Abstract

Penulisan junal ini adalah untuk mengetahui bagaimana perlindungan hukum pada konsumen yang tidak menerima barang sesuai dengan pesanan dilihat dari UUPK dan UU ITE serta apa saja upaya hukum yang dapat dilakukan konsumen apabila mengalami kerugian dari pihak e-commerce. Metode yang digunakan adalah metode yang merajuk pada ketentuan UUPK dan UU ITE dan juga dengan mengumpulkan data kepustakaan, mengaitkan pokok permasalahan dengan peraturan perundang-undangan, mengutip dari beberapa peraturan perundang-undangan yang relevan. Perlindungan hukumnya terdapat pada UU ITE No. 11 Tahun 2008 dan Pasal 38 dan pasal 45 ayat (1) serta ayat (2) UUPK. Yang memuat tentang menyelesaikan masalah jika barang yang dibeli tidak sesuai dapat diselesaikan secara litigasi atau non litigasi.

Abstract

Tujuan utama studi ini ialah menganalisis makna yuridis PMA No. 891 K/Pdt.Sus-HKI/2019 jo. Putusan Pengadilan Niaga No. 66/Pdt.Sus-Merek/2018/PN Niaga Jkt. Pst., serta kesesuaian putusan tersebut dengan Undang-undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Metode penelitian ini menggunakan metode penelitian normatif dengan sumber hukum primer berupa Undang-undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, Putusan PN Niaga No. 66/Pdt.Sus-Merek/2018/PN Niaga Jkt. Pst, dan Putusan MA Nomor 891 K/Pdt.Sus-HKI/2019. Hasilnya menunjukkan bahwa Majelis Hakim dalam PMA No. 891 K/Pdt.Sus-HKI/2019 mempertimbangkan kriteria-kriteria berikut dalam mengambil keputusan menolak permohonan kasasi: Dibuktikan merek penggugat, HOT STAR, adalah merek terkenal, Merek HOT STAR milik tergugat yang terdaftar memiliki persamaan pada pokoknya dengan merek HOT STAR milik penggugat, Tergugat dibuktikan mempunyai niat mencontoh, meniru merek Penggugat yang sudah populer (terkenal) itu, pada dasarnya mencerminkan kebijaksanaan dalam rangka mewujudkan keadilan yang salah satu dalilnya adalah memberikan atau menetapkan hak bagi subyek hukum yang benar-benar berhak. Kesesuaian antara fakta yang terjadi dengan norma-norma hukum yang diterapkan menunjukkan putusan hakim yang bersangkutan sudah memenuhi aspek-aspek keadilan, kepastian hukum, dan kemanfaatan. Aspek kemanfaatan terpenuhi mengingat dalam putusan hakim tersebut secara implisit terdapat upaya memajukan efisiensi hukum atau ketepatgunaan hukum atau kesesuaian hukum. This research aims to analyze the juridical meaning of the judge's considerations in the Supreme Court Decision Number 891 K/Pdt.Sus-HKI/2019 in conjunction with the Commercial Court Decision Number 66/Pdt.Sus-Merek/2018/PN Niaga Jkt. Pst and to determine the compatibility of the judge's decision with Law Number 20 of 2016 on Trademarks and Geographical Indications. This research uses a normative legal research method with primary legal materials such as Law Number 20 of 2016 on Trademarks and Geographical Indications, Commercial Court Decision Number 66/Pdt.Sus-Merek/2018/PN Niaga Jkt. Pst, and Supreme Court Decision Number 891 K/Pdt.Sus-HKI/2019 as its sources. The research results show that the considerations of the Judges' Panel in rejecting the cassation request in Supreme Court Decision Number 891 K/Pdt.Sus-HKI/2019 include: the plaintiff's HOT STAR trademark is proven to be famous, the defendant's registered HOT STAR trademark has substantial similarity with the plaintiff's HOT STAR trademark, and the defendant is proven to have the intention to copy or imitate the well-known plaintiff's trademark. Essentially, this reflects the wisdom in pursuit of justice, one of the principles being to grant or establish rights to the party who truly deserves it. The alignment between the factual events and the legal norms applied indicates that the judge's decision meets the aspects of justice, legal certainty, and utility. The utility aspect is fulfilled as the judge's decision implicitly aims to promote legal efficiency, appropriateness, and conformity with the law.

Abstract

Pancasila, as the source of legal morality of Indonesia, is used as the primary benchmark by Judges of the Constitutional Court in providing decision. The paper at hand explains that the constitutional court decision Number 90/PUU-XXI/2023 has moral weaknesses related to legal behaviour derived from Pancasila, specifically, First: Constitutional Court Decision had led to conflict and arising different views that potentially might cause disruption to Indonesia nation entity. Second: Constitutional Court Decision does not fully align with the Wisdom in Deliberation principle contained in the Fourth Principle of Pancasila. Third: Constitutional Court Judgment does not satisfy the sense of justice for Indonesian People. This paper employs a normative research method with a conceptual approach and a value-based approach.

Abstract

Insurance helps individuals manage risks in areas like health, education, and retirement. However, issues such as defaults by insurance companies can harm customers and erode public trust. To address this, preventive measures, including establishing a Policy Guarantee Agency, are needed to protect customers and minimize losses. This normative legal study examines preventive protection regulations, focusing on balance in contracts and legal protection theories, and proposes constructing regulations for a policy guarantee program. Findings reveal that while the Insurance Law mandates such regulation, its absence creates legal uncertainty, leaving customers vulnerable to losses from insurance defaults.
