Abstract

The establishment of the Regional Representative Council of the Republic of Indonesia so called Dewan Perwakilan Daerah (DPD-RI) at least has two objectives. The first is to enhance justice for the people in the region. Secondly, to expanding and increasing the participation of local communities in national life. The process to form this state institution is done by amending the 3rd amendment of the 1945 Constitution of the Republic Indonesia. However, in doing that  amendment there was an internal conflict within the body of DPD-RI involving the old and the new leaders of this institution last year. The length of leadership tenure which was initially made 5 years was amended to became 2.5 years. The different length of leadership tenure was then canceled by the Supreme Court and it was decided to be the same as other institution such as The People’s Consultative Assembly and The House of Representative in that the leadership tenure should be in accordance with the electoral cycle of 5 years. However, although the regulation of DPD-RI has been canceled, the Supreme Court keeps sending its representative to guide the oath of position of the new DPD-RI leadership. The only regulation that has been introduced by the state was regulation toward conflict between state institutions and this conflict can merely be resolved by the Constitutional Court. Therefore, there is an urgent need for the state to seek solution to solve this problem to prevent the same thing happened to other state institution in the future.

Abstract

Masalah administrasi kelembagaan di lembaga kepolisian nasional seperti pemberhentian, pengangkatan, mutasi dan eselon bersifat dinamis, merupakan bagian dari pembangunan yang berjalan secara sistematis, berkelanjutan dan terus berlanjut secara internal sebagai pertanda perkembangan institusi kepolisian nasional indonesia. Penulisan ini bertujuan untuk bagaimana mengidentifikasi Kedudukan Pegawai Negeri Polisi dalam UU ASN. Metodenya penelitian hukum normatif dengan menggunakan teori harmonisasi yang mengacu pada prinsipprinsip preferensi hukum seperti prinsip Lex supreriori derogat legi inferiori dan prinsip Lex specialis derogat legi generali. Hasil penelitian menunjukkan bahwa Kedudukan Pegawai Negeri Polisi adalah berdasarkan UU ASN, yaitu tentang pemberhentiannya, pengangkatan, mutasi dan aturan eselon, tidak lagi mengacu pada UU Kepolisian dan Peraturan Kapolri. Kesimpulan dari penelitian ini adalah peraturan Kepala Kepolisian Negara Republik Indonesia mengenai peraturan institusi administratif di Kepolisian Negara Republik Indonesia seperti pemberhentian, pengangkatan, mutasi dan eselon harus didasarkan pada UU ASN. Abstract

Public policy is an instrument for resolving conflicts in society. Public policies based on human rights are public policies that are formed to become a reference in providing services to the community by prioritizing human values. The formation of public policies based on human rights itself is in accordance with the mandate of Pancasila, the 1945 Constitution of the Republic of Indonesia, and Law Number 39 of 1999 concerning Human Rights itself. This research aims to contribute knowledge to policy makers in implementing human rights-based public policies. This research is research using library research. Public policy is a series of policy decisions made by a person or group of people in realizing the goals of every problem experienced by society. Public policy based on human rights in Indonesia is a relatively new policy. This human rights-based public policy has only been implemented within the Ministry of Law and Human Rights with the issuance of Minister of Law and Human Rights Regulation Number 27 of 2018 concerning Human Rights-Based Public Service Awards, which was then refined by replacing this regulation with Minister of Law and Human Rights Regulation (Permenkumham) Number 2 of 2022 concerning Human Rights-Based Public Services (P2HAM). The issuance of the Permenkumham P2HAM is in accordance with the public service standards regulated in Law Number 25 of 2009 concerning Public Services. In order to produce good and equitable human rights-based public services, it is necessary to have human rights-based public policies that apply broadly and evenly. Thus, it is necessary to make human rights-based public policy rules in all sectors, so that injustice does not occur.

Abstract

Providing quality healthcare is a state responsibility as mandated by Article 34(3) and Article 28H of the 1945 Constitution of Indonesia. However, malpractice issues in the healthcare sector remain a critical concern. This study aims to analyze the legal protection for medical and healthcare professionals accused of malpractice under Law Number 17 of 2023 on Health. It also examines the role of professional organizations in assisting their members in facing malpractice allegations in accordance with Article 440 of the law. Case studies on three legal matters highlight the importance of adherence to Standard Operating Procedures (SOPs) to protect patients from medical negligence. The findings reveal that although the law provides legal protection, its practical implementation often falls short. Therefore, public education, enhanced oversight, and regulatory improvements are necessary. Legal protection is not only intended to safeguard healthcare professionals but also to ensure justice and legal certainty for all parties involved.

Abstract

Perkembangan Teknologi pada dasarnya mempengaruhi perkembangan perekonomian, tidak terkecuali di Indonesia, dimana teknologi membuat meningkatnya bisnis e-commerce, salah satunya dibidang perdagangan kosmetik, dimana banyak perusahaan e-commerce maupun pelaku usaha yang menggunakan sarana e-commerce sebagai media perdagangan dengan sistem elektronik, memperdagangkan kosmetik melalui e-commerce, namun tidak jarang pula dalam praktiknya, pada perdagangan kosmetik ditemukan kosmetik palsu yang diperdagangkan di e-commerce, sebagaimana contoh terjadi pada perkara Putusan No.323/Pid.Sus/2019/ PN.Jkt.Tim., namun penanganannya sendiri oleh pemerintah belum dilakukan secara serius, hal ini terbukti dalam penggunaan pasal dan istilah yang dipergunakan untuk mempidana para pelakunya, dimana dimana terdakwa Fano Tandyo terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana “Perlindungan Konsumen” yang diatur dan diancam pidana menurut Pasal 197 Jo Pasal 106 ayat (1) Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan, masalah penanganan kasus ini sendiri tergolong cukup unik, karena pada dasarnya Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan tidak mengatur mengenai masalah perlindungan konsumen, namun masalah kesehatan masyarakat yaitu pasien, dimana penggunaan istilah konsumen sendiri merupakan istilah yang umum dipakai bagi pengguna barang dan jasa, sedangkan pasien adalah istilah khusus yang digunakan bagi masyarakat pengguna barang dan jasa kesehatan, sehingga penanganan perkara ini terkesan tidak secara serius ditangani. Penelitian ini menggunakan penelitian yuridis normatif dengan data sekunder berupa bahan hukum primer, sekunder, dan tersier. Adapun hasil penelitian menunjukkan pertanggungjawaban pelaku tindak pidana yang menjual kosmetik tanpa izin edar melalui e-commerce berdasarkan Undang-Undang Republik Indonesia Nomor 36 tahun 2009 tentang Kesehatan pada dasarnya diatur pada ketentuan 105 ayat 2, dan tidak memiliki pengaturan pemidanaan, namun karena adanya bahaya dari peredaran kosmetik kepada wanita khususnya penegakan hukum dapat dilakukan dengan menerapkan ketentuan Pasal 197 jo Pasal 106 ayat 1 Undang-Undang Kesehatan. Kemudian hasil penelitian menunjukkan tinjauan dan pertimbangan hakim dalam memeriksa perkara pelaku tindak pidana yang menjual kosmetik tanpa izin edar melalui e-commerce pada dasarnya hanya menggunakan ketentuan Pasal 197 jo Pasal 106 ayat 1 Undang-Undang Kesehatan dan terdapat kesalahan dengan menyebutkan bahwa tindak pidana tersebut adalah tindak pidana perlindungan konsumen, seharusnya bila memang hendak menerapkan tindak pidana terhadap konsumen, maka majelis hakim menerapkan ketentuan Pasal 62 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen.

Abstract

In this study, it aims to analyze a criminal act of money laundering committed by active actors in terms of returning assets resulting from corruption, the process of money laundering carried out by active actors causes something that is very detrimental to the state and bureaucracy. Money laundering is a follow-up crime in which a crime that participates in corruption which is an extra ordinary crime. The research method used is a normative research method with a statutory approach and a case approach. The types and sources of legal materials used are primary, secondary, and tertiary materials using the collection of legal materials. The theoretical framework in this study uses the theory of legal certainty, law enforcement theory, and corruption theory. The conceptual framework in this study uses criminal responsibility of active actors, money laundering, and return of assets resulting from corruption. The results of the research obtained in the conclusions and suggestions of this study are that money laundering is an act that deviates from legal norms and also violates the rules of the law that has been written. And the form of criminal responsibility is that the perpetrators of the crime of laundering must be held accountable for their actions by carrying out the punishment that has been set. The government and law enforcement officials can make a policy that is contained in a form of legislation by prioritizing the effectiveness of the legal product and accompanied by a good legal structure and culture to be able to prevent and eradicate money laundering.
