Abstract

Tanah ulayat memiliki peran yang sangat penting bagi masyarakat adat di Bali, tidak hanya sebagai sumber daya ekonomi, tetapi juga sebagai simbol identitas budaya dan hubungan spiritual dengan alam. Pengelolaan tanah ulayat yang baik dapat mendukung pembangunan berkelanjutan, namun konversi hak atas tanah ulayat sering kali menimbulkan konflik antara kebutuhan pembangunan dan pelestarian hak-hak tradisional masyarakat adat. Bali, sebagai destinasi wisata utama, mengalami tekanan besar terhadap lahan strategis untuk pengembangan sektor pariwisata, yang menyebabkan konversi hak atas tanah ulayat menjadi isu yang kompleks. Proses ini sering kali melibatkan ketegangan antara pemerintah, investor, dan masyarakat adat, serta dipengaruhi oleh regulasi yang tidak konsisten dan kurangnya pemahaman tentang hukum adat. Konversi hak atas tanah ulayat tidak hanya berdampak pada aspek ekonomi, tetapi juga pada perubahan sosial dan budaya, yang dapat merusak identitas dan keberlanjutan tradisi masyarakat adat. Selain itu, ketidaksepakatan antar generasi dalam masyarakat adat mengenai pengelolaan tanah juga memperburuk situasi ini. Oleh karena itu, kajian mendalam mengenai dinamika konversi hak atas tanah ulayat diperlukan untuk menemukan solusi yang adil dan berkelanjutan. Pendekatan komprehensif yang melibatkan semua pihak, termasuk masyarakat adat, pemerintah, dan investor, sangat penting untuk menciptakan kebijakan yang berpihak pada keberlanjutan sosial, budaya, dan ekonomi. Penelitian ini bertujuan untuk memberikan pemahaman yang lebih jelas mengenai konversi hak atas tanah ulayat di Bali dan merumuskan strategi yang tepat untuk menjaga hak-hak masyarakat adat sambil mendukung pembangunan yang inklusif dan berkelanjutan.

Abstract

This community service activity was carried out to strengthen the advocacy capacity of the Pari Island community, Seribu Islands, DKI Jakarta, in defending their rights to land and living space from corporate claims of control. The problems faced by the community are not only related to land disputes, but also include social pressure, community polarization, threats of eviction, economic weakening, and damage to coastal ecosystems due to reclamation activities. The community service activity was carried out through participatory dialogue, problem mapping, strengthening legal literacy, discussions on advocacy strategies, and the formulation of a sustainable assistance model with the community. The results of the activity indicate that the Pari Island community has carried out various forms of advocacy, including collective action, collaboration with civil society organizations, media publications, legal assistance, institutional complaints, and environmental advocacy. However, this advocacy still needs to be strengthened through internal consolidation, documentation of intimidation, strengthening the community economy, mangrove protection, and strengthening the community's mental health. This article offers the concept of advocacy for living space resilience as a model for assisting small island communities. This model combines legal, social, media, environmental, economic, psychological, and community-based documentation advocacy. With this approach, community service serves not only as an outreach activity but also as a socio-legal assistance process that strengthens community resilience in the face of long-term agrarian and ecological conflicts.

Abstract

Child marriage dispensation remains a crucial issue in Indonesian Islamic family law because it places judges between the legal restriction of minimum marriage age and the social realities faced by families. This article examines urgent reasons and the best interests of the child in marriage dispensation determinations at the Indramayu Religious Court. The study aims to identify the typology of urgent reasons constructed in judicial considerations and to assess the consistency of those considerations with Supreme Court Regulation Number 5 of 2019. This research uses a normative-empirical legal method with statutory, case, and content analysis approaches. The primary data consist of marriage dispensation determinations from the Indramayu Religious Court, supported by relevant regulations, literature, previous studies, and statistical data on dispensation cases. The findings show that urgent reasons are constructed through several patterns: pregnancy, intimate relationships between prospective spouses, fear of zinā and social shame, family approval, and economic readiness of the prospective husband. The study also finds that the implementation of Supreme Court Regulation Number 5 of 2019 is relatively consistent at the formal-procedural level, but still requires substantive strengthening, particularly regarding meaningful child participation, freedom from coercion, education, health, and alternatives to marriage. This article contributes to Islamic family law studies by emphasizing that urgent reasons must be controlled by the principle of the best interests of the child.
