Abstract

Penulisan junal ini adalah untuk mengetahui bagaimana perlindungan hukum pada konsumen yang tidak menerima barang sesuai dengan pesanan dilihat dari UUPK dan UU ITE serta apa saja upaya hukum yang dapat dilakukan konsumen apabila mengalami kerugian dari pihak e-commerce. Metode yang digunakan adalah metode yang merajuk pada ketentuan UUPK dan UU ITE dan juga dengan mengumpulkan data kepustakaan, mengaitkan pokok permasalahan dengan peraturan perundang-undangan, mengutip dari beberapa peraturan perundang-undangan yang relevan. Perlindungan hukumnya terdapat pada UU ITE No. 11 Tahun 2008 dan Pasal 38 dan pasal 45 ayat (1) serta ayat (2) UUPK. Yang memuat tentang menyelesaikan masalah jika barang yang dibeli tidak sesuai dapat diselesaikan secara litigasi atau non litigasi.

Abstract

Pancasila, as the source of legal morality of Indonesia, is used as the primary benchmark by Judges of the Constitutional Court in providing decision. The paper at hand explains that the constitutional court decision Number 90/PUU-XXI/2023 has moral weaknesses related to legal behaviour derived from Pancasila, specifically, First: Constitutional Court Decision had led to conflict and arising different views that potentially might cause disruption to Indonesia nation entity. Second: Constitutional Court Decision does not fully align with the Wisdom in Deliberation principle contained in the Fourth Principle of Pancasila. Third: Constitutional Court Judgment does not satisfy the sense of justice for Indonesian People. This paper employs a normative research method with a conceptual approach and a value-based approach.

Abstract

Insurance helps individuals manage risks in areas like health, education, and retirement. However, issues such as defaults by insurance companies can harm customers and erode public trust. To address this, preventive measures, including establishing a Policy Guarantee Agency, are needed to protect customers and minimize losses. This normative legal study examines preventive protection regulations, focusing on balance in contracts and legal protection theories, and proposes constructing regulations for a policy guarantee program. Findings reveal that while the Insurance Law mandates such regulation, its absence creates legal uncertainty, leaving customers vulnerable to losses from insurance defaults.
