Abstract

Abstrak Penelitian ini membahas konsep Perlindungan Hukum Terhadap Konsumen Calon Jemaah Panitia penyelenggara Ibadah Umroh dalam rangka perlindungan hukum terhadap calon jamaah. Penelitian ini menggunakan pendekatan yuridis normatif, dengan metode konseptual dengan menganalisis permenag No. 8 Tahun 2018. Penelitian ini menggunakan data sekunder berupa bahan hukum, Diharapkan dengan riset ini ditemukan solusi baru dan saran berupa model kebijakan pemerintah yang efektif dalam memberikan perlindungan hukum terhadap konsumen. Kesimpulan dan Saran dari Hasil Penelitian ini adalah, Pertama, Langkah Kemenag dalam meningkatkan pengawasan travel umrah melalui revisi Peraturan Menteri Agama dan sistem Informasi Online, sudah sangat bagus namun ada beberapa hal yang msih perlu jadi perhatian dan perlu dibuatkan dan cover dalam regulasi yang sudah ada yakni dengan perlunya melakukan audit keuangan terhadap PPIU guna menjamin pengelolaan keuangan dijalankan sesuai standar yang berlaku, sehingga menutup peluang terjadinya Kecurangan (Fraud). Kedua, Audit Keuangan yang dilakukan seharusnya adalah pengawasan yang dilakukan secara preventif bukan represif seteleh muncul laporan kecurangan atau timbulnya korban. Hal ini dirasa perlu dilakukan karena usaha yang dijalankan oleh PPIU adalah usaha yang hampir sama dengan lembaga keuangan yang menghimpun dana dari masyarakat. Ketiga, Kemenag perlu bekerjasama dengan lembaga lain seperti YLKI (yayasan Lembaga Konsumen Indonesia) dan OJK (Otoritas Jasa Keuangan) dalam hal pengawasan pengelolaan keuangan. Hasil akhir dari penelitian ini adalah dengan pengawasan dan pengendalian yang dilakukan oleh kementrian agama terhadap panitia penyelenggara ibadah umroh diharapkan dapat memberikan perlindungan hukum dan kepastian hukum bagi calon jemaah sehingga tidak menimbulkan kerugian pada konsumen atau calon jamaah khususnya dikota padang sumatera barat. Selain itu aspek hukum bersifat legal substancediatas menjadi rekomendasi untuk kebijaka pengawasan pemerintah sehingga ditemukan konsep perlindungan hukum terhadap calon jemaah Panitia Penyelenggara Ibadah Umroh agar masyarakat mendapatkan kepastian hukum dan menumbuhkan kepercayaan masyarakat pada panitia penyelenggara ibadah umroh di indonesia, sehingga perlindungan terhadap masyarakat akan terwujud. Kata Kunci : PPIU, Perlindungan Hukum, Umroh, Calon Jamaah Abstract This study discusses the concept of Legal Protection for Prospective Consumers of the Pilgrimage Committee organizing Umrah Prayers in the context of legal protection against prospective pilgrims. This study uses a normative juridical approach, with the conceptual method by analyzing Permenag No. 8 of 2018. This study uses secondary data in the form of legal material, it is hoped that with this research new solutions and suggestions will be found in the form of effective government policy models in providing legal protection to consumers. Conclusions and Suggestions from the Results of this Research are, First, the Ministry of Religion's Steps in increasing Umrah travel supervision through the revision of the Minister of Religion Regulation and Online Information system, is very good but there are some things that still need attention and need to be made and covered in existing regulations namely the need to conduct financial audits of PPIU to ensure financial management is carried out according to standards applicable, thus closing the opportunity for fraud (Fraud). Second, the Financial Audit that should be carried out should be supervision that is carried out preventively rather than repressively after reports of fraud or casualties occur. This is considered necessary because the business carried out by PPIU is a business that is almost the same as financial institutions that collect funds from the public. Third, the Ministry of Religion needs to collaborate with other institutions such as YLKI (Indonesian Consumers Foundation) and OJK (Financial Services Authority) in terms of overseeing financial management. The final result of this research is the supervision and control carried out by the ministry of religion on the organizing committee of the pilgrimage is expected to provide legal protection and legal certainty for prospective pilgrims so as not to cause harm to consumers or prospective worshipers, especially in the city of Padang, West Sumatra. In addition, legal aspects are legal substancediatas become recommendations for government oversight policies so that the concept of legal protection for prospective pilgrims organizers will be found so that people get legal certainty and foster public confidence in the organizers of the pilgrimage in Indonesia, so that protection for the community will be realized.

Abstract

One of the form of applying the value of democratic in Indonesia is accommodate by the regulation of community organization which is concretely regulated in the provisions of article 28 E Paragraph 3 of the 1945 constitution also in the provisions of law number 39 of 1999 on Human Rights. The existence of community organizations does have a great constribution in the implementation of the state, but on the other hand the existence of people raises the pro and contra. The enecment of government regulation number 59 on community organization established by foreign citizens makes the community more worried if the exixtance of community organizations affect the sovereignty of NKRI because they have different ideology with Indonesia. Based on this, it should be discussed about the organizations in Indonesia. The position of foreign social organizatios in Indonesia is reviwed from the government regulation number 59 of 2016 on community organizations established by foreign citizens and the influence of basic organizations for the sovereignty of NKRI. To answer that question, qualitative method is used  as a means to answer the problem by conducting of normative juridical approach which is done by reviewing the law and the literature. Based on this study, it is concluded that the existence of foreign social organizatios in Indonesia in line with  democracy and human right but also politically can treaten NKRI.

Abstract

Leasing adalah perusahaan atau lembaga pembiayaan yang menyediakan biaya modal kepada seseorang ataupun perusahaan melalui metode pembayaran secara berkala atau bertahap dengan jaminan sebagai alat yang menghimpun antara lembaga pembiayaan yang disebut juga sebagai (kreditur) dan penerima biaya yang disebut juga sebagai (debitur). Jaminan fidusia telah diatur dalam Undang – Undang Nomor 42 Tahun 1999. Berdasarkan laporan Badan Penyelesaian Sengketa Debitur (BPSK) telah menemukan sebanyak 128 kasus pada tahun 2019 mengenai laporan penarikan barang (jaminan) nasabah secara tiba – tiba. Jumlah kasus seperti ini turun pada tahun 2020 yang hanya ada 112 kasus, namun karena adanya covid yang melanda Indonesia, pada tahun 2021 kasus seperti ini kembali melonjak menjadi 172 kasus. Peneliti menemukan kasus terkait debitur dan kreditur di Pengadilan Negeri Padang dengan nomor kasus 158/Pdt.Sus-BPSK/2023/PN.Pdg. tujuan dari penelitian ini adalah (1) Untuk Mengetahuhi Bentuk Eksekusi Jaminan Fidusia terhadap Debitur yangng melakukan Wanprestasi dalam putusan Perkara 158/Pdt.Sus-BPSK/2023/PN.Pdg; dan (2) untuk Mengetahuhi dasar pertimbangan hakim terhadap gugurnya permohonan praperadilan dalam putusan Perkara 158/Pdt.Sus-BPSK/2023/PN.Pdg. metode penelitian yang digunakan adalah metode yuridis normatif dengan pendekatan deskriptif. Sumber data yang diperoleh adalah data sekunder. Hasil penelitian yakni Hakim Pengadilan Negeri Padang memutuskan perkara 158/Pdt.Sus-BPSK/2023/Pn.Pdg mengadili dengan menerima permohonan keberatan dari Pihak Kreditur PT. Clifan Finance Indonesia, Tbk tersebut dan Mengabulkan permohonan keberatan Kreditur PT. Clifan Finance Indonesia, Tbk. Tersebut seluruhnya, serta membatalkan Putusan Badan Penyelesaian Sengketa Konsumen Kota Padang Nomor 09/PST/BPSK-PDG/SBR/ARBT/VII/2023, dan menghukum Debitur untuk membayar biaya perkara.

Abstract

Article 6 Regulation of the Head of the National Police of the Republic of Indonesia Number 2 of 2017 concerning Procedures for Providing Legal Assistance by the National Police of the Republic of Indonesia. This research is legal research with descriptive analytical specifications and this research uses empirical juridical methods. The role of the West Sumatra Regional Police's Legal Sector as Legal Counsel in Implementing Mediation to Settle Criminal Cases to provide legal assistance and be mediated as a resolution to criminal cases. Legal Sub-Sector with a Letter of Order to the assigned legal advisor/legal representative/companion. The West Sumatra Regional Police Chief provides support through Bidkum Personnel of the West Sumatra Regional Police to provide legal assistance in conducting mediation. The obstacle to the role of the West Sumatra Regional Police's Legal Sector as Legal Attorney in Implementing Mediation to Settle Criminal Cases in the implementation of providing legal assistance by the West Sumatra Regional Police's Legal Sector to members of the National Police who commit criminal acts while carrying out their official duties is a shortage of legal advisors. lack of patience in carrying out the mediation process carried out by members of the police from the legal sub-sector as those involved in the case as well as legal advisors/attorneys/advocates. To the West Sumatra Regional Police in the Legal Sub-sector to increase the number of personnel who have taken the Special Education for the Advocate Profession.

Abstract

PKWT (Fixed Term Employment Agreement) workers are non-permanent employees who are employed with an employment agreement that has a certain duration or period. PKWT is often used for temporary or project-based work. PKWT employees are entitled to compensation money as a replacement for rights after the employment agreement is completed. Protectionifor PKWT workers has not been specifically regulated, although there are general provisions in the Manpower Law regardingitermination of employment, problems often arise such as lower salaries and cases of termination of employment (PHK) before the contract ends, compensation money not given by employers which is detrimental to workers. The government provides legal protection to workers both preventively and repressively, through the formation of laws and regulations and the implementation of systematic supervision. The focus of this study is to analyze the form of legal protection for workers with the status of a Fixed Term Employment Agreement (PKWT), especially regarding the right to compensation after the employment contract ends. The Job Creation Law and its implementing regulations are a form of protection for workers' fundamental rights that are adjusted to the dynamics of employment developments. This study uses a normative legal research method, by analyzing primary and secondary legal materials through a statutory, conceptual, and case study approach. The results of the study show that if the employment relationship ends before the PKWT period is over, the employer is still obliged to pay compensation to the worker,iwith the amount calculated based on the period of work that has been undertaken. Fulfillment of basic workers' rights is the responsibility of the employer and requires active government involvement, both in the form of regulation and supervision. The conclusion of this study confirms that legal protection for PKWT workers in terms of providing compensation after the contract ends has been regulated and guaranteed by the government, referring to the provisions of Article 61A of the Job Creation Law and Articles 15, 16, and 17 of Government RegulationiNumber 35 of 2021 concerning the provision of compensation for PKWT workers.

Abstract

Sebagai negara serumpun, Indonesia dan Malaysia memiliki beberapa persamaan dalam hukum adat, terutama karena sejarah dan pengaruh budaya yang serupa di masa lalu. Kedua negara mengakui dan menerapkan hukum adat dalam berbagai aspek kehidupan, meskipun dengan variasi dan penyesuaian lokal.Hukum adat di Indonesia dan Malaysia memiliki sejarah dan perkembangan yang berbeda. Perbedaan sistem hukum ini berbeda atas faktor sejarah yaitu penguasaan atau penjajahan dari 2 buah kuasa besar barat. Malaysia dijajah oleh British dan Indonesia dijajah oleh Belanda. Kedua-dua buah negara ini mempunyai sistem hukum yang tersendiri Dalam masa pemerintahan nasional dewasa ini eksistensi dan kedudukan hukum adat justru menjadi persoalan Tulisan ini membahas bagaimana posisi hukum adat Indonesia dan Malaysia, apakah masih sama berlakunya ketika zaman penjajahan, di Indonesia Hukum Adat Sebagai The Living Law, Mazhab sejarah memandang bahwa hukum yang baik itu adalah hukum yang berasal dari jiwa bangsa/semangat rakyat (volkgeist). Hukum yang mengikuti volkgeist di dalam masyarakat Indonesia dikenal dengan istilah hukum adat. Namun, ajaran filsafat hukum dan positivism hukum barat terutama ajaran dari civil law (eropa continental) dan common law (anglo saxon) untuk dijadikan sarana adan alat pembangunan hukum Indonesia. Semestinya sistem kodifikasi tidak berarti memarginalkan atau mematikan atau tidak memberikan ruang lagi bagi hukum adat. Malaysia merupakan Negara bekas jajahan Inggris, Sebagai bekas jajahan Inggris, Malaysia tetap mempertahankan tradisi hukum kebiasaan Inggris ( Common Law Sistem ) Malaysia merupakan salah satu dari sekian banyak dari anggota negara-negara persemakmuran Inggris. Malaysia tidak menghilangkan Hukum Asli sudah ada jauh sebelum Hukum Inggris masuk ke dalam tatanan hukum negara Malaysia.

Juvenile courts require defendants to be accompanied by legal counsel, parents, guardians or foster parents, and community counselors. They have their own roles, legal advisors/advocates have a different position from parents, guardians or community counselors. (1) Whatiisitheiroleiof the Legal Aid Institute inihandling casesiofiChildreniiniConflictiwithitheiLaw (ABH) in Padang City. (2) How effective is theiroleiofiLegaliAidiInstitutionsiinihandlingicasesiofiChildreniiniConflictiwithitheiLaw (ABH) in Padang City. Theirole of Legal Aid Institutions in Handling Children in Conflictiwith theiLaw, includes accompanying ABH at every level of examination so thatiABH's rightsiare guaranteed both before, during and after the trial and seeking diversion in children's cases so that children are not directly affected by crime or punishment. Data from year 2020 to 2023 showsithatitheirole of Legal Aid Institutions in handlingichildreniin conflictiwith theilaw has notibeenieffective,ibutitheihandlingiisiiniaccordanceiwithiLawiNumberi11iofi2012 concerningitheiJuvenileiCriminaliJusticeiSystemiand procedures in LawiNumber 16 of 2011 concerningiLegal Aid . The obstacles faced that make it ineffective areithe lackiofiperspective ofilawienforcementiofficialsiregardingichildren and the lack of understanding of law enforcement officials regarding theiJuvenileiCriminaliJusticeiSystemiAct, so this makes it very difficult for the process of assisting children by Legal Aid Institutions.
