Abstract

The study aimed to examine the legal safeguards provided to consumers engaged in online shopping. This study utilized a normative juridical approach with a descriptive qualitative method. Secondary data was collected through a literature review, encompassing various sources such as journals, books, laws, and regulations. The analysis was descriptive in nature, leading to a generalization of the research problem. The findings revealed that consumer protection is regulated by Law no. 8 of 1999 on Consumer Protection, with the ITE Law, specifically Law no. 19 of 2016 on Information and Electronic Transactions, also being applicable to online shopping transactions. Disputes arising from online shopping can be resolved through instant claims (negotiation, mediation, etc.), seeking assistance from the Consumer Dispute Settlement Agency, or resorting to legal action. Furthermore, the study highlighted the importance of consumer awareness and education in understanding their rights and responsibilities when engaging in online shopping. It also emphasized the need for e-commerce platforms to implement transparent and fair practices to protect consumers from fraudulent activities

Abstract

Getting a job and achieving a decent living is a fundamental right of every citizen. In practice, however, various issues arise in the realm of employment, one of which is related to wages. This wage issue emerges due to a fundamental gap between the regulations aspired to and their implementation in society, often described as the gap between das Sollen and das Sein. This discrepancy is evident in the ineffective enforcement of the law within the community, particularly regarding the Bali Governor's Decree Number 2235/03-G/HK/2019, which pertains to the provision of minimum wages for workers, and the factors that hinder the realization of these minimum wages. The aim of this journal is to analyze and understand the implementation of legal arrangements related to the provision of minimum wages for workers, as well as the factors that impede this implementation. The method employed in this journal is empirical legal research, which is conceptualized as an empirical phenomenon that compares existing rules with their actual implementation or reality in society (das Sollen and das Sein). The findings suggest that the implementation of legal arrangements related to the provision of minimum wages for workers in the Commanditaire Vennootschap (CV) Raka Bali has not been effective. The factors contributing to the ineffectiveness of wage implementation are primarily internal to the company itself.

Abstract

Penulisan junal ini adalah untuk mengetahui bagaimana perlindungan hukum pada konsumen yang tidak menerima barang sesuai dengan pesanan dilihat dari UUPK dan UU ITE serta apa saja upaya hukum yang dapat dilakukan konsumen apabila mengalami kerugian dari pihak e-commerce. Metode yang digunakan adalah metode yang merajuk pada ketentuan UUPK dan UU ITE dan juga dengan mengumpulkan data kepustakaan, mengaitkan pokok permasalahan dengan peraturan perundang-undangan, mengutip dari beberapa peraturan perundang-undangan yang relevan. Perlindungan hukumnya terdapat pada UU ITE No. 11 Tahun 2008 dan Pasal 38 dan pasal 45 ayat (1) serta ayat (2) UUPK. Yang memuat tentang menyelesaikan masalah jika barang yang dibeli tidak sesuai dapat diselesaikan secara litigasi atau non litigasi.

Abstract

ABSTRAK Tujuan dari studi ini adalah guna mengkaji keberlakuan dan kepastian hukum dari bentuk kerja sama secara joint venture yang dilakukan oleh perusahaan asing dengan perusahaan dalam negeri dalam bentuk penanaman modal asing berdasarkan hukum yang berlaku di Indonesia. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan bahan-bahan sekunder lainnya yang mengandung kaidah hukum. Adapun hasil dari studi ini menunjukkan bahwa skema joint venture untuk kegiatan penanaman modal asing secara implisit diatur dalam UU Penanaman Modal. Dari segi bentuk perjanjiannya yaitu joint venture agreement terutama dalam hal pendirian entitas bisnis di Indonesia, joint venture agreement juga tunduk pada peraturan perundang-undangan lain misalnya syarat sahnya perjanjian dalam KUHPerdata dan ketentuan mengenai persyaratan untuk mendirikan Perseroan Terbatas sebagaimana diatur dalam UU Perseroan Terbatas. ABSTRACT The purpose of this study is to examine the applicability and legal certainty of the form of joint venture cooperation carried out by foreign companies with domestic companies in the form of foreign investment based on applicable law in Indonesia. This study uses normative legal research methods with statutory approaches and other secondary materials that contain legal principles. The results of this study indicate that the joint venture scheme for foreign investment activities is implicitly regulated in the Investment Law. In terms of the form of the agreement, namely a joint venture agreement, especially in the case of establishing a business entity in Indonesia, the joint venture agreement is also subject to other laws and regulations, for example the Indonesian Civil Code has regulated the terms of validity of the agreement and regulations regarding the requirements for establishing a Limited Liability Company as regulated in the Limited Liability Company Law.

Abstract

This research aims to discover about and comprehend the legal framework that underpins the partnership between insurance agents and insurance companies. The research method used is a type of normative legal research. The type of approach used is a statutory approach and a conceptual approach. The laws used are the Civil Code, the Commercial Code, the Insurance Law and POJK.05/2013 concerning Insurance Products and Insurance Marketing. The results of this study revealed that the legal basis for the relationship between insurance agents and insurance companies is not expressly regulated in the Civil Code, Commercial Code, Insurance Law and Financial Services Authority (OJK) Regulations. The Insurance Law only provides a definition of insurance agents and insurance companies. As such, the legal relationship between insurance agents and insurance companies is not regulated. As a legal basis, the relationship between the insurance agent and the insurance company lies in the agreement made by the agent with the company. Thus, the agreement becomes the legal basis for the relationship between the insurance agent and the insurance company. Meanwhile, the legal relationship between an insurance agent and an insurance company is a contractual relationship or a relationship that is bound in an agreement.

Abstract

Penulisan ini bertujuan untuk mengembangkan ilmu pengetahuan hukum bagi diri pribadi maupun ke dalam kehidupan masyarakat melalui penelitian terhadap adanya konflik norma dalam pengaturan minimal modal dasar pada pendirian perseroan terbatas. Keberadaan PT di Indonesia memberikan peran yang penting terhadap perkembangan perekonomian bangsa Indonesia karena semakin banyaknya perusahaan-perusahaan yang didirikan memberikan peningkatan pendapatan negara dan juga dapat menjamin kesejahteraan rakyat di Indonesia. Dalam pembuatan perusahaan modal merupakan salah satu bagian paling terpenting yang harus dimiliki oleh setiap perusahaan termasuk juga di dalam pembuatan suatu PT. Dengan modal, sebuah PT dapat melaksanakan aktivitas produksi dan aktivitas–aktivitas bisnis lainnya, serta usaha PT dapat ditingkatkan dan dikembangkan dengan penambahan jumlah modalnya. Hasil studi menunjukkan bahwa besaran modal dasar pendirian PT yang semula ditentukan pada Pasal 32 ayat (1) UUPT adalah paling sedikit Rp 50.000.000,00, menjadi diserahkan sepenuhnya kepada para pendiri PT dengan kesepakatan para pendiri PT. Akibat hukum PT yang memiliki besaran modal dasar kurang dari ketentuan dalam UUPT. PT tidak memiliki status badan hukum karena setelah akta pendirian atau Anggaran Dasar PT selesai dibuat maka untuk memperoleh status badan hukum haruslah mengajukan permohonan ke Menteri Hukum dan Hak Asasi Manusia untuk memperoleh pengesahan. Penyusunan jurnal ini mempergunakan tipe penelitian hukum Normatif, jenis pendekatan masalah yang digunakan adalah Pendekatan Perundang-Undangan (Statute Approach) dan Pendekatan Konsep Hukum (Conceptual Approach).

Abstract

This research aims to identify and comprehend the regulatory arrangements for employees with physical disabilities to get opportunity equality, as well as the implementation of legal protection for workers with physical disabilities to obtain equal job opportunities in the city of Denpasar. The study approach utilized is an empirical legal research method based on a comparison between das sollen and das sein. Legal and fact-based approaches are applied. Primary data sources include interviews with disabled workers in the city of Denpasar, whereas secondary data sources include statutes and regulations, books, and scientific journals. According to the findings, the regulation regarding persons with disabilities is clearly stated in the national regulations, namely the Human Rights Law, the Law on Persons with Disabilities, and the Manpower Act, whereas the special regulations for Denpasar City are contained in the Bali Provincial Regulation on Persons with Disabilities. However, despite the fact that there are policies in place to govern persons with disabilities in Denpasar City, it is still difficult to find a job, especially in companies, due to the stigma that people with disabilities are incapable of doing anything. Even though the state has enacted legislation governing the employment of people with disabilities, the reality of the situation makes these regulations difficult to implement, especially in relation to issues of employment.

Abstract

Down syndrome sufferers often experience speech acts that are difficult to interpret. Therefore, researchers will observe the level of locution, illocution and perlocution of Down syndrome sufferers who attend SLB Tunas Bangsa, Blitar Regency. In people with Down syndrome there is weakness in speech acts. They have difficulty conveying ideas. Communication problems experienced by children with Down syndrome include difficulty in making sounds and using language rules. Many children with Down Syndrome experience developmental delays in many aspects including understanding speech in communication. In this research, researchers found a breakthrough in researching locutions, illocutions, perlocutions or speech acts of Down syndrome sufferers so that later there will be improvements in the speech teaching of Down syndrome sufferers. This research uses a qualitative paradigm or approach. With this descriptive research, it is hoped that it can explain the application and describe locutions and illocutions. perloksi in the conversation of children suffering from Down syndrome at SLB Tunas Bangsa, Blitar Regency. In this research, researchers used a purposive sampling technique, namely by determining a number of informants with certain criteria. Data collection techniques in this research used observation, interviews and documentation from Down syndrome sufferers who attended SLB Tunas Bangsa, Blitar Regency. The results of this research show that Down syndrome sufferers have an IQ below the average of normal people, so they have deficiencies in locutionary, illocutionary and perlocutionary speech acts. If they fail to produce clear speech and experience deficiencies in making illocutionary and perlousional responses to the speech partner. Therefore, there is a need for special measures and special training for children with Down syndrome to improve locutionary, illocutionary and perlocutionary skills
