Abstract

a society, values ??that govern life are needed in order to create order in life together. This system of values ??is needed to ensure that the rights of everyone in that society are maintained. The values ??held by the community usually come from something that is highly regarded and respected by everyone in the community. In indigenous peoples, the system of values ??that is believed to be a customary system that originates from reason and mind after the reading process of nature. For religious communities the value system that is believed to be a value system that originates from God's revelation. When the identity of the community is as a customary community and religion, then between religion and custom there is a process of acculturation, although many experts have researched and written about the acculturation between religious and customary teachings, but in this study the researcher saw the acculturation between customary and customary law. as well as religion, especially the customary law and customs of the Minangkabau community which are related to the economic practices of local communities. From the research conducted, it was found that the acculturation of Islamic teachings into the customs of the Minangkabau community because these two values ??have in common some sources, namely reason and nature

Abstract

As a religion, Islam is a vision and way of life in taking action. In the field of entrepreneurship, research has proven that religion has a close relationship in realizing economic development. The topic of the role of entrepreneurial universities has attracted the attention of researchers by enriching the literature. However, the discussion on the role of Islamic entrepreneurial universities in economic development is still minimal. The main objective of this paper is to explore Islamic tertiary institutions as religious-based universities that can contribute to economic development through religious-based entrepreneurial activities, with the method used in writing this article is a literature review. The discussion started with sustainable economic development, then how entrepreneurial universities have an impact on economic development. Then try to explain how the relationship between Islam and entrepreneurship and then what is the entrepreneurial condition that has existed so far in Islamic universities.

Abstract

 In line with the increasing demands of the business in the era of globalization, especially related to the resolution of business conflicts, business people have tried to find alternative dispute resolution methods other than justice. This is because the judicial institution as a legal institution that should be able to play its role in efforts to resolve various kinds of business conflicts, is in reality not as expected by business people. There is support for normative formalities. Therefore alternative dispute resolution institutions can be used as a very possible choice. This alternative institution is considered more effective in various aspects of business dispute resolution, in response to the demands of very fierce business competition. Some economic benefits gained from choosing a solution through ADR (Alternative Despute Resolution) are that this model is not formal, saves more time and also minimize costs in dispute resolution.

Abstract

The demand for a democratic system of government in Indonesia is not only the demands of society but also constitutional demands. Therefore, regional autonomy is expected to be able to provide answers to both needs. Because the essence of local independence itself is a tangible form of the practice of democracy in society, in the way of giving autonomy to the region to advance its society democratically in various aspects of life, politics, social economy and culture, to answer the challenges in the era of globalization. Community involvement by empowering local community values is one surefire strategy in the process of democratization. Besides, bureaucratic reform is a necessity; therefore, a combination of allowing the benefits of local communities with the government bureaucracy system is an appropriate strategy for accelerating democratic development.

Abstract

As a country that adheres to the Pancasila ideology, and places the precepts of divinity as the first precept of Pancasila, Indonesia should be a religious country that is thick with religious nuances, and free from heinous acts and evil deeds. But in fact, Indonesia is currently experiencing moral degradation and no longer reflects religious values. This is marked by a statement of actions that violate religious norms and state rules. One example is the problem of adultery that knows no age and social status. In fact, regarding this issue there are indications of omission and protection, because so far there has been no legal certainty in its resolution. Furthermore, in legal disputes the issue of adultery is actually included in the complaint offense. Of course, this problem has bad implications for its identity as a religious nation. Therefore, it is not wrong if the role of Indonesia's national criminal law is questioned by many parties. On the one hand, we believe that criminal law is the ultimum remedium as a controller or regulation of criminal acts. In social reality, throughout the history of human civilization, adultery has never stopped, even now it is growing and the perpetrators come from various circles and layers of society, which are not limited by age and profession. Therefore, this paper will analyze how the law actually anticipates this phenomenon, both in the perspective of Indonesian national criminal law and Islamic criminal law.

Abstract

The panitentiary System in Indonesia in general and in West Sumatra in particular is a sub-Criminal Justice System. Goal orientation of the criminal process since the police, prosecutors, judiciary is a panitentiary. The philosophy’s is conceptually much different from the concept of imprisonment. The existence of a gap between the conceptual ideal and its practical reality, the  planning and implementing the modernization process of both the system and the penitentiary itself. Penitentiary is "a place to the development of prisoners, panitentiary students, and  clients." The implementation its system is essentially an effort to develop Indonesian people as a whole, so that in this context prisons have a very strategic role in the context of fostering human resources, the implementation of guidance for panitentiary including how to create conducive conditions in carrying out duties. The effective coaching in prisons to develop Indonesian people as a whole is very important for modernization. In general, prisons in historical contexts often prioritize a security approach, whether it is maximum security, medium security and minimum security. Modernization is security approach and spiritual approach when integreted sistem. In perspektive siyasah qadha’iyah’s is the essence of the modernization of the prison system now and in the future.Keywords: Panitentiary System;Modernization; siyasa qadha'iyah Syar'iyah

Abstract

Perilaku konsumen maupun nasabah bank dipengaruhi faktor psikologi, diantaranya faktor emosional dan faktor rasional. Penelitian ini mengkaji tentang faktor emosional dan faktor rasional berpengaruh terhadap keputusan nasabah bertransaksi dengan bank, tujuan untuk mengetahui, menganalisis pengaruh faktor emosional, rasional berpengaruh terhadap keputusan nasabah bertransaksi dengan Bank Muamalat Cabang Pembantu Payakumbuh. Jenis penelitian lapangan (field research) bersifat deskriptif, data dikumpul melalui hasil kuesioner dengan tekhnik analisa kuantitatif, dengan regresi linier berganda dengan persamaan sebagai berikut: Y = 36,974 + -0,957X1 + 1,906X2. Hasil penelitian uji t menunjukkan variabel faktor emosional secara parsial tidak berpengaruh terhadap keputusan nasabah memilih bertransaksi dengan nilai t hitung < t tabel sehingga Ho diterima. Variabel faktor rasional juga berpengaruh terhadap keputusan nasabah memilih bertransaksi dengan nilai t hitung > t tabel sehingga H0 ditolak, uji F diketahui variabel faktor emosional, faktor rasional berpengaruh signifikan secara bersama-sama terhadap keputusan nasabah memilih bertransaksi pada Bank Muamalat. The behavior of consumers and bank customers is influenced by psychological factors, including emotional factors and rational factors. This study examines the emotional and rational factors influencing the customer's decision to transact with the bank, the purpose of knowing, analyzing the influence of emotional factors, rational influencing the customer's decision to transact with Bank Muamalat Payakumbuh Supporting Branch. This type of field research is descriptive, data collected through the results of a questionnaire with quantitative analysis techniques, with multiple linear regression with the following equation: Y = 36,974 + -0,957X1 + 1,906X2. The results of the t test showed that partially emotional factors had no effect on the customer's decision to transact with the calculated t value <t table so that Ho was accepted. The rational factor variable also influences the customer's decision to choose a transaction with the value of t arithmetic> t table so that H0 is rejected, the F test is known to be the variable of emotional factors, the rational factor has a significant effect jointly on the customer's decision to trade at Muamalat Bank
