcement of Semarang City Regional Regulation Number 3 of 2013 concerning No-Smoking Areas. Routine Satpol PP outreach in schools, public places, offices and tourist attractions increases public awareness. Sanctions include warnings, statements that you will not smoke, and sanctions for minor crimes. The main obstacles involve societal ignorance and a lack of human resources. However, increased awareness since 2017 shows positive progress. This research concludes that the implementation of Semarang City Regional Regulation Number 3 of 2013 concerning No-Smoking Areas has succeeded in increasing public awareness through routine Satpol PP outreach. Sanctions are applied systematically and progressively, in accordance with regulations, with the potential to reduce tobacco consumption. The main obstacle involves community ignorance, requiring cooperation from the government, Satpol PP, Non-Governmental Organizations, and communities to increase understanding and compliance. Suggestions involve stronger synergies, comprehensive implementation methods, and active cooperation to achieve efficient and sustainable smoke-free areas in Semarang City.

Abstract

The number of people with mental disorders in Semarang City continues to increase. The large number of people with mental disorders in Semarang needs to be addressed seriously to prevent causing discomfort in social activities. Therefore, the author compiled a journal titled "Implementation of Law Enforcement Law Number 18 of 2014 concerning Legal Protection and Constraints on People with Mental Disorders in Semarang City." This journal aims to uncover issues related to how the implementation of Law Number 18 of 2014 on law enforcement against legal protection for people with mental disorders in Semarang City and what factors cause people to experience mental disorders in Semarang City. The research method used in this study is a qualitative method with a socio-legal juridical approach. The data used in this study was obtained using data collection techniques through interviews conducted with Mrs. Lela Dwipayana, S.H. as the Social Rehabilitation Staff of the PMKS Guidance Service Sub-Coordinating Social Welfare Services. The results of this study found that Law Number 18 of 2014 on Mental Health has protected people with mental disorders by being handled by the Social Service in Semarang City.
