Abstract

Government Regulation Number 24/2022 (PP 24/2022) has just regulated the provision of guarantees for intellectual property created by creative economy actors. YouTube content as one of the copyrighted works is included in the intellectual property in question. Even though it has been regulated, the government is still making preparations for its implementation. Where it is still not clear the scheme and its implementation. Based on this, the problems are formulated, how to measure YouTube content as a digital asset and how YouTube content can be used as an object of fiduciary security in a debt agreements. The result is that YouTube content can be regarded as a digital asset based on the economic value or income generated from the adsense feature. This income, later could become a value in fiduciary guarantees. The advice that can be given in this study is the need for good supervision in creating schemes and best implementation of making YouTube content an object of fiduciary guarantees in debt agreements.

Abstract

The existence of BPHTB acceptance by the government, especially the Regional Government, cannot be separated from the important role of a Notary who has the authority as a Land Deed Maker Officer or commonly known as PPAT. BPHTB is an obligation to pay taxes incurred due to a transfer of rights to land and buildings that must be paid by the buyer. A transfer of rights to land and buildings can only be carried out if it is carried out in the presence of a PPAT. Notaries such as PPATs are important parties in the acceptance of BPHTB to the Regional Government because in order to make BPHTB payments by taxpayers a BPHTB registration process is required first, which can only be done by a Notary as PPAT. Although BPHTB payments can be made independently by taxpayers, this cannot be done without BPHTB registration carried out by a Notary as PPAT. From the explanation above, we can find one of the important roles of a Notary as a PPAT in the process of tax revenue and income, especially the BPHTB tax as one of the local government revenues. The reality in the field is that the Regional Government does not realize the important role of the Notary as the PPAT in the process of accepting the BPHTB. The Regional Government is passive and not appreciative of the Notary as the PPAT so as not to create a mutualistic relationship between the Regional Government and the Notary as the PPAT.

Abstract

Kelalaian dalam pembuatan akta oleh notaris terjadi karena notaris tidak memperhatikan prinsip kehati-hatian dalam melaksanakan tugasnya sehingga menimbulkan kerugian bagi para pihak yang terlibat. Masalah yang dibahas dalam karya ini adalah perlindungan hukum notaris sebagai penerima akta notaris yang meninggal dunia berdasarkan Keputusan nomor 52/PDT.G/2020/PN MDN. Metode penelitian yang digunakan adalah metode hukum normatif yang menitikberatkan pada norma hukum positif dan literatur masalah serta menggunakan pendekatan deskriptif. Dalam hal terjadi perselisihan, kedudukan notaris yang menerima akta berhadapan dengan notaris yang mengeluarkan akta tersebut hanyalah sebagai turut tergugat, karena masing-masing notaris bertanggung jawab atas akta yang dibuat olehnya tanpa beban apapun. batas waktu sesuai Pasal 65 UUJN. Perlindungan hukum ahli waris protokol notaris terhadap lalai penulisan notaris yang meninggal dunia yang mengeluarkan protokol, yaitu jika ada panggilan yudisial, ia harus terlebih dahulu mendapatkan persetujuan dari dewan kehormatan notaris.Kata Kunci: Perlindungan Hukum, Notaris Penerima Protokol, Kelalaian Notaris

Abstract

With the enactment of Government Regulation Number 24 of 2022, creative economy actors can now apply for financing based on intellectual property. Intellectual property that is used as the object of debt guarantees is a fiduciary guarantee on intellectual property, contracts in creative economic activities, and collection rights in creative economic activities. Contracts in creative economic activities are objects that are still foreign to be used as collateral for debt, so it is still unclear about the implementation and how a contract in creative economic activities can become an object of debt guarantee. The research method used in this research is normative juridical. The result of this research is that contracts for creative economic activities can be used as collateral for debt by nominating the contract. Suggestions that can be conveyed based on research conducted are the need for clearer arrangements regarding the assessment and implementation of creative economic activity contracts as debt guarantees, because the elements of creative economic activity contracts and debt guarantees are quite different.

Abstract

Marriage is the inner bond between a man and a women as husband and wife with the aim of forming a happy and everlasting family that based on the lordship of the almighty. The marriage agreement is a very important thing in the course of marriage. The marriage agreement in the civil code and the Marriage Law is a joint agreement between husband and wife ratified by the registrar of marriages at the time or before the marriage is held. Both parties by mutual consent may enter into a written agreement authorized by the marriage registration employee, as the content applies also to third parties to the extent that the third party is caught. For this reason, what about the regulations regarding marriage agreements and the legal consequences of marriage agreements made after the marriage takes place and are not announced. Abstrak Perkawinan adalah ikatan batin antara laki-laki dan perempuan sebagai suami-istri dengan tujuan membentuk keluarga yang bahagia dan kekal berdasarkan ketuhanan Yang Maha Esa. Perjanjian perkawinan merupakan suatu hal yang sangat penting dalam berlangsungnya perkawinan. Perjanjian Perkawinan dalam KUHPerdata maupun UU Perkawinan merupakan persetujuan bersama antara suami dan istri yang disahkan oleh Pegawai Pencatat Perkawinan pada waktu atau sebelum perkawinan dilangsungkan. Kedua pihak atas persetujuan bersama dapat mengadakan perjanjian tertulis yang disahkan oleh Pegawai Pencatatan Perkawinan, sebagaimana isinya berlaku juga terhadap pihak ketiga sepanjang pihak ketiga tersangkut. Untuk itu bagaimana dalam peraturan mengenai perjanjian perkawinan dan akibat hukum terhadap perjanjian perkawinan yang dibuat setelah perkawinan berlangung dan tidak diumumkan.

Abstract

Pada tahap penyidikan perkara pidana yang menimbulkan kematian dilakukan pencarian serta pengumpulan alat bukti, Salah satu alat bukti yang dapat dilampirkan adalah visum et repertum yang termasuk dalam keterangan ahli. Adapun yang menjadi permasalahan dalam penelitian ini adalah adalah bagaimana kewenangan notaris dalam melegalisasi keterangan berkaitan dengan hasil autopsi kemudian bagaimana akibat hukum dari keterangan hasil autopsi yang telah dilegalisasi oleh notaris. Penelitian ini menggunakan metode penelitian yuridis normatif, dengan menggunakan pendekatan kualitatif. Berdasarkan penelitian yang dilakukan, diperoleh hasil bahwa notaris tidak mempunyai kewenangan untuk membuat akta mengenai autopsi, karena autopsi merupakan kegiatan yang oleh undang-undang telah ditugaskan kepada dokter forensik. Bahwa terhadap akta notaris yang memuat hasil autopsi tidak memiliki kekuatan pembuktian sehingga bukan merupakan alat bukti yang sah dalam perkara pidana.

Abstract

Under the Basic Agrarian Law No. 5 of 1960 article 21 paragraph 1 stated that only Indonesia citizen may have the right of ownership and it is the main principle of right of ownership in Indonesia. However, it would not be a problem for foreign citizen to have the right of land ownership in Indonesia with the use of Nominee Agreement. Nominee agreement is a form of legal smuggling towards the right of ownership by foreign citizen. The research method that will be used in this article is a juridical-normative approach by using primary and secondary legal material. As for the approach that will be used is the study documents through library research derived from statutes, publications, and related legal articles. The result shows the use of nominee agreement in right of ownership towards foreign citizen is null and void. The legality of this agreement is dubious because it does not fulfill the requirements for the validity of agreements, that is a legal cause. There is no legal protection towards the notary who create this agreement.

Abstract

Penelitian ini dilakukan setelah hadirnya Peraturan Presiden Nomor 59 Tahun 2019 tentang Kebijakan Pengendalian Alih Fungsi Lahan Sawah dan aturan pendukung lainnya yang menimbulkan beberapa masalah lapangan, khususnya terkait Para Pelaku Bisnis Perumahan dalam menjalankan bisnis mereka. Isi dari Peraturan tersebut yang berdampak pada Para Pelaku Bisnis Perumahan ialah masalah perizinan. Perizinan yang sulit didapatkan ini membuat hak warga negara atas kebutuhan tempat tinggal atau rumah menjadi terhambat.

Abstract

This study aims to analyze the urgency of attaching the photo of the person at the time of signing the deed in the minutes of the deed and to examine more deeply the position of the photo as evidence in the trial. The form of this research is juridical-normative which relies on written legal sources with a research typology that is explanatory and in the form of prescriptive. The type of data used in the form of secondary data sourced from primary, secondary and tertiary legal materials with qualitative data analysis methods. Attaching a photo of the person at the time of signing the deed in the minutes of the deed is expected to further guarantee the Notary in carrying out his obligations in the deed inauguration process, so that he does not only adhere to the presence of fingerprints which also have the potential to be taken at different times, because essentially the role of affixing fingerprints on the sheet separate evidence is as additional evidence if the appearer denies his signature and guarantees that the appearer is actually dealing with the notary at the time of signing the deed, but does not guarantee that the signing is done at the same time

Abstract

Notaries are general officials authorized to do authentic deeds; notaries must comply with laws and regulations and professional codes of ethics. One form of action that deviates from the provisions of rules and regulations and professional codes of ethics is concurrent positions, namely as the Regional People's Representative Council (DPRD). The purpose of the research in this study is to analyze the legal consequences of the concurrent position of a Notary as a DPRD based on the Notary Position Law. This research was carried out using the Normative Juridical method. The normative Juridical Method is a legal research method aiming to gain knowledge about a legal event. The results of the study can be concluded that the Notary Position Law does not regulate the legal consequences of the concurrent position of a Notary as a DPRD. DPRD is not a State Official. As a result of the legal consequences, notaries who concurrently serve as DPRD are regulated by UUMD3, which expressly explains that the DPRD is prohibited from together doing as a Notary. Notaries who together do as DPRD will be subject to sanctions in the form of dismissal as members of the DPRD.
