Abstract

This research was intended to examine al-Sya’rani main thoughts on the diversity of legal schools as outlined in his al-Mizân al-Kubrâ work along with the context and challenges historically which in many cases gave rise to ikhtilaf (differences of opinion) in Fikih, as well as an overview in the legal context as a means of social transformation. The method used in this study was library research, both primary and secondary. Primary sources consisted of the works of al-Sya’rani (especially al-Mizan al-Kubra) with more emphasis on the content analysis. In detail, the problem is formulated in some questions; (1) what is the socio-historical situation (political, socioeconomic, intellectual, and religious traditions) behind the formation of al-Sya’rani ideas about Fikih pluralistic?, (2) what is the construction or pattern of al-Sya’rani thought regarding pluralistic Fikih?, (3) what is the position of al-Sya’rani thought in the perspective of law as one of the means of social transformation? As a result of this discussion, al-Sya’rani seeks to provide a new orientation in legal thinking in a direction that is closer to the demands of a real and pluralistic reality of life. The idea is then outlined in four main points of view which include: (1) Justification of three episteme systems (2) The use of pragmatism principles in the application of the law, Legitimacy of legal changes in line with the development of the situation (3) His views on the necessity of ijtihâd and prohibition of taqlîd in practice Sharia law

Abstract

This article examines the phenomenon of the pilgrimage of followers of the Syattariyah Order in Minangkabau to the tomb of Sheikh Burhanuddin. The focus of this article is on the forms of cultural and religious simbols that exist in the pilgrimage tradition to this tomb and how they are interpreted. The main data of this research are from field data, such as: interviews, observations, and historical objects around the tomb. An interviews data sources involve about 80 respondents. The focus of the study is the pilgrim's motives, simbols and meanings that accompany this tradition. The results of this study prove that the cultural simbols in this tradition are representations of the community's mindset, related to the socio-economic background that influences differences in the process of meaning and the practice of pilgrimages. The identified meanings of pilgrimage are: letting go of intentions, healing, expressing gratitude, charity, matchmaking, developing or perpetuating business, continuity of practice, respect for teachers and obtaining safety and peace.

Abstract

This study applied Terry Eagleton's Marxist sociological literary theory to find the relations of production, economic structure and social behavior in society called infrastructure which has the essential function to legitimize social classes. Thus, the concept of ideas and consciousness, which also called superstructures, are the ideas of the authority. This research found forms of social relations that cause class struggle. The alienation of the people as a group of the proletariat was the result of oppression by the Shaykh Abbas as a bourgeoisie from the ownership of the entire village's wealth. Khalil, as Marxist hegemony, tried to build awareness of the people who have been exploited to fight to live without oppression.

Abstract

The study explains the form of local wisdom of Bugis culture as a cultural value that is characteristic of the Palopo people. This type of research is qualitative. The local wisdom that develops in Palopo City is in line with the pluralistic Palopo culture that develops in Indonesia. Palopo city has local wisdom values such as humanizing (sipakatau), respecting (Sipakalebbi), remembering (Sipakingge'). These values are always preserved, so that they become the glue of religious harmony in Palopo City. The value of pluralism in the education of local wisdom, Bugis culture, embodies the concept of pesse as the value of Sipakatau, Sipakalebbi, Sipakingge, Sipakatou. Bugis culture has love and compassion for others shown by proverbs such as Mali siparappe, rebba sipatokkong, malilu sipakinge (others are swept away, helped, others fall, are helped to get up, others are out of the norm being reminded/reinforced). Palopo people value peace, love to help fellow human beings, especially if it is a fellow human being .

Abstract

Traditional medicine is a form of treatment method used by people since time immemorial. This knowledge is obtained through human experience and understanding of disease. Traditional medicine is in the form of potions, spells and some are in the form of amulets. Minangkabau society in ancient times also used traditional types of medicine. This can be known through ancient manuscripts found in several places in Minangkabau, such as in Surau, Rumah Gadang, Museum, and Library. This study was conducted to determine the form of traditional medicine in Minangkabau. The analysis was done descriptively. From this research, it is known that in Minangkabau there are several types of traditional medicine that can cure various diseases and even diseases that cannot be cured by hospital medicine can be cured by traditional medicine.

Abstract

This research is motivated by the changes that occurred in the customary government that survived for many years as social control in Malay society. The purpose of this research is to describe the changes in the customary government system in the muara bungo Islamic Malay community (1979-2023). The research method used is the four stages of historical research methodology, namely heuristics, source criticism, interpretation, and writing. The data collection techniques used are observation, interviews, literature study, and documentation. The results showed that as a social controller in the Malay customary society of Muara Bungo, which lost its role thanks to Law No. 5 of 1979 which changed all the smallest units into village governments. The customary government then disappeared and all the rules and customary devices that had existed after so long. This change then did not bring changes towards progress in the indigenous Malay community of Muara Bungo, it became a setback for the community. The village government only regulates village administration, not regulating the problems that arise in indigenous peoples. The loss of the Customary Chief (Pasirah) made the Malay indigenous community lose guidance, so that community problems could not be resolved by the village government. The increasingly worrying situation made the Jambi Level I regional government move by issuing Regional Regulation No. 5 of 2007 with the intention of restoring the identity, function and role of customary institutions to the community. Rio emerged as the new customary head, to socialize and teach the community the customary rules, and to peacefully resolve customary problems that occurred in the community.
