Abstract

This research critically examines the implementation of flogging punishment as regulated in Qanun Jinayat Aceh, particularly from the perspective of legal effectiveness and its challenges to international human rights principles. As the only region in Indonesia that formally implements Islamic criminal law, Aceh has become a focal point in both national and global legal discourse. Utilizing a normative qualitative approach and juridical-philosophical analysis of the qanun regulations, field practices, and criticisms from international institutions such as Komnas HAM and Human Rights Watch, the findings indicate that although uqubat flogging is considered effective in creating a deterrent effect and enjoys social legitimacy in parts of Acehnese society, its implementation remains highly controversial, particularly regarding respect for human dignity, fair trial mechanisms, and universal human rights protection standards. This study emphasizes the need for a more humanistic, contextual, and socially responsive approach without disregarding the basic principles of Islamic law, with the expectation that this discourse will enrich the treasury of Islamic legal thought and encourage the reformulation of sharia criminal law in line with substantive justice values.

Abstract

Bank interest is a controversial issue in the study of Islamic jurisprudence, especially in the context of the development of the modern banking system which makes it the main mechanism in conventional economic activities. The majority of classical fiqh scholars view bank interest as a form of riba that is prohibited because it contains additional elements of the principal of the loan that has the potential to cause injustice and exploitation, as affirmed in the Qur'an and hadith. However, some contemporary scholars offer a more contextual approach by taking into account the principles of emergency, benefits, and global economic realities. This study aims to analyze the legal position of bank interest in the perspective of Islamic jurisprudence and examine the development of ijtihad of classical and contemporary scholars in responding to conventional banking practices. The research method used is qualitative research with a literature study approach, through the study of classical fiqh sources, the thoughts of contemporary scholars, and literature related to Islamic economics and finance. The results of the study show that there are different views among scholars regarding the law of bank interest, which reflects the dynamics of ijtihad in responding to changes in the modern economic system. The majority of scholars still prohibit bank interest because of its similarity to riba, while some contemporary scholars provide limited space of abilities on the condition that they are not exploitative and intended for benefit. In conclusion, the fiqh study of bank interest emphasizes the importance of a comprehensive and contextual understanding of sharia principles in modern economic practice, as well as the need to strengthen the Islamic financial system as a fair alternative and in accordance with Islamic values.

Abstract

Securities play a strategic role in financial transactions as instruments that can be used as collateral for debt. However, in practice, issues arise regarding the legal certainty of securities in lawsuits, particularly when disputes arise between creditors and debtors. This study aims to examine the extent to which securities provide legal certainty in the process of enforcing creditors' rights through litigation. The research method used is a normative-juridical approach with an analysis of laws and regulations, jurisprudence, and legal doctrine. The results show that although securities such as checks and giro bills have the power to serve as evidence and collateral, their application in judicial practice still faces procedural obstacles and varying legal interpretations. Therefore, strengthening regulations and consistent legal application are needed to ensure legal certainty for the parties.
