Abstract

Narcotics abuse is not only a national problem, but has become a global problem (world). Currently, narcotics abuse has entered all levels of society to the limit of gender, economic class, and even the age of the child. The Indonesian Government’s policy in handling narcotics abuse as regulated in Law Number 35 Year 2009  concerning Narcotics still positions narcotics abusers as criminal acts with the threat of criminal sanctions without differentiating the age limit of the perpetrators. Specifically for the handling of narcotics abuse children based on Law Number 11 Year 2012 concerning the Juvenile Criminal System, diversion must be sought. The existence of diversion is based on the fact that the criminal justice process against children dealing with the law through the formal criminal justice system causes more harm than good. Based on these problems, research is carried out using the normative legal research method, by taking an approach that is, the statutory approach related to diversion. The results showed that the concept of diversion which should be applied in Indonesia in the future, is not much different from the concept of diversion that is applied in Australia, namely Police Diversion. This is based on the consideration of the Police as the first gate to deal with children in conflict with the law to determine whether a child will proceed to the judicial process or other informal actions.

Abstract

Narcotics abusers are said to be victims of narcotics crimes and are placed into rehabilitation, but based on Decision No. 1016/Pid.Sus/2022/PN.Jkt.Brt. the defendant has been proven and determined as a narcotics abuser based on the results of the assessment and evidence which leads to rehabilitation. The formulation of the problem in this article is how the application of rehabilitation sanctions to the perpetrators of class I narcotics abuse in Decision No.1016/Pid.Sus/2022/PN.Jkt.Brt., and the obstacles and efforts in applying rehabilitation sanctions to perpetrators of class I narcotics abuse. This article uses normative juridical research methods, descriptive research nature, data used Secondary data and primary data, data collection using literature study, data analysis using qualitative, drawing conclusions using the deductive method. In the results of this study, Law Number 35 of 2009 concerning Narcotics has regulated the mandatory use of medical rehabilitation, but in practice it does not run according to the Law. The conclusion is that the implementation of rehabilitation for addicts and victims of narcotics abuse by the National Narcotics Board has followed the existing provisions. However, the possibility of shortcomings in the application of these rules remains open

Abstract

Fenomena klitih sebagai bentuk kekerasan jalanan yang melibatkan anak atau remaja sebagai pelaku utama di Daerah Istimewa Yogyakarta telah menjadi persoalan sosial dan hukum yang kompleks dalam beberapa tahun terakhir. Penelitian ini bertujuan untuk menganalisis penerapan pendekatan keadilan restoratif dalam penyelesaian perkara klitih di Yogyakarta serta menilai efektivitas mekanisme diversi sebagaimana diatur dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa penerapan keadilan restoratif dalam perkara klitih dapat menjadi alternatif penyelesaian yang lebih humanis dan edukatif dibandingkan pendekatan retributif yang berorientasi pada pembalasan. Mekanisme diversi, yang mengalihkan penyelesaian perkara anak dari proses peradilan pidana formal ke luar peradilan, terbukti sejalan dengan tujuan pembinaan dan perlindungan anak. Namun demikian, implementasinya masih menghadapi berbagai kendala, baik yuridis, struktural, maupun kultural. Hambatannya meliputi keterbatasan norma hukum dalam UU SPPA yang membatasi ruang lingkup diversi, kurangnya pemahaman aparat penegak hukum terhadap paradigma restoratif, serta resistensi masyarakat terhadap penyelesaian damai karena dianggap tidak memberikan efek jera
