Abstract

Sebagai negara yang mengalami wabah covid-19, Indonesia juga menerapkan regulasi dalam usaha untuk menekan tingkat penularan virus tersebut. Undang-Undang Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan merupakan pengaturan yang telah disiapkan pemerintah sebagai wujud keseriusan menangani wabah covid-19. Pada tanggal 17 September 2021 kemarin, negara kita dikejutkan oleh pelanggaran karantina dengan mengabaikan kurun waktu karantina yang harus dijalani. Satgas covid-19 sangat memperhatikan masyarakat agar selalu memperketat penerapan protokol kesehatan, sebagai usaha untuk bisa terhindar dari bahaya covid-19. Maka itu, masyarkat Indonesia yang telah bepergian dari luar negeri diwajibkan untuk menjalani karantina dengan batas waktu yang telah ditetapkan. Persoalan yang dibahas dan di kajian ini yaitu bagaimana hukuman yang diberikan terhadap pelanggar karantina era wabah corona virus sesuai regulasi yang ada, seperti yang terjadi di Wisma Atlet Kebayoran Jakarta.

Abstract

Indonesia is a state of law that relies on a rule of law formed as a basic rule in the state and society. The law as the primary basis must be made following the principles of the Formation of good law so that it is expected that later it can be applied and has binding legal force for all levels of society. However, the current situation is far from the expectation of the formation of good law. For example, the Formation of a job creation law which is considered not to involve the community actively, many articles are contrary to legal principles, disharmonized and unsynchronized between law. The formation of law seems in a hurry so there are many errors in writing (typo) and many other things. Therefore, it is necessary to reconstruct the stages in making good law. This paper uses normative research with a statutory approach, a comparative approach, and finally concludes with a conceptual approach where concepts that are considered suitable can be applied in Indonesia. This article provides two conclusions. First, the practice of harmonization, synchronization and consolidation of conceptions that have been well implemented but only exist at the planning and drafting stages of the Bill. While after the discussion/mutual agreement (plenary), no further harmonization and synchronization are carried out. Second, the post-discussion (plenary) re-harmonization stage can provide space for the implementation of educational facilities, consultations and publications of pre-validation and enactment of law that will be ratified in the form of meaningful public participation

Abstract

This manuscript presents a comparative analysis of environmental permitting frameworks in Indonesia and Malaysia, specifically focusing on their application to large-scale development initiatives, particularly National Strategic Projects (PSN) . As developing economies, both nations grapple with the imperative of balancing economic growth with environmental sustainability. This study employs a comparative juridical–normative approach, drawing on statutory frameworks, secondary literature, and policy documents from Indonesia and Malaysia. Additionally, this study examines the legal and procedural aspects of environmental impact assessment [Analisis Mengenai Dampak Lingkungan (AMDAL) in Indonesia and Environmental Impact Assessment (EIA) in Malaysia], highlighting key similarities and differences in their approaches. While both countries possess established legislative frameworks for environmental protection, Indonesia’s accelerated permitting for the PSN, commonly facilitated by the Online Single Submission system, has drawn criticism for potentially compromising environmental safeguards and exacerbating social and environmental conflicts. Conversely, Malaysia relies on its more standardized EIA process for major projects, although it faces challenges in ensuring effective enforcement and public participation. The analysis demonstrates that despite distinct regulatory evolutions and implementation strategies, both nations share common struggles in mitigating the adverse environmental and social consequences of rapid development. The findings underscore the urgent need to strengthen environmental governance, enhance transparency, and promote meaningful stakeholder engagement to foster genuinely sustainable development pathways in Indonesia and Malaysia.
