Abstract

Aspek pemidanaan lingkungan merupakan kunci yang harus diperhatikan dalam penegakan hukum lingkungan yang ada di Indonesia.Berdasarkan pengertiannya tindak pidana lingkungan adalah mencemarkan dan merusak lingkungan, sebagaimana yang diatur dalam 98-115 Undang-undangPerlindungan dan Pengelolaan Lingkungan Hidup (UUPPLH). Dalam kehidupan saat ini, banyak sekali pelanggaran yang terjadi dibidang lingkungan yang akan berdampak bagi kehidupan yang akan datang. Untuk meminimalisir pelanggaran yang terjadi maka pemerintah menetapkan UU No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup.Dengan menetapkan UU tersebut diharapkan dapat berjalan sesuai dengan permasalahan yang terjadi saat ini.Untuk penelitiandalam penulisan ini, menggunakan metode penelitian normatif, yang dimana berdasarkan peraturan-peraturan tertulis, studi kepustakaan yang mengkaji aspek teori, serta penjelasan hukum.Di Indonesia sendiri faktor utama yang menyebabkan peraturan yang ditetapkan tidak berjalan dengan baik adalah, kurangnya kesadaran pihak- pihak terkait, tentang penting menjaga kelestarian alam dan lingkungan.Dan hasil dari penelitian ini menunjukkan penegakan hukum lingkungan di Indonesia berdasarkan kajian perspektif hukum pidana.

Abstract

The aspect of environmental punishment is a key that must be considered in the enforcement of environmental laws in Indonesia. Based on the definition, environmental crime is polluting and damaging the environment, as regulated in the Law on Environmental Protection and Management (UUPPLH). In this life, there are many violations that occur in the environmental sector that will have an impact on the life to come. To minimize the violations that occur, the government has enacted Law no. 32 of 2009 concerning Protection and Management of the Environment. By enacting this law, it is hoped that it can run in accordance with the problems that occur today. For research in this writing, using normative research methods, which are based on written regulations, literature study that examines aspects of theory, and legal explanations. In Indonesia, the main factor that causes the stipulated regulations to not work well is the lack of awareness of related parties about the importance of preserving nature and the environment. And the results of this study indicate that environmental law enforcement in Indonesia is based on a criminal law perspectivestudy. Keywords: Environmental Criminal Aspects, UUPPLH, and Application of Environmental Criminal Law

Abstract

Licensing in establishing a business has a legal basis contained in Government Regulation number 24 of 2018 concerning Electronically Integrated Business Licensing Services, where in the regulation it is explained that OSS (Online Single Submission) is a business license issued by the OSS Institution intended and on behalf of the minister. , leaders, institutions, governors, mayors or regents to business actors in carrying out their business. OSS is a product of government that is growing along with advances in technology. With the OSS, business actors who run MSMEs are made easier in the process of registering their businesses to get legal certainty, legal protection, and of course get their right to run a business. The purpose of writing this Community Service is specifically to assist partners in assisting in making OSS-based business legalities. In this Community Service activity, data collection techniques that are more widely used are online interviews and documentation for each stage of registration on the OSS website. Thus, the output of activities that have been achieved in Community Service is obtaining a NIB issued by the OSS institution, which will be used by business actors Cakey Bakey Co and Joyi Bakes to conduct business activities.
