Abstract

This study reviews the judge’s legal consideration basis in rejecting the confirmation of unregistered marriage (isbat nikah) for a husband who had married in the Religion Court’s decision of Nganjuk No: 1339/Pdt.G/2013/PA.Ngj and how the analysis of Islamic law against the denial of the confirmation of unregistered marriage for a husband who had married in the Religious Court’s decision of Nganjuk. The data of the research are obtained through documentation and interview. The data are then analyzed by descriptive-deductive mindset. This study concludes that the consideration and the legal basis used by the judge in the case of the confirmation of unregistered marriage is Article 4, paragraph 1 of Law No. 1 of 1974 About Marriage jo. Article 52 paragraph 1 Islamic Law Compilation. In Article 5, paragraph 1 (a) of Law No. 1 of 1974 jo. Article 58, paragraph 1 (a) Islamic Law Compilation states that one of the requirements of conducting polygamy is the condition must be approved by wife. The judge rejected the request of the confirmation of unregistered marriage because in this case, according to the judge, is classified as polygamy. Judge just looks at the judicial aspect without considering the principles of maqasid al-shari’ah. In this case, the very important to note is the civil right and welfare of children which is one of the main constituents of hifzd al-nasl (protection of children) that should be maintained. In consideration of hifzd al-nasl, the petition of the confirmation of unregistered marriage should have been granted. [Penelitian ini mengkaji tentang dasar pertimbangan hukum hakim dalam menolak ithbat nikah siri bagi suami yang sudah beristri dalam putusan Pengadilan Agama Nganjuk nomor: 1339/Pdt.G/2013/ PA.Ngj dan bagaimana analisis hukum Islam terhadap penolakan ithbat nikah siri bagi suami yang sudah beristri dalam putusan Pengadilan Agama Nganjuk tersebut. Data penelitian ini diperoleh melalui dokumentasi dan wawancara yang selanjutnya dianalisis dengan metode deskriptif menggunakan pola pikir deduktif. Penelitian ini berkesimpulan bahwa, pertimbangan dan dasar hukum yang digunakan hakim dalam menetapkan perkara ithbat nikah adalah pasal 4 ayat 1 Undang-Undang No 1 Tahun 1974 Tentang Perkawinan jo. Pasal 52 ayat 1 Kompilasi Hukum Islam. Dalam pasal 5 ayat 1 (a) Undang-Undang No 1 Tahun 1974 jo. Pasal 58 ayat 1 (a) Kompilasi Hukum Islam bahwa salah satu syarat berpoligami harus ada persetujuan dari istri. Hakim menolak permohonan ithbat nikah karena pada kasus ini menurut majelis hakim ergolong perkara poligami. Hakim hanya melihat dari aspek yuridis tanpa mempertimbangkan maqasid al-shari’ah. Dalam kasus ini yang sangat penting untuk diperhatikan adalah hak-hak keperdataan dan kesejahteraan anak yang merupakan salah satu unsur pokok hifzu al-nasli yang harus terpelihara. Dengan pertimbangan tersebut permohonan ithbat nikah ini seharusnya dikabulkan.]

Abstract

The Aswaja School is a cadre development forum organized by PMII Rayon Tarbiyah Walisongo with the main objective of internalizing the fundamental values of the organization, including its historical narratives, core principles, and Islamic teachings rooted in the Ahlussunnah wal Jama’ah tradition. This article aims to critically examine how these values are internalized during the cadre formation process, particularly through the delivery of PMII's history, organizational principles, Aswaja values, and Mabadi Khaira Ummah. This study adopts a participatory qualitative approach in which the author was directly involved as both a participant and a researcher. The findings indicate that methods such as lectures, open discussions, and ideological reflections serve as essential tools in shaping the character of PMII cadres. The Aswaja School is not merely a platform for knowledge transfer but also a reflective and ideological space where cadres develop awareness of their identity and organizational responsibilities. The article recommends enhancing participatory approaches and contextual relevance in future cadre training programs of PMII.

Abstract

The decline in morality and quality of the nation's children in this country indicates that there is a mistake in the world of our education, education itself should function as a space and process of humanization for all students and students who are currently pursuing education, both formal and non-formal, education should not only focus on the growth and development of various potentials that exist within students but furthermore it can become a strategic forum and internalization of values, ethics, morals and the main character of students so that they become individuals who, not only excel in terms of science and technology, but also based on high morals and etiquette. The research method used is qualitative with a descriptive approach. The results of the research are that to realize the human attitude of students in the Al-Irsyad Al-Islamiyyah Middle School Purwokerto school environment, it must start from the agreement of all parties, which includes several parties involved, including the school, teachers and students, then to create human beings. Kamil, students and teachers at Al-Irsyad Al-Islamiyyah Middle School, Purwokerto, must practice the values shared together to become a strong commitment to the values of community life and all aspects that bind them, including the formation of character education which has the noble goal of balancing between religious interests and ideal social needs, apart from that there are several messages that serve as a reference for all school members to always prioritize the values of character education in accordance with the teachings of the Islamic religion. Thus, character education which aims to form human beings can be seen from its main benchmark, namely understanding values and norms originating from religious teachings, which are then combined as one of the components of a character-based curriculum, meaning the values that are manifested in human morals. can be agreed upon as a character and can be well accepted by all members of the school community and social environment.

Abstract

This journal tries to investigate the complexity of integration between Islam, science and Indonesian culture in the Walisongo era. This research explores the roots of local Indonesian wisdom by examining the central role of Walisongo in integrating these three aspects into community life. Through careful historical analysis, this journal reveals how the Walisongo era became the starting point for the formation of a unique cultural identity in the archipelago. The approach used in this research is a qualitative approach, with the type of library research. The results of this research illustrate the interaction between religious beliefs, scientific knowledge, and cultural heritage shaping Indonesian society in this historical period. This study provides in-depth insight into the important role of Walisongo in integrating Islamic values, science and local traditions which ultimately form the foundation of a rich and diverse culture in the archipelago.

Abstract

This research study was conducted to examine models of integration of science, religion and culture in State Universities in Indonesia, especially State Islamic Universities (UIN). This research uses the integrative literature review method, where researchers combine various articles, books and other literature regarding the integration model of science, religion and culture in state universities. The results of this study show that State Universities are part of educational institutions that can be used as a center for dialogue between science, religion and culture. This can be seen from several campuses that have their own models in integrating science, religion and culture in state universities. Such as UIN Syarif Hidayatulloh, UIN Sunan Ampel Surabaya, UIN Sunan Kalijaga, UIN Sumatera, UIN Maulana Malik Ibrahim. Keywords: State Universities, Center for Dialogue, Religion and Culture.
