Abstract

The study aims to determine the application of criminal law material to the crime of theft with violence Pinrang, and how the consideration of the judge ruled against the crime of theft. This study took place in the District Court and State Attorney Pinrang. Interview data collection methods directly to the officials of the two institutions. Other documents which are files District Court Pinrang hereinafter writer qualitative analysis. From the results of this study the authors analyzed the application of the criminal law is not the right material because the defendant can be proven legally and convincingly or meet formulation offenses charged. Likewise consideration is not appropriate because the judge based on the facts revealed in the judicial proceedings.

Abstract

Harta waris adalah salah satu kewajian dan hak untuk mereka yang masih diberikan oleh Allah SWT umur yang panjang di dunia. Baik untuk mewarisinya ataupun membagikannya sesuai dengan haknya yang telah ditentukan oleh Agama Islam yang telah diatur dalam Syari’at-Nya. Oleh karena itu, maka berdosa besarlah bagi salah seorang hamba Allah SWT yang tidak melaksanakan pembagian harta tersebut dengan Syari’at Islam yang telah diatur di dalamnya. Harta yang telah ditinggalkan oleh seorang yang telah meninggal dunia kepada orang yang berhak menerimanya, karena di dalam harta yang ditinggalkan tersebut terdapat kemaslahatan-kemaslahatan untuk tetap menjalankan kehidupan bagi ahli warisnya. Kebanyakan orang menjadi kufur dengan kemiskinannya. Oleh karena itu orang yang mendapatkan harta warisan tersebut. Insya Allah, orang tersebut akan bersyukur kepada Allah SWT dalam menjalani kehidupan menuju akhirat kelak.

Abstract

Upaya pemberdayaan perempuan agar dapat mengangkat harkat dan martabat kaum perempuan menjadi bermartabat di mata mereka yang laki-laki sangatlah penting. Pemberian penyuluhan diperlukan agar mereka memahami hak-haknya dengan baik dan sekaligus mampu melaksanakan kewajibannya dengan sempurna, agar arah kehidupannya bisa ditentukan sendiri berdasarkan pilihan bebasnya sesuai dengan keyakinan agamanya, bukan diatur atau didektekan oleh suaminya atau lingkungan di mana dia berada. Begitu juga adanya pemahaman mengenai arti penting sebuah perkawinan agar antara suami istri benar-benar memahami hak-hak dan kewajibannya antara kedudukan sebagai suami dan sebagai kedudukan istri dalam sebuah rumah tangga demi terwujudnya tujuan perkawinan sakinah, mawaddah wa rahmah dan perempuan mempunyai harkat dan martabat dihadapan laki-laki, meskipun itu keluarga yang bermonogami ataupun berpoligami bawah tangan/kawin sirih.

Abstract

Al Imam Al Ghazali ra, mengambarkan seorang pemimpin yang benar terlihat dari negara yang baik dan memiliki kumpulan orang-orang Islam yang kuat, negara diatur dengan barometer yang bersandarkan pada Wahyu Allah SWT dan Hadits Rasulullah Muhammad SAW dengan menjalankan kebijakan sesuai petunjuk ajaran Islam. Sehingga menciptakan keadaan negara yang baik dan menjaga pemikiran-pemikiran yang menyimpang, agar tidak muncul pada warga negara yang hidupu di dalamnya. Seorang pemimpin haruslah rela berdekatan dengan masyarakat dalam melaksanakan tugasnya, menghilangkan sifat tinggi diri sebagai seorang yang memilili kedudukan di dalam negara. Imam Al Ghazali ra, berfatwah bahwa menemui masyarakat untuk mendengarkan dan memenuhi keinginan mereka, selama sesuai dengan kebutuhan masyarakat bernegara dan tidak keluar dari syari’at itu lebih baik dari pada menyibukkan diri untuk melaksanakan ibadah sunnah. Betapa penting memenuhi kebutuhan masyarakat, mereka lemah harus deperlakukan dengan baik dan penuh kasih. Al Ghazali ra, juga mengingatkan para pemimpin agar jangan sekali-kali menerima raswah dari masyarakatnya dengan menyampingkan kebenaran yang sesungguhnya dan mengabaikan apa yang ada dalam ajaran Islam. Kebiasaan manusia dapat tercermin dalam aktifitas sehari-harinya, dengan begitu aktifitas tersebut dapat terlihat kedalam worldview atau pandangan hidupnya. Maka seorang pemimpin yang memiliki pandangan hidup Islami, maka semua kebijakannya tidak terlepas dari pola pikir yang Islamipula. Kata Kunci: Al Wilayah , Al Imam Al Ghazali, ra.

Abstract

ABSTRAK Nusyuz merupakan perbuatan yang melanggar hukum dalam agama Islam, hal tersebut terkadang berkenaan dengan seorang istri, yang mana di dalamnya melanggengkan hak-hak seorang suami dan mengenyampingkan keharusannya sebagai seorang istri. Hal tersebut tercermin dari adanya beberapa hak suami yang diabaikan oleh seorang istri, disebut dengan perbuatan nusyuz yang melanggar batasan-batasan yang jelas dalam agama Islam. Seorang perempuan memiliki ruang tersendiri dan juga memilki batasan-batasan ketika ia memiliki seorang suami, di sinalah nilai penting yang tergambar dalam ajaran Islam. Pembahasan ini dapat fahami, bahwa dalam ajaran Islam ada batasan dan kewenangan seorang suami dalam memperlakukan seorang istri yang melakukan perbuatan nusyuz, karena dalam pembahasan perbuatan nusyuz. Seorang istri seringkali melanggar asas dasar atau prinsip dasar dalam kewenangan sebagai seorang istri terhadap suaminya. Prinsip aturan Islam bagi suami istri, tujuan adalah memberikan ketentraman dan kebagagiaan agar tidak melakukan perbuatan nusyuz, baik dari segi pelangaran hingga tidak menjadi pemicu timbulnya kekerasan dalam rumah tangga. Hukum yang gunakan di dalamnya adalah hukum Islam, persoalan perbuatan nusyuz yang sering terjadi terhadap kaum perempuan, dapat menjadi salah satu sebab adanya tindak kekerasan kekerasan dalam rumah tangga. Oleh sebab itu ajaran Islam mewanti-wanti setiap seorang istri yang memilikli seorang suami kiranya dapat memahami pedoman-pedoman agama Islam dalam menjalani hidup berumah tangga agar menjadi keluarga sakinah mawaddah wa rahma di dunia kelak kekal, abadi menuj akhirat dengan ridho Allah SWT dan Rasulullah Muhammad SAW. Abstract

The level of assets received or iwadh due to the wife's demand for divorce from her husband using the khulu' method, often becomes a prolonged polemic. Referring to the views of the jumhurul ulama, especially the Imam Syafi'i school of thought, which is more of a reference for the Muslim community in Indonesia, makes the marriage dowry that the husband has given to the wife at the time of the marriage contract as redemption for divorce. The main problem in this research is how the legal istinbath is used and what is the opinion of the Imam Syafi'i RA school about the amount of wealth received by the husband in khulu'. The results of this research are that the legal istinbath of the Imam Syafi'i ra school of thought cannot be separated from: Al-Quran, Al-Hadith, Ijma', Kiyas and Istidlal. And the opinion of the Imam Syafi'i school of thought is that a wife is allowed to ask her husband for a divorce, if he is worried that he will not be able to carry out his obligations properly through khulu' means, as well as giving iwadh as ransom. There is no minimum or maximum limit for Iwadh, the wife is allowed to give a ransom which can be equal to the wedding dowry, it can be reduced or it can be more.

Abstract

Marriage in Islamic law requires the fulfillment of certain conditions and pillars, including the presence of a guardian (wali) for the marriage. The guardian plays a crucial role in ensuring that the marriage is conducted in accordance with religious guidelines. This study aims to analyze the transition of the role of nasab guardians to that of judicial guardians in marriage practices according to Islamic law, as well as to understand the implications of this transition in the context of contemporary society. The research employs a library research method with a normative approach, exploring literature and references from various sources, including fiqh texts and scholars' opinions. The findings reveal that marriage guardians consist of wali mujbir, who is a nasab guardian, and wali hakim, who acts as a substitute when the nasab guardian is unable to fulfill their duty. The criteria for appointing a wali hakim based on scholarly ijtihad provide flexibility in marriage practices. This research contributes to understanding the dynamics of guardianship in marriage and clarifies the provisions for wali hakim according to the Shafi'i school of thought. The results are expected to serve as a reference and guideline for the community in conducting marriages in accordance with Islamic principles.

Abstract

Islam is the source of all sources of knowledge that depart from the "premise of faith", or based on thoughts of faith and belief that rely on the Koran revealed by Allah Subhanahu Wa Ta'ala and the Hadith of Rasulullah Muhammad Shallallahu'Alaihi Wasallam to distinguish between rights and falsehood and be a clarification and guidance for His people. Knowledge obtained by humans or animals later from science or what is called the philosophy of science. Where did the knowledge come from or through what knowledge was obtained, that is the question of how toriqokh or how to get the knowledge or where did the knowledge obtained by mankind come from. The knowledge possessed by mankind on the face of this earth, all originate from one source, namely Allah Subhanahu Wa Ta'ala through the holy words of the Prophet Muhammad Shallallahu'Alaihi Wasallam and there is not the slightest source of knowledge that escapes His knowledge. Allah Subhanahu Wa Ta'ala. Only a different way or toriqoh that He gave to mankind.

Abstract

Basically, human life cannot be separated from rules, with the existence of real forms of religious activities, it is hoped that it will have a positive impact on daily life in society to understand what can be done and what cannot be done with the barometer of Islamic teachings that are relevant at all times. Focus on devotion, how to convey the message of da'wah with current developments without ignoring religious values. And the goal of service is a concrete manifestation of the practice of Islamic values. The research method used, descriptive qualitative, is a form of social and religious service related to the practice of Islamic teachings. As a result of the service, the practice of instilling Islamic values ​​in Lumbang Village, Lumbang District, Probolinggo Regency has had a positive impact on people's lives, as well as the practice of Islamic values ​​in daily life, this activity has become an opportunity to strengthen friendship between fellow citizens. , and the active role of the community in these activities makes them understand how important religious teachings are in the continuity of life in the current generation and beyond. With religious activities, it is hoped that they can make a better contribution to religious life for the Islamic ummah and society in general.

Abstract

Marriage is the union of a man and a woman who are not mahram (unmarriageable kin). Early marriage refers to the marriage of a man and a woman who are still considered young in age. This study is prompted by the concerning situation in Indonesia today, where many young people have fallen into acts of fornication. Test results show that many young women are no longer virgins and that a significant number have become pregnant outside of marriage. This study seeks to explore one possible solution to the issue of fornication by referring to Islamic teachings, specifically through the book authored by Abuya Prof. Dr. As-Sayyid Muhammad bin As-Sayyid Alwi Al-Maliki Al-Hasani Ra, who is more commonly known as Abuya Maliki Ra. This study employs a qualitative research method, specifically a type of library research. Data collection is carried out by identifying key points relevant to the main issue, followed by analysis of the findings through translation and interpretation. The results are then presented in a discussion that relates directly to the core problem. First, Abuya Maliki wrote this book in response to the various problems occurring within marriage. Second, he structured the book in stages that are easy to understand, explaining each issue individually along with its solution. Third, Abuya Maliki authored the book because the problems addressed in the study had already existed, and have now become even more serious-like a dangerous virus attacking the human body. This study is expected to provide a deeper understanding of the importance of encouraging early marriage, in order to prevent acts of fornication within society.
