Abstract

Dilatarbelakangi dengan suatu keprihatinan tentang teori-teori, pendapat-pendapat, dan konsepsi pemikiran hukum di Indonesia yang lahir dari para pakar dan ahli hukum. Kendatipun Indonesia telah Merdeka 76 Tahun, masih saja terbelenggu dan mengagungkan teori dan konsep pemikiran yang bersumber dari para ilmuawan Barat. Padahal ilmu hukum berbeda dengan ilmu sosial lainnya, apalagi dengan ilmu eksakta. Hukum itu bukanlah ilmu yang bersifat universal, tapi dia punya batas yuridiksi dan teritorial, dan hukum itu harus digali dan diambil dari nilai-nilai yang hidup dari masyarakatnya sendiri. Di Indonesia adalah hukum adat yang lahir dan tumbuh dan ditaati oleh masyarakat itu sendiri. Dengan melakukan penelitian kepustakaan dan mengamati fenomena yang ada di dunia akademis maupun dikalangan praktisi hukum kiranya saatnya kita mencari teori hukum yang bercirikan Keindonesiaan berdasarkan aliran Sociological Jurisprudence, halmana hukum sebagai pencerminan dan kongkretisasi nilai-nilai yang hidup dalam massyarakat (living law), selanjutnya hukum positif hanya akan efketif apabila selaras dengan hukum ynag hidup dalam masyarakat yang merupan cerminan nilai-nilai yang hidup di dalamnya. Dalam penulisan ini penlis mengambil contoh yang diambil dari falsafah Adat Jawa, Bali dan Minangkabau.

Abstract

One of the functions of the DPRD is a regional people's representative institution, namely the legislative function. This function is even often referred to as the core of a representative institution, namely as a law-making body within the scope of the region, in other words having the authority to form regional regulations (PERDA). In implementing the policy of making local regulations. The role of DPRD is very large in local government because it is a regional legislative body that functions as one of the institutions that channel people's aspirations in the city of Cirebon. The problem in this study is related to the legislative function of the Regional People's Representative Council (DPRD) in forming Regional Regulations (Perda). This research method is library research (field research) which is descriptive-analytical. The results of this study are the function of the Regional People's Representative Council (DPRD) in line with the People's Representative Council (DPR) in the central government which has an important function in the implementation and administration of government in the regions. Furthermore, the revitalization of the role of the Regional People's Representative Council (DPRD) can be observed in Law Number 32 of 2004 concerning Regional Government, where the Regional People's Representative Council (DPRD) has the authority to make regional regulations (PERDA), budget preparation and supervision, as mandated in Article 41: “Regency/City DPRD has the functions: 1) legislation, 2) budget, and 3) supervision.” Paragraph (2) explains that the three functions as referred to in paragraph (1) are carried out within the framework of people's representation in districts/cities.

Abstract

Legal anthropology approach is a scientific discipline which explicitly focuses on normative complexity in society and on the relationship between human behavior and its complexity and changes in both human behavior and normative complexity. The application of modern technology in villages has shown the central governments support, especially in the acceleration of village economy. On the other hand, there are not many people in the village who understand the application of the technology itself. Villages, that are vulnerable to changes, require special attention especially with regard to technology. The aim of legal anthropology in accelerating the digital economy is expected to provide a balance in the acceleration of village economy. Thus, the issue raised in this research is how the novelty and renewal of law on digital economy acceleration through the village website viewed from legal anthropology. This research used a normative legal research method which was done by describing views related to the subject matter. In terms of anthropological tendency, there is a tendency adjusted to the dynamics of the societys culture including the acceleration of digital economy for the village. Anthropology sees only law as an aspect of culture, namely an aspect used by public authority in regulating behavior and society, so that there are no deviations and irregularities of the determined social norms. Legal anthropology looks at possible differences or even conflicts in order to assess the modernization culture with the level of understanding in the village. The legal novelty and renewal in the village with regard to digital economic acceleration is considered as a channel, means, and a type of membrane that can be penetrated without disturbing or damaging the membrane.Pendekatan Antropologi hukum merupakan disiplin ilmiah yang paling eksplisit memusatkan perhatian pada ke-kompleksitasan normatif dalam masyarakat dan pada hubungan antara prilaku manusia dengan ke-kompleksitasan, perubahan-perubahan baik dalam prilaku manusia maupun dalam kekompleksitasan normatif. Penerapan teknologi modern di desa- desa telah menunjukan dukungan pemerintah pusat terutama dalam percepatan ekonomi desa. Di sisi lain masyarakat desa masih belum banyak yang mengerti akan penerapan teknologi itu sendiri. Desa yang rentan akan perubahan memerlukan perhatian yang khusus apalagi berkenaan dengan teknologi. Tujuan antropologi hukum dalam percepatan ekonomi digital diharapkan memberikan keseimbangan dalam percepatan ekonomi desa. Maka yang menjadi pertanyaan yakni bagaimana kebaruan dan pembaharuan hukum percepatan ekonomi digital melalui website desa dilihat dari sisi antropologi hukum. Penelitian sendiri menggunakan metode penelitian hukum normative dilakukan dengan cara mendeskripsikan pemikiran yang berkenaan dengan pokok bahasan. Kecenderungan antropologis, terdapat kecenderungan yang disesuaikan dengan dinamika budaya masyarakat termasuk didalamnya percepatan ekonomi digital bagi desa. Antropologi melihat hukum sebagai aspek dari kebudayaan, yaitu suatu aspek yang digunakan oleh kekuasaan masyarakat yang teratur dalam mengatur perilaku dan masyarakat, agar tidak terjadi penyimpangan dan penyimpangan yang terjadi dari norma-norma sosial yang ditentukan dapat diperbaiki.Antropologi hukum dengan melihat kemungkinan perbedaan atau bahkan pertentangan masyarakat desa dalam rangka menilai budaya modernisasi dengan tingkat pemahaman di desa.Kebaruan dan pembaharuan hukum di desa berkenaan dengan percepatan ekonomi digital dianggap sebagai saluran, sarana, sejenis selaput yang bisa ditembus tanpa mengganggu atau merusak selaput.

Abstract

The drug problem in Indonesia is still something thatis urgent and complex. In the last decade this problem hasbecome widespread. Evidenced by the significant increase in thenumber of drug abusers or addicts, along with the increasingdisclosure of drug crime cases, the pattern of which isincreasingly diverse and the syndicate network is getting moremassive. The Indonesian people, and even the world community,in general, are currently facing a very worrying situation due tothe widespread illegal use of various types of drugs. This concernis getting sharpened due to the rampant illicit trafficking ofnarcotics which has spread to all levels of society, includingamong the younger generation. This will greatly affect the life ofthe nation and state in the future. The behavior of some teenagerswho have clearly ignored the values, norms and laws that applyin people's lives is one of the causes of the rise of drug use amongthe younger generation. In everyday life in the midst of societythere are still many teenagers who still abuse drugs.The purpose of this service activity is to increase the knowledgeof adolescents by educating them about the dangers of juveniledelinquency which will impact their future, one of the negativeeffects of which is the dangers of narcotics among adolescents.The implementation method that we do is the Communication,Information, and Education counseling method using PowerPoint media. And the results of the counseling that we did tostudents of SMK Negeri 2 Setu, Bekasi, namely being able tounderstand well and also look interactive and be able to answerquestions that our group asked about the influence of juveniledelinquency and narcotics.

Abstract

The sale and purchase and transfer of accounts receivable (Cessie) from the bank to a third party (the new creditor) are by applicable legal provisions, so legally the third party (the new creditor) is the new creditor who has the right to collect on the debtor's obligations based on the credit agreement. However, in reality, since the New Creditor received the transfer of Accounts Receivable on behalf of the debtor, he did not make payments on his obligations based on the credit agreement. The purpose of this research is to find out how the cessionary legal remedies against the right to collect on the guarantee of mortgage based on debt transfer (cessie). The results of this study indicate that the cessionary legal action against the right to collect on collateral based on the transfer of debt (cessie) is filing a lawsuit for default or breaking promises on the credit agreement at the District Court. Cessie buyers must apply to the District Court first so that the District Court's decision can become the basis for the change of name (in its decision, the District Court orders the National Land Agency (BPN) to transfer the name written on the certificate to the name of the cessie buyer.

Abstract

A consumer is anyone who uses goods and/or services available in society for the benefit of himself, also his family and other people and even other living creatures and not for trading, and this is also for buying and selling transactions both directly and face to face. Consumers are also entitled to protection through rules governing rights and obligations in realizing legal protection, and more emphasis on consumer rights where there are several rights to be protected, namely the right to choose, the right to obtain information, the right to security and also the right to heard. These consumer rights relate to after-sales service if the consumer in purchasing goods and/or services is carried out in follow-up consultation between the buyer and the consumer or there is a warranty period such as replacement of damaged goods, as well as maintenance and provision of spare parts, but with a certain period of time. from the warranty period made by business actors because there are certain products whose warranty period is not as stated or promised and of course provides consumer limitations and the rights of consumers cannot be fully realized or fulfilled.

Abstract

Copying and commercial use of copyright (especially songs) is an act that is detrimental to copyright holders. Article 9 of the Copyright Law has emphasized this action and problems in the field of intellectual property protection become a fundamental problem when research shows that there are weaknesses in aspects of copyright protection. A copyrighted work will receive legal protection if it covers the fields of science, art and literature. Legal protection is obtained if a creation has been realized in a tangible form. The method used in this research is normative research. The author uses the library research method (library search) which is done by reading and studying written sources. According to Article 4 UUHC, the exclusive rights of protected music creators consist of moral rights and economic rights. Moral rights are inherent in the creator or actor that cannot be removed or deleted without any reason, even though the copyright or copyright has been transferred. However, not all countries provide the same legal protection for moral rights in copyright. Some countries may not have strong moral rights laws, or may provide less protection for those rights. Legal arrangements regarding the economic rights of creators or copyright holders show that economic rights are the exclusive rights of creators or copyright holders to obtain economic benefits from creations, so that everyone who exercises economic rights must obtain permission from the creator or copyright holder and is prohibited from duplicating and/or commercial use of works without the permission of the creator or copyright holder.

Abstract

The use of electronic documents signed with electronic signatures as evidence is different from evidence regulated in the Civil Code, because the level of originality or authenticity still needs to be proven first, or in other words has objections to electronic evidence that has legal force, this study aims to know the validity of electronic signatures in proving Indonesian civil procedural law, as well as to determine efforts to resolve civil disputes on electronic documents signed with electronic signatures. This writing uses normative legal research, utilizing existing legal literature and its relation to the problem to be studied. The conclusion of this study is that electronic signatures are valid when using electronics in accordance with applicable laws and regulations, namely the Law on Electronic Information and Transactions Article 16 Paragraph (1), expert testimony is also one of the elements considered important for the examination process because it provides an explanation regarding the authenticity or authenticity of evidence which is an electronic signature submitted.

Abstract

Marketplaces in Indonesia have offered a new payment system, namely Cash on Delivery (COD) to make it easier for consumers to make payments without having to have a bank account or go to an ATM to make transfers. COD is an electronic transaction system that is given in cash via courier as a third party when delivering goods to consumers. However, often COD provides a loss for the seller where there are buyers who are not responsible for making payments because buyers cannot be contacted and are not honest in providing information. The lack of legal regulation regarding the protection of business actors causes losses for business actors in running their business, especially in the COD payment system. By using normative juridical research methods, this study will discuss the payment system for e-commerce transactions between consumers and business actors as well as protection for business actors if consumers cancel e-commerce transactions in the cash on delivery payment system. The purpose of this study is to explain the payment system between consumers and business actors in e-commerce transactions and to analyze the protection for business actors in the event of cancellation of e-commerce consumer transactions in the cash on delivery system. The problem that the author will raise in this research is what factors cause business actors to be disadvantaged in the practice of cash on delivery (COD) payments, as well as legal protection for business actors who are harmed by consumers in the cash on delivery (COD) payment system in the e-commerce. Regarding the rights and obligations of consumers, it is regulated in Law Number 8 of 1999, which requires consumers to have good faith in transactions to buy goods and services, and consumers are also required to exchange according to the agreed wage exchange rate. The low understanding of consumers regarding COD payment methods in the marketplace causes losses for business actors. E-commerce need to be responsible for ix providing education about the online buying and selling process, including the COD payment system to the public.
