Abstract

ABSTRAK Usaha perikanan di Bengkulu secara umum dilakukan nelayan tradisional, yang  menggunakan peralatan tradisional dan sederhana. Berpedoman pada cara-cara dan aturan yang mengandung nilai-nilai sebagai kearifan lokal. Hal tersebut masih berlaku hingga saat ini dalam kegiatan perikanan. Penelitian hukum non doktrinal dengan pendekatan socio-legal research ini berupaya mengkaji nilai-nilai kearifan lokal berkaitan dengan aktivitas perikanan di Bengkulu. Penelitian dengan metode pengamatan dan wawancara di wilayah pesisir untuk memperoleh data primer. Hasil penelitian menunjukan bahwa saat ini nilai-nilai kearifan lokal  berkaitan usaha perikanan telah mengalami perubahan bersamaan dengan berjalannya waktu. Meski demikian nilai-nilai yang bersifat positif dan universal,  perlu dipertahankan dan dikembangkan dalam upaya pengelolaan sumberdaya kelautan dan perikanan berkelanjutan. Oleh karena itu perlu diformulasikan dalam bentuk Peraturan Desa atau Peraturan Daerah.  Hal tersebut penting untuk   keberlanjutan ekonomi, sosial dan ekologis. Kata kunci: Berkelanjutan; Kearifan–lokal; Kelautan; Perikanan; Usaha. ABSTRACT Fishing business in Bengkulu is generally done by traditional fishermen, who use traditional and simple equipment. Guided by means and rules that contain values as local wisdom. This is still true to date in fisheries activities. Non-doctrinal legal research using socio-legal research approach attempts to examine the values of local wisdom related to fishery activities in Bengkulu. Research with observation methods and interviews in coastal areas to obtain primary data. The results showed that the current values of local wisdom related to fishery business has changed along with the passage of time. Nevertheless, values that are positive and universal, need to be maintained and developed in the efforts of sustainable management of marine resources and fisheries. Therefore it needs to be formulated in the form of Village Regulation or Regional Regulation. It is important for economic, social and ecological sustainability. Keywords: Business; Fisheries; Local Wisdom; Marine; Sustainability.

Abstract

AbstractDamage and pollution of the environment is driven by the dominance of anthropocentric concepts in environmental and natural resources management that are backed-up by the sectoral and partial regulations more to prioritize aspects of economic development but ignoring the sustainability of the environment. The concept of Deep Ecology’s Arne Naess fight for the sustainability of ecological communities. In the concept of Deep Ecology, protection and saving the environment by humans basically moved from the awareness that humans are part of nature and environmental sustainability intended for the entire ecological community.Law No. 32 of 2009 on the Protection and Management of the Environment (UUPPLH 2009) which establishes the obligation of the planning of the Protection and Environmental Management (RPPLH), the Strategic Environmental Assessment (SEA), Spatial Planning (RTRW) at the policy level and Environmental Impact Assessment (EIA) within the framework of the licensing system for environmental management at the project level or activity must be understood as an effort to protect and maintain environmental carrying capacity  as the implementation of the concept of Deep Ecology  in the regulation of Indonesian environmental law.Keywords:   Deep ecology concept, Environmental law, Regulation AbstrakKerusakan dan pencemaran lingkungan hidup didorong oleh masih dominannya konsep antroposentris dalam pengelolaan lingkungan hidup dan sumber daya alam yang diback-up oleh peraturan yang bersifat sektoral dan parsial yang lebih memprioritas aspek pembangunan ekonomi tetapi mengabaikan keberlanjutan fungsi lingkungan hidup.Konsep Deep Ecology dari Arne Naess memperjuangkan keberlanjutan komunitas ekologis. Dalam konsep Deep Ecology, perlindungan dan penyelamatan lingkungan hidup yang dilakukan manusia pada dasarnya beranjak dari kesadaran bahwa manusia merupakan bagian dari alam dan keberlanjutan lingkungan hidup diperuntukan bagi seluruh komunitas ekologis.Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UUPPLH 2009) yang menetapkan kewajiban penyusunan Rencana Perlindungan dan Pengelolaan Lingkungan Hidup (RPPLH), Kajian Lingkungan Hidup Strategis (KLHS), Rencana Tata Ruang Wilayah (RTRW) di level kebijakan dan Analisis Mengenai Dampak Lingkungan Hidup (AMDAL) dalam kerangka sistem perizinan pengelolaan lingkungan hidup di level proyek atau kegiatan harus dipahami sebagai upaya untuk melindungi dan memelihara daya dukung dan daya tampung lingkungan hidup (DDDTLH) sebagai implementasi konsep Deep Ecology dalam pengaturan hukum lingkungan Indonesia. Kata Kunci:  Konsep deep ecology, Hukum lingkungan, Pengaturan

Abstract

The purpose of this study is to analyze and to describe the implementation of administrative bureaucratic reform at Bengkulu regional office of Ministry of Law and Human Rights of Bengkulu based on Presidential Regulation Number 81 of 2010 concerning the Grand Design of Bureaucratic Reform of 2010-2025, and to analyze the obstacles in the implementation of administrative bureaucratic reform at Bengkulu regional office of Ministry of Law and Human Rights. This research was a normative legal research. The analysis of legal materials was carried out in a qualitative juridical manner. The results of the study show that: Firstly, the implementation of administrative bureaucratic reform at the Bengkulu Regional Office of the Ministry of Law and Human Rights has been carried out for the needs of Bureaucratic Reform. Secondly, there are obstacles in the implementation of administrative bureaucratic reform at the Bengkulu Regional Office of the Ministry of Law and Human Rights, namely: The juridical obstacles consist of the absence of technical legislation for performance improvement and the absence of Standard Operating Procedures (SOPs) that can build a common perception, commitment, involvement in program implementation and bureaucratic reform activities at all levels of employees. Technical obstacles, namely the limited quantity and quality of Human Resources (HR) and facilities and infrastructure. By establishing an organizational structure based on the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 30 of 2018 concerning the Organization and Work Procedure of the Regional Office of the Ministry of Law and Human Rights, it can be a solution to achieve efficiency and effectiveness in the implementation of the tasks of the government bureaucratic apparatus.

Abstract

Coal mining license is a juridical instrument for businessmen to carry out coal mining activities. Coal mining license is also a preventive instrument to prevent coal mining activities from causing environmental damage and pollution. In the process of issuing and implementing coal mining licenses according to Law Number 32 of 2009 concerning Environmental Protection and Management, one must consider the precautionary principle, which is implemented by integrating environmental considerations, in making coal mining licenses decisions. However, coal mining activities carried out by 9 coal mining companies in the Watershed of Air Bengkulu, showed that there was environmental destruction and pollution seen along the Watershed of Air Bengkulu. This study aimed to determine the application of the precautionary principle to coal mining licenses and the legal consequences of coal mining license decisions that did not apply the precautionary principle. This research was conducted using juridical empirical/socio-legal research, and data analysis was carried out using a qualitative juridical approach. The results of this research showed that the government of Bengkulu Province has not applied the precautionary principle in the process and implementation of coal mining license in the Watershed of Air Bengkulu of Central Bengkulu Regency. The legal consequence of not applying the precautionary principle in the decision to issue 9 (nine) coal mining licenses which was an essential and material requirement in a decision to issue a permit was null and void (nietig van rechtwege) and could be canceled (vernietig baar), the government of Bengkulu Province has the authority to cancel the licenses decision because it is a State Administration official.

Abstract

Along with the formation of institutions in Indonesia, it is known by the term Non-Departmental Government Institutions (LNDP) which after the enactment of the Law on State Ministries which changed department term into ministry, but at the initiative of several ministries, there were also other terms that were introduced, namely Non-Structural Institutions (LSN). One of the NonStructural Institutions (LSN) currently is State Civil Apparatus Commission. In Article 1 number 19 of Law Number 5 of 2014 concerning State Civil Apparatus is stated that the Commission of ASN, which abbreviated as KASN, is a non-structural institution which independent and free from political intervention to create ASN employee that professional and performs to provide services fairly and neutral and become adhesive and unifier of the nation. KASN was formed to supervisethe implementation of basic norms of the ethic code and behavior code of ASN as well as the Application of the Merit System in ASN’s policy and management.

Abstract

The State and the Government are obliged and responsible for the orderliness of children adoption practices, both in terms of administration and legal certainty. Therefore several policies were issued through legislation and jurisprudence that regulates and handles the issue of children adoption. The implementation of children adoption must be based on Government Regulation of the Republic of Indonesia Number 54 of 2007 concerning Children Adoption. This study aims to get an overview and explanation of the Implementation of Licensing for ChildrenAdoption in Bengkulu Province Based on Government Regulation 54 of 2007 concerning the Implementation of Children Adoption. The children adoption process requires regulations that are in accordance with the Laws and Government Regulations and needs control of how they are implemented in the field. In addition to the Social Department of Bengkulu Province as the technical executor of adoption activities, it is necessary to establish a Regional Consultation Team for Children Adoption (known as PIPA in Indonesian abbreviation), to avoid irregularities in the process of implementation of children adoption, such as the adoption of children carried out without proper procedures, falsification of data and the existence of child trafficking, so the goal of adopting a child for the best interests of the child is not achieved. In analyzing the data in this thesis, the researcher applied a qualitative juridical analysis approach that describes the picture of the data obtained by researcher in the field and connects with each other to get a general conclusion. From the results of the qualitative juridical analysis, it can be seen and obtained inductive conclusions, namely the way of thinking in taking conclusions in general was based on facts that are specific. Data collection methods in this study were done through in-depth interview techniques, observation and documentation.The informants in this study were determined by selecting informants who comprehended and were directly involved in the implementation of child adoption programs. The informants consisted of the Head of Social Rehabilitation Division at the Social Department of Bengkulu Province, Head of Children and Elderly Social Rehabilitation Section at the Social Department of Bengkulu Province, Head of ChildrenProtection Section of the Women Empowerment Department and Children Protection in Bengkulu Province, Children Social Workers and Parents or Prospective Adoptive Parents who follow procedural for children adoption in accordance with applicable regulations. Data processing and analysis were conducted through data reduction, data presentation and conclusion drawing.

Abstract

The quality of the decisions handed down by judges can be seen from the ratio decidendi or legal arguments given by the judges themselves. Before the judge decides to answer the plaintiff's demands, the judge first makes the basics of legal considerations containing legal arguments or reasons to arrive at a decision finally. Article 109 paragraph (1) of Law Number 5 of 1986 concerning the State Administrative Court stipulates that one thing that must be included in a judge's decision is the legal reason that forms the basis of the decision. The method used in this research is the empirical legal research method. This study used primary data and secondary data. The data obtained were analyzed juridical qualitatively utilizing deductive-inductive thinking. The decision has carried out the breadth of proof, the burden of proof, and the assessment of evidence, and the judge has assessed all evidence based on Article 109 of Law Number 5 of 1986 and supported by two pieces of evidence based on Article 107 of Law Number 5 of 1986, the reasons for the judge's refusal and accept the arguments of the plaintiff and the defendant is because the legal remedies do not carry out the decision. The application of Article 107 of Law Number 5 of 1986 concerning the State Administrative Court was then implemented into Article 109 paragraph 1 point d of Law Number 5 of 1986 concerning the State Administrative Court must be carried out in the context of creating a quality State Administrative Court decision.

Abstract

The existence of the village is a starting point to develop and determine its position, role, and authority autonomously by developing a tourist village. Legally, Law Number 6 of 2014 concerning Villages has given positive energy to the sustainability of community welfare in the village through the development of tourist villages. The potential of tourism resources in Bengkulu is quite large, especially in Rindu Hati Village. This village has 11 types of tourism that are rarely found, including glamping, waterfalls, camping ground, tubing, rock climbing, rice fields, Putri Lake, stone boats, Supit waterfalls, the funeral of Tuanku Gagok and Raja Pembesar Alam, etc. The stages of this community service include first, identification and preliminary studies by the team, second, doing service with several techniques, which are focus group discussions, field observations, and socialization. This service resulted in Village Regulations regarding Tourism Villages and Village promotion media consisting of tourist maps and videos that would lead to village welfare.
