Abstract

Health is a right for all Indonesian citizens. Therefore, as a government effort to maintain and improve public health status, the government created a health insurance program. Krama Badung Sehat (KBS) is an effort made by the Regional Government of Badung Regency (Badung Regency Government) in the health sector in the form of guaranteed health services provided to all residents of Badung Regency. The Krama Badung Sehat health insurance program (KBS) has 23 additional benefits compared to the JKN-KIS program. However, there are still obstacles, one of which is the distribution of Healthy Badung Cards. Another inhibiting factor arises because of the lack of good socialization to the public. Meanwhile, the manager of KBS revealed that the issues of transparency and accountability are very vulnerable to occur due to the lack of management and education personnel that are not in accordance with the authority to manage a health insurance

Abstract

Pasal 164 ayat 1 UU Ketenagakerjaan ini menjelaskan bahwa situasi pandemi COVID-19 ini tergolong keadaan force majeure (keadaan memaksa) yang mana situasi ini berada di luar kendali atau di luar kemampuan dari pemilik usaha maka dari itu pengusaha masih diperbolehkan melakukan PHK terhadap karyawannya dengan uang pesangon rendah. Namun apa yang terjadi di lapangan berdasarkan pengamatan, ternyata ada juga perusahaan yang melakukan pemutusan hubungan kerja di masa pandemi Covid-19 ini dengan menggunakan alasan keadaan memaksa padahal perusahaannya masih beroperasi dan mendapatkan keuntungan meskipun tidak sebesar sebelumnya.

Abstract

COVID-19 is an infectious disease caused by a newly discovered coronavirus. The new virus and the disease it causes were unknown before the outbreak in Wuhan, China, in December 2019 began. COVID-19 is now a pandemic occurring in many countries around the world. After the issuance of various regulations to stem the spread of covid19, entrepreneurs also took the initiative to save their businesses from bankruptcy. A policy that is widely used by various business companies in Indonesia is termination of employment. enis research used is normative juridical law research. Normative juridical approach. The Pancasila State uses the principle of mutual cooperation in responding to the problem of termination of employment in the COVID-19 pandemic situation. Entrepreneurs cannot easily terminate employment without thinking about the conditions of the workers, especially since their business can still run and make a profit. Workers also still have the right to severance pay even in circumstances that force the Covid pandemic19. This principle of kinship means that between workers and entrepreneurs there is a balance that jointly thinks of solutions to every problem. There is no one-size-fits-all solution to all problems based on the current situation and conditions, however, by building a business concept as a jointly owned business, a sense of belonging will be created that can benefit both parties

Abstract

  The legal regulations for the crime of hate speech have been regulated in the Criminal Code and also Law concerning information and electronic transactions. In this study using empirical juridical methods with interview qualitative techniques. This study aims to determine the efforts of the Bali Police in minimizing the crime of hate speech on social media The role of the Bali Police in dealing is carried out through preventive and repressive efforts. Preventive efforts are carried out by providing counseling to the public regarding the impact of the crime of hate speech on social media. Abstract

Majelis Desa Adat dibentuk dalam rangka membantu pemerintah daerah Provinsi Bali dalam menjalankan otonomi daerah. Surat Edaran yang diterbitkan oleh Majelis Desa Adat Provinsi Bali Terkait Pengaturan Pengarakan Ogoh-Ogoh Pada Saat Perayaan Hari Raya Nyepi Pasca Pandemi Covid-19 Di Provinsi Bali. Tulisan ini menggunakan metode penelitian hukum normatif Majelis Desa Adat memiliki kewenangan dibidang adat istiadat, oleh karena itu pengambilan keputusan pengarakan ogoh-ogoh saat perayaan Hari Raya Nyepi sepatutnya menjadi kewenangan Pemerintah Pusat, melalui Kementerian Agama dan/atau Kantor Wilayah Kementerian Agama pada tingkat Provinsi/Kabupaten/Kota atau Gubernur sebagai wakil Pemerintah Pusat berdasarkan Asas Dekonsetrasi. Sehingga jika terdapat Surat Edaran yang bertentangan dengan peraturan perundang-undangan yang lebih tinggi dapat mengajukan judicial review kepada Mahkamah Agung RI.

Abstract

This research aims to determine the juridical analysis of the duties and functions of Debt Collectors after the Constitutional Court decision and to determine the impact of the post-Constitutional Court Decision on the duties and functions of Debt Collectors. The method used in this research uses the type of research used is a type of juridical analysis approach. The results of the research show that the implementation of the execution of fiduciary guarantees has undergone a change following the decision of the Constitutional Court, which is the term "executorial power" in Article 15 Paragraph (2) and the decision. court which has legal force remains contrary to the 1945 Constitution and does not have binding legal force as long as it is not interpreted as a lack of agreement in the event of a breach of contract and the debtor objects to voluntarily surrendering the object which is a fiduciary guarantee, then the implementation of legal procedures for implementing fiduciary guarantees must be carried out and likewise This is the case with the execution of court decisions that have permanent legal force. On the other hand, if a default agreement has been agreed between the debtor and creditor at the beginning of the agreement, the finance company can directly carry out its own execution without going to court. So that after the decision of the Constitutional Court, creditors can no longer carry out unilateral execution of fiduciary collateral objects, but must go through the District Court, unless there is a breach of contract agreement at the beginning of the agreement between the debtor and creditor, and the debtor voluntarily hands over the fiduciary collateral object to the creditor.

Abstract
