<![CDATA[Ekonomi Syariâah mengalami akselerasi perkembangan bukan semata karena aspek emosional keagamaan tetapi juga aspek rasionalitas ekonomi yaitu terterima oleh masyarakat dan pasar. Pesantren dengan kekayaan kultur dan potensi ekonominya, sangat strategis sebagai penggerak ekonomi syariâah. Pesantren layak menjadi lokomotif pengembangan ekonomi syariâah di negeri ini. Pesantren telah menciptakan kemajemukan dan kedinamisan sebagai sebuah lembaga multi fungsi yang melibatkan kiai, santri, ustadz, masyarakat, dan pemerintah. Dari identitas dan dinamisasi itulah, maka pesantren dapat berperan aktif dalam kehidupan sosial, ekonomi bahkan politik. Fondasi motor penggerak adalah koperasi BMT. <![CDATA[When a society grows and the needs of its members increase, the relation between them and other people?who possess various primordial identities?will be impossibly avoided. This social relation will potentially bring about friction among different groups existed in the society. Islam has established a number of rules concerning the relationship of Muslims and other religious adherents. Although the regulations have been firmly settled, the controversy among the Muslims themselves?in dealing with their relation with the non-Muslims?is often inevitable. The issue of relation with other people of different religions has become contentiously debatable topic among the Muslim academics. The debate has subsequently brought about the emergence of different ideological inclinations within the Muslim society. This ideological preference emerges through such number of ?appearances? as moderates, radicals, liberals, traditionalists, and modernists. Each group possesses its own perception along with its arguments about the issue. This article seeks to explain the pattern of Muslims and non-Muslims relation in the light of more moderate and contextual approach. This is so why that Muslims should constantly prioritize inclusive behavior and reciprocally sincere interreligious dialogue with their non-Muslim fellows.]]>

<![CDATA[Masalah pernikahan selalu muncul di masyarakat karena menikah menjadi salah satu fitrah manusia. Di antara fenomena yang muncul dalam masalah pernikahan adalah pasangan suami istri menikah menurut ketentuan agama, namun substansi pernikahan tersebut tidak sepenuhnya memenuhi ketentuan peraturan perundang-undangan. Misalnya menikahnya seorang pria yang masih terikat pernikahan dengan wanita lain, dan dilakukan tanpa prosedur resmi nikah poligami. Persoalan hukum mendasar dalam fenomena tersebut adalah, menurut ketentuan Pasal 4 dan 9 UUP, bagi setiap laki-laki yang ingin beristri lebih dari satu orang wajib mengajukan permohonan izin kepada pengadilan. Di satu sisi pihak suami yang masih terikat pernikahan yang sah dengan pasangan yang lain, masih memiliki peluang untuk mengajukan permohonan pengesahan nikah, sebagaimana ketentuan Pasal 7 ayat (2) dan (3) KHI. <![CDATA[Muslim communities believe that compliance with the law is not only in the field of worship but also in the field of muamalah. Therefore, people want what they practice to be legal and in accordance with Islamic teachings. One of the problems whose legal status continues to be questioned is the issue of pawning which is carried out under customary law. There have been many explanations regarding this problem by religious leaders, but their answers have not been able to satisfy the community. The answers available so far tend to conclude that the practice is not allowed, the law is haram. It is undeniable that the explanation of this in fiqh books is indeed the case because the collateral in the pawn cannot be used by the pawnee, who in this case is a creditor. A creditor may not take advantage of the pledged goods for reasons of riba (usury). However, the practice of pawning, which is carried out according to custom, has become a tradition in the community and is carried out with the pleasure of the pawnbroker and pawnee, and this tradition has become a means to get out of trouble to cover one's life. <![CDATA[This research aims to examine and analyse the urgency of making notarial deeds online. This research uses normative legal research methods, with a qualitative approach. The data sources comprise legislation and references in the form of books, journal articles, and research results relevant to the theme of this research. The results show that the urgency of making notarial deeds online has not been fully addressed in Law Number 30 of 2004, as amended by Law Number 2 of 2014, related to the office of notary. This is due to the obligation for notaries to read out the deed in the presence of the confronters, witnessed by witnesses, so that the legal position of notarial deeds made online must be carried out by authorised officials as specified in the laws and regulations. Deeds made online by notaries are categorised as authentic deeds and can be valid, perfect, and have binding evidentiary power for the parties.]]>

<![CDATA[Micro, Small, and Medium Enterprises (MSMEs) are important in fostering economic development through broad-based community engagement, positioning this sector as a strategic priority for governments. The COVID-19 pandemic caused significant disruptions to the global economy, severely impacting MSMEs. Therefore, this study aimed to examine strategic measures to accelerate the growth and development of MSMEs in the halal industry in Gorontalo City. A field study method was adopted, and primary data were collected through observations, interviews, and documentation, complemented by secondary data from literature. The collected data were analysed using a qualitative descriptive method in the framework of business economics and Maqāṣid Asy-Syarī`ah principles. The results showed that both internal initiatives by MSMEs entrepreneurs and external support from governmental institutions synergise to provide essential moral and material reinforcement. These efforts were critical to the survival and growth of MSMEs and consistent with Maqāṣid Asy-Syarī`ah. Strengthening MSMEs represented a fundamental endeavour in ensuring sustainable economic resilience.]]>

<![CDATA[This study examines the formulation and application of hybrid contracts in Islamic financial institutions in Gorontalo, with a focus on Bank Syariah Indonesia (BSI) and Bank Muamalat Gorontalo Branch. The primary objective of this research is to identify and analyze the types of hybrid contracts applied in Islamic banking products, and to examine how their implementation contributes to the development and innovation of financial products that align with Islamic principles. This research uses a descriptive qualitative approach with data collection methods through in-depth interviews and literature review. The approach includes both fiqh and economic analysis to understand the legal foundations and economic impacts of implementing hybrid contracts in the operations of Islamic banking. The findings show that both Islamic banks apply hybrid contracts in three main forms: Murābaḥah (Bay’ bi Thaman ‘Ājil), Ijārah Muntahiyah bi al-Tamlīk (IMBT), and Musyārakah Mutanāqiṣah. These forms are used in various banking products, such as home ownership financing, vehicle financing, and bank guarantees. The study also reveals that the implementation of hybrid contracts helps Islamic financial institutions meet the growing demand for products that comply with sharia principles, especially amid the economic pressures caused by the Covid-19 pandemic. The application of hybrid contracts not only provides flexibility in financing products but also supports the long-term goals of Islamic financial institutions to enhance financial inclusion and strengthen local economic stability. This research contributes to the development of both theoretical and practical aspects of Islamic banking, particularly related to the use of hybrid contracts as an innovative solution to address contemporary economic challenges.]]>
