Abstract

Pasal 1338(3) BW secara tersirat mengatur kewajiban itikad baik selama negosiasi. Walaupun terdapat aturan hukumnya, masih terdapat masalah dengan itikad baik dalam hukum kontrak; makna dan ruang lingkupnya yang abstrak. Masalah tersebut disebabkan oleh minimnya aturan hukum tentang itikad baik dalam hukum kontrak, terutama dalam BW. Akibatnya, banyak pihak yang dirugikan selama tahap negosiasi, namun tidak ada perlindungan hukum bagi pihak yang dirugikan tersebut. Di sisi lain, hukum nasional lain telah mengenal tanggung gugat prakontrak, yaitu kewajiban bagi pihak yang beritikad buruk selama negosiasi untuk membayar ganti kerugian. Metode yang digunakan dalam penelitian hukum ini adalah konstruksi hukum dan penalaran deduktif. Hasil analisa menunjukkan bahwa kriteria itikad buruk selama negosiasi jual beli dapat diperoleh dari doktrin-doktrin dan prinsip hukum internasional. Selain itu, sebagian doktrin tanggung gugat pra kontrak telah diatur dalam BW, sepanjang mengenai pembatalan kontrak, selebihnya pihak yang dirugikan dala tahap negosiasi dapat menggugat berdasarkan perbuatan melanggar hukum, atau wanprestasi (jika mengatur hak dan kewajiban secara rinci dalam perjanjian pendahuluan).

Abstract

AbstractOne of the most important authority of the public notary as stated in Article 15 Law Number 2 Years 2014 is the deed storage. In practice, the issuance of a receipt by a notary in the process of submitting a Certificate of Ownership for transactional purposes related to land and buildings, often creates problems. Not infrequently notaries have to deal with civil lawsuits and criminal proceedings that originate from the receipts they issue. Therefore, this paper try to analyze the public notary liability so that they could uphold the carefulness principle in conducting their authority. AbstrakHal yang berkaitan dengan kewenangan notaris sebagaimana tercantum dalam Pasal 15 Undang-Undang Nomor 2 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris adalah menyimpan suatu Akta. Dalam praktek, pengeluaran bukti tanda terima oleh seorang notaris dalam proses penyerahan Sertipikat Hak Milik untuk kepentingan transaksional yang berkaitan dengan tanah dan bangunan, seringkali mendatangkan masalah. Tidak jarang notaris harus berhadapan dengan gugatan perdata dan proses pidana yang bersumber dari tanda terima yang ia keluarkan. Tulisan ini berupaya untuk menguraikan tanggung jawab seorang notaris, sehingga mereka dalam praktek bisa menjunjung tinggi prinsip kehati-hatian.Kata Kunci: Notaris; Kewenangan; Tanda Terima; Pertanggung jawaban.

Abstract

This study aims to analyze the construction of the cancellation of the land purchase agreement and legal protection for the seller in land purchases before the custody. The study used statute, case, and conceptual approaches. It focuses on the concept of custody and good faith. After analyzing the relevant legal sources, it is known that, on the one hand, Article 447 of the Indonesian Civil Code allows for the retroactive application of the custody in some conditions: (1) the custody is due to unwise, mental disorder, and irrational; and (2) the reasons underlying the custody had existed at the time the legal action is taken. The implementation of Article 447 can cancel land purchases made before the custody. On the other hand, the state must protect the buyer’s principle of good faith even though the seller is an unauthorized person. Article 447 must be applied because (1) the Indonesian Civil Code is a positive law that must be enforced; (2) people who are placed under custody are more at risk of experiencing losses in land purchases, and (3) construction of good faith land buyers cannot be applied because there are fewer parties.DOI: https://doi.org/10.22304/pjih.v9n2.a6

Abstract

From time to time, it is considered that Constitutional Amendments are lack of public participation and contains political aspects. Therefore, many nations regulate certain provisions to ensure that the Constitutional Amendments are merely for public order and welfare. One of the provision is the temporal unamendability. In the shape of deliberation requirements, which is essentially the involvement of the public in submitting constitutional amendments within a certain time limit. Indonesian Law doesn’t recognize the concept of deliberation requirements, therefore, the authors will analyze Sweden and South Korean Law, two countries that are also using civil law system and have regulated deliberation requirements in submitting constitutional amendments. This paper will discuss two problems: 1) the legal provisions for constitutional amendments in Indonesia, Sweden, and South Korea, and 2) the guarantee model for public participation in constitutional amendments using the deliberation requirements model. This paper uses legal research method, with a conceptual, statutory, and comparative approach. The results show that Sweden and South Korean Law have involved both the public and the Representative Body to determine wether constitutional amendment will be performed, meanwhile Indonesia hasn’t involve the public to vote for a constitutional amendments. Therefore, to guarantee public participation in constitutional amendments, the authors provide a model which include the public participation through vote or referendum to decide a constitutional amendments and a period of time to file for constitutional amendment.
