Abstract

Tujuan penulisan artikel jurnal ini untuk mengetahui dan menganalisis tentang penyebab kelalaian, upaya pencegahan dan perlindungan hukum oleh JNE Kediri-Tabanan kepada konsumennya yang mengalami kerugian akibat kelalaian dalam pengiriman. Penulisan ini menggunakan metode penelitian hukum empiris, yang menggunakan teknik pengumpulan data berupa wawancara dan pengamatan atau observasi. Berdasarkan hasil penelitian dan pembahasan dapat disimpulkan bahwa (!) faktor penyebab terjadinya kelalaian pada JNE karena kurangnya pegawai di saat sedang ramai, (2) upaya pencegahan dengan melakukan 4 oprasional yaitu collecting, transporting, processing, delivery, (3) perlindungan bagi konsumen yang mengalami kerugian akibat kelalaian dalam pengiriman adalah berupa kompensasi ganti rugi oleh penyedia jasa ekspedisi. Kata Kunci: Perlindungan Hukum, Konsumen, Jasa Pengiriman Abstract The purpose of writing this journal article is to find out and analyze the causes of negligence, prevention efforts and legal protection by JNE Kediri-Tabanan to consumers who suffer losses due to negligence in shipping. This writing uses empirical legal research methods, which use data collection techniques in the form of interviews and observations. Based on the results of research and discussion it can be concluded that (!) The factors causing negligence in JNE due to lack of employees when it is busy, (2) prevention efforts by conducting 4 operational namely collecting, transporting, processing, delivery, (3) protection for consumers who incur losses due to negligence in shipping in the form of compensation for compensation by the expedition service provider. Abstract

Tulisan ini betujuan untuk mengetahui bentuk-bentuk pelanggaran/kejahatan dalam transaksi pasar modal dan untuk mengetahui perlindungan hukum terhadap investor dalam transaksi pasar modal. Metode penulisan jurnal menggunakan penelitian normatif dengan pendekatan yaitu pendekatan perundang-undangan yaitu Undang-Undang Nomor 8 Tahun 1995 tentang pasar modal, pendekatan fakta menalaah menyinggung praktik modal di indonesia dan pendekatan analisis konsep pendekatan bagi analisis hukum. Berdasarkan hasil penelitian yaitu : Perlindungan hukum kepada badan pengawas pasar modal pasal 4 undang-undang no 8 tahun 1995 tentang pasar modal dinyatakan bahwa "pembinaan, pengaturan, pengawasan oleh Bapepam dengan tujuan mewujdkan terciptanya kegiatan pasar modal yang teratur, wajar, dan efisien dan Kejahatan maupun pelanggaran dalam bidang pasar modal akan terlibat kasus hukum, dalam pelanggaran pasar modal, biasanya mengenai kasus perizinan dan pendaftaran BAPEPAM.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganlisis tentang pengaturan hukum dari tindakan typosquatting terhadap nama domain dalam suatu kegiatan e-commerce serta mengetahui akibat hukum dari tindakan typosquatting. Metode penelitian hukum yang digunakan dalam penulisan ini adalah normatif, dimana proses penelitian yang dilakukan adalah dengan menggunakan bahan pustaka yang berasal dari buku atau publikasi hukum dan peraturan perundang-undangan. Hasil studi menunjukkan bahwa pengaturan hukum suatu nama domain terhadap tindakan typosquatting dalam kegiatan e-commerce diatur dalam pasal 23 ayat (1) UU No 19 tahun 2016 dalam perubahan terhadap UU No 11 tahun 2008 tentang Informasi dan Transaksi Elektronik yang menentukan suatu nama domain harus didasarkan pada undang-undang, kepatutan dan itikad baik. Akibat hukum yeng terjadi oleh tindakan typosquatting dalam kegiatan e-commerce yaitu tindakan typosquatting dapat diberikan pembatalan terhadap nama domain dan juga sanksi administratif yang sanksinya dapat berupa teguran tertulis, pencabutan nama domain dan pencabutan status operasi jika setelah 14 (empat belas) hari sejak dikeluarkannya teguran tertulis, pengelola nama domain yang bersangkutan tetap melakukan pelanggaran. Kata Kunci: Typosquatting, Internet, Nama Domain. ABSTRACT The pupose of this study is to find out the legal arrangements of typosquatting actions against domain names in e-commerce activities and to find out the legal consequences of typosquatting. The legal research method used in this writing is normative, where the research process carried out is to use library materials from books or publications of law and legislation. The results of the study show that the legal regulation of a domain name against typosquatting in e-commerce activities is regulated in article 23 paragraph (1) of Law No. 19 of 2016 in amendments to Law No 11 of 2008 concerning Electronic Information and Transactions which determines a domain name must be based on law, propriety and good faith. Legal consequences that occur by typosquatting in e-commerce activities, namely typosquatting actions can be given domain name cancellation and administrative sanctions, which can be in the form of a written warning, revocation of domain names and revocation of operating status if after 14 (fourteen) days since the issuance of a written warning, the domain name manager concerned continues to commit violations. Abstract

Tujuan dari penulisan ini adalah untuk melihat bagaimana kejelasan asuransi dalam perjanjian kerja pada perusahaan penangkap ikan. Permasalahan dari penelitian ini adalah pertama, menyangkut pengalihan tanggung jawab keselamatan nelayan dapat dialihkan kepada pihak asuransi. Kedua, bagaimana kedudukan asuransi di dalam perjanjian kerja antara nelayan dengan perusahaan penangkap ikan sesuai dengan Undang – Undang yang berlaku. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan perundang – undangan dan hukum yang berlaku. Hasil penelitian ini memperlihatkan bahwa bagaimana pemberlakuan UU sesuai dengan hukum yang berlaku di dalam perjanjian kerja antara perusahaan penangkap ikan dengan nelayan pekerja kemudian diikuti dengan sejauh mana peran dan tanggungan yang dapat diberikan oleh pihak asuransi perikanan di dalam perjanjian kerja pada perusahaan penangkap ikan. Kata kunci: Perjanjian Kerja, Nelayan, Asuransi Perikanan ABSTRACT This task aims to see how the clarity of insurance in the employment agreement in fishing companies. The problems of this research are first, regarding the transfer of responsibility for the safety of fishermen to be transferred to the insurance company. Second, how is the position of insurance in the work agreement between fishermen and fishing companies in accordance with applicable laws. This research is a normative legal research approach with legislation and applicable law. The results of this study show that how the enforcement of the law is in accordance with the applicable law in the work agreement between fishing companies and working fishermen, then followed by the extent of the roles and responsibilities that can be given by the fishery insurance in the work agreement at the fishing company. Abstract

The study aimed to examine the legal safeguards provided to consumers engaged in online shopping. This study utilized a normative juridical approach with a descriptive qualitative method. Secondary data was collected through a literature review, encompassing various sources such as journals, books, laws, and regulations. The analysis was descriptive in nature, leading to a generalization of the research problem. The findings revealed that consumer protection is regulated by Law no. 8 of 1999 on Consumer Protection, with the ITE Law, specifically Law no. 19 of 2016 on Information and Electronic Transactions, also being applicable to online shopping transactions. Disputes arising from online shopping can be resolved through instant claims (negotiation, mediation, etc.), seeking assistance from the Consumer Dispute Settlement Agency, or resorting to legal action. Furthermore, the study highlighted the importance of consumer awareness and education in understanding their rights and responsibilities when engaging in online shopping. It also emphasized the need for e-commerce platforms to implement transparent and fair practices to protect consumers from fraudulent activities

Abstract

Getting a job and achieving a decent living is a fundamental right of every citizen. In practice, however, various issues arise in the realm of employment, one of which is related to wages. This wage issue emerges due to a fundamental gap between the regulations aspired to and their implementation in society, often described as the gap between das Sollen and das Sein. This discrepancy is evident in the ineffective enforcement of the law within the community, particularly regarding the Bali Governor's Decree Number 2235/03-G/HK/2019, which pertains to the provision of minimum wages for workers, and the factors that hinder the realization of these minimum wages. The aim of this journal is to analyze and understand the implementation of legal arrangements related to the provision of minimum wages for workers, as well as the factors that impede this implementation. The method employed in this journal is empirical legal research, which is conceptualized as an empirical phenomenon that compares existing rules with their actual implementation or reality in society (das Sollen and das Sein). The findings suggest that the implementation of legal arrangements related to the provision of minimum wages for workers in the Commanditaire Vennootschap (CV) Raka Bali has not been effective. The factors contributing to the ineffectiveness of wage implementation are primarily internal to the company itself.

Abstract

Kajian ini membahas mengenai tinjauan hukum terkait transaksi jual/beli pakaian bekas (thrifting) impor serta perlindungan bagi konsumen dari kegiatan thrifting melalui Instagram. Guna mengamati hal tersebut maka akan dilakukan dengan kajian yuridis normatif, mempergunakan pendekatan melalui undang-undang dan pendekatan sosio legal. Sehingga kajian ini akan bersifat prespektif analisis berdasarkan sumber bahan hukum yang diperoleh melalui studi kepustakaan. Hasil dari kajian ini adalah: bahwa kegiatan thrifting pakaian bekas impor merupakan pelanggaran terhadap Undang-Undang Nomor 7 Tahun 2014 mengenai perdagangan. Khususnya bertentangan dengan Pasal 47 ayat (1) yang menyatakan bahwa importir wajib mengimpor produk dalam keadaan baru, dan Pasal 51 ayat (2) yang melarang importir untuk mengimpor produk yang telah ditetapkan dilarang oleh Peraturan Menteri Perdagangan Nomor 51/M-DAG/PER/7/2015 terkait Larangan Impor Pakaian Bekas. Selanjutnya, jika pakaian bekas yang diimpor berasal dari dalam negeri, dianggap sama sekali tidak ada kaitannya dengan syarat keempat Pasal 1320 KUH Perdata. Selain itu, perlindungan hukum bagi konsumen didasarkan pada Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, khususnya dalam Pasal 27 ayat (1) sebagaimana diatur dalam Undang-Undang Nomor 8 Tahun 1999 dan peraturan turunannya. Kesadaran dan pengetahuan tentang hak-hak konsumen dalam thrifting pakaian bekas impor melalui platform media sosial Instagram sangatlah penting. Kata Kunci: Perlindungan Konsumen, Pakaian Bekas, Instagram. ABSTRACT This study discusses the legal review related to the sale/purchase of imported used clothing (thrifting) transaction as well as protection for consumers from thrifting activities through Instagram. In order to observe this, it will be carried out with a normative juridicial study, using a statutory approach and a socio-legal approach. So that this study will be a perspective analysis based on the source of legal materials obtained through literature study. The results of this study are: that the thrifting activity of imported used clothing is a violation of Law Number 7 of 2014 concerning trade. Specifically, it contradicts Article 47 paragraph (1) which states that importers are obliged to import products in a new state, and Article 51 paragraph (2) which prohibits importers from importing products that have been determined to be prohibited by the Minister of Trade Regulation Number 51/M-DAG/PER/7/2015 regarding the Prohibition of Imports of Used Clothing. Furthermore, if the imported used clothing comes from within the country, it is considered to have absolutely no relation to the fourth condition of Article 1320 of the Civil Code. In addition, legal protection for consumers is based on the 1945 Constitution of the Republic of Indonesia, specifically in Article 27 paragraph (1) as stipulated in Law Number 8 Year 1999 and its derivative regulations. Awareness and knowledge of consumer rights in thrifting imported used clothing through the Instagram social media platform is very important. Key Words: Consumer Protection, Used Clothing, Instagram.

Abstract

Penulisan artikel ini memiliki tujuan guna mengetahui apa dasar hukum yang melindungi konsumen pada kasus kebocoran data pribadi, serta mengetahui pertanggungjawaban perdata Provider terhadap kasus kebocoran data pribadi. Metode penelitian yang digunakan dalam penulisan artikel ini ialah penelitian hukum normatif dengan melakukan pendekatan perundang-undangan. Hasil dari penulisan artikel hukum ini menunjukan bahwa adanya peraturan perundang-undangan yang dijadikan sebagai dasar hukum perlindungan konsumen terhadap kebocoran data pribadi diantaranya Kitab Undang-Undang Hukum Perdata, Undang-Undang, dan Peraturan Menteri. Serta mengetahui pertaggungjawaban apa yang dapat diberikan pihak Provider kepada konsumen atas kejadian kebocoran data pribadi. Konsumen yang merasa dirugikan atas kejadian kebocoran data pribadi tersebut, dapat mengajukan gugatan atas dasar perbuatan melawan hukum atas dasar kesalahan. Kata kunci: Perlindungan Konsumen, Pertanggungjawaban, Kebocoran data pribadi ABSTRACT The writing of this article has the aim of knowing what is the legal basis that protects consumers in cases of personal data leakage, as well as knowing Provider 's civil liability for personal data leakage cases. The research method used in writing this article is normative legal research by taking a statutory approach. The results of writing this legal article show that there are laws and regulations that are used as the legal basis for consumer protection against leakage of personal data, including the Civil Code, Laws, and Ministerial Regulations. As well as knowing what responsibility Provider can give to consumers for personal data leakage incidents. Consumers who feel aggrieved by the leakage of personal data can file a lawsuit on the basis of unlawful acts on the basis of errors. Abstract

Riset ini memiliki tujuan guna memahami sebagaimana hukum memberikan pengamanan atas konsumen yang terkena dampak dirugikan sebagai akibat dari pembelian produk kecantikan kosmetik yang tidak mempunyai izin peredaran di dalam platfrom e-commerce dan mengetahui bagaimana peran BPOM dalam mengatasi permasalahan maraknya penjualan kosmetik yang tidak sesuai standar di platform e-commerce. Riset ini mempergunakan metode penelitian empiris, mempergunakan pendekatan perundang-undangan (statue approach) serta pendekatan kasus (the case approach). Hasil riset ini menunjukkans bahwasannya konsumen yang berdampak dirugikan sebagai hasil dari menggunakan kosmetik palsu, maka akan mendapatkan kompensasi (ganti kerugian) dari pihak pelaku usaha. BPOM telah melakukan pengawasan melalui media sosial yakni cyber patrol, selain itu untuk memastikan apakah produk kosmetik tersebut palsu atau tidak, maka dapat menggunakan aplikasi atau scan barkode yang dilakukan dengan cara pengecekan nama produk, bentuk sediaan, nama pendaftar, serta nomor registrasi. ABSTRACT This research aims to understand how the law provides security for consumers affected by losses as a result of purchasing cosmetic beauty products that do not have distribution permits on e-commerce platforms and to find out how BPOM's role is in overcoming the problem of the rampant sale of cosmetics that do not comply with standards in e-commerce platforms. This research uses empirical research methods, uses a statutory approach (statue approach) and a case approach (the case approach). The results of this research indicate that consumers who are harmed as a result of using counterfeit cosmetics will receive compensation (compensation) from the business actor. BPOM has carried out surveillance through social media, namely cyber patrol. Apart from that, to ascertain whether the cosmetic product is counterfeit or not, it can use an application or scan a barcode which is done by checking the product name, dosage form, registrant's name, and registration number.

Abstract

Penelitian ini bertujuan untuk mengetahui pengaturan hukum aktivitas transaksi elektronik Cryptocurrency di Indonesia serta untuk mengetahui perlindungan hukum pelanggan asset kripto terhadap transaksi elektronik Cryptocurrency di Indonesia dengan menggunakan metode penelitian normatif atau disebut juga penelitian doktrin, yang fokusnya adalah meneliti dan menemukan landasan pustaka menggunakan penelitian normative. Adapun penggunaan pendekatan perundang-undnagan, konsep dan kasus yang relevan dapat memperjelas ungkapan dari permasalahan di atas dan metode kasus untuk mempelajari penelitian ini untuk memahami urgensi penguatan atas instrument hukum investasi Cryptocurrency melalui transaksi elektornik di Indonesia. Pengaturan hukum transaksi cryptocurrency di Indoensia tidak diatur secara khusus melainkan tersebar dibeberapa peraturan perundang-undangan. Asset kripto hanya diperbolehkan pada instrument investasi melalui pasar komoditas berjangka dengan pengaturan hukum secara umum dalam dan diawasi oleh Bapppebti. Perlindungan hukum bagi pelanggan asset kripto bersamaan kedudukannya sebagai konsumen yang mempunyai hak atas permintaan ganti rugi sebagai bentuk atas perlindungan hukum yang tertuang dalam UU Perlindungan Konsumen pada Pasal 19. Pada perlindungan hukum atas transaksi elektronik maka seluruh penggunaan data pribadi oleh pelanggan asset kripto mendapat perlindungan berdasar pada UU ITE yang memberikan jaminan kewajiban bagi pihak yang melibatkan data pribadi untuk menjaga kerahasiaan data yang ada sebagaimana tertuang dalam Pasal 26 UU ITE. ABSTRACT The aim of this study is to understand the legal arrangements for cryptocurrency electronic transaction activities in Indonesia, and to understand that crypto asset customers are protected from the legal protection of cryptocurrency electronic transactions in Indonesia. The research method used is normative research or also known as doctrine research. Its research focus is to research and find the foundation of law libraries, periodicals, legal research and legislation so that the research can use normative research. The use of legal methods, concepts and related cases can clarify the expressions of the above issues and case methods to study this research to understand the urgency of strengthening cryptocurrency investment law tools through election transactions in Indonesia. Indonesia has no special regulations on cryptocurrency transactions, but it involves multiple laws and regulations. Crypto assets are only allowed on investment instruments through the commodity futures market with general legal regulation in the Regulation of the Regulatory Supervisory Board of Futures Trading Commodition No. 5 of 2019 concerning Technical Provisions for the Implementation of Physical Markets of Crypto Assets on Futures Exchanges and supervised by Bappebti. Legal protection for crypto asset customers along with their position as consumers who have the right to demand compensation as a form of legal protection contained in the Consumer Protection Law in Article 19. In the legal protection of electronic transactions, all use of personal data by crypto asset customers is protected based on the ITE Law which provides guarantees of obligation for parties involving personal data to maintain the confidentiality of existing data as stated in Article 26 of the ITE Law.
