Abstract

This research addresses the complex debate regarding the practice of polygamy, which is a hot and controversial topic in various social, religious, legal, and personal contexts around the world. This research focuses on the history, relevance, and solutions of polygamy practices in the contemporary era. This study, conducted through qualitative research, details the history of polygamous practices from historical, cultural, and religious perspectives. The research questions raised include aspects of how the practice of polygamy developed, whether it is considered a necessity or a lifestyle in the contemporary era, and how solutions can be applied to overcome the negative impacts of the practice. The results show that the practice of polygamy has a long and complex history relating to historical, cultural, and religious factors. In the contemporary era, polygamy is still debated with a multifaceted approach. The research proposes solutions involving public education on gender equality and human rights, strengthening laws and policies that support monogamy, promoting intercultural and interfaith dialogue, women's economic empowerment, and developing socialisation programmes. Psychological support, public policies in favour of monogamous families, and the building of community support networks are also considered important in curbing the practice of polygamy. This research contributes to a better understanding of the dynamics of polygamous practices by combining historical analyses, contemporary studies, and relevant solutions. The results reflect the complexity of interactions between religion, culture, law, and individual choice in the contexts where polygamy is practised. Efforts to reduce the prevalence of polygamy not only rely on enforcing social norms but also involve building solid foundations for healthy and egalitarian relationships and families in the contemporary era.

Abstract

Divorce has become a significant social phenomenon, impacting not only the couple but also the children involved in the process. This research aims to explore the role of parental emotional intelligence in enhancing children's resilience post-divorce, using the Maqāṣid al-Sharī‘ah framework for analysis. Previous studies have primarily focused on external factors such as social support, co-parenting, and intervention programs in fostering children's resilience. However, this study shifts the focus toward parents' internal abilities, particularly their emotional intelligence in managing emotions and its direct impact on children. Utilizing a literature review and qualitative research with a descriptive-analytical approach, this study examines data from academic literature, journals, books, and related reports. The findings show that parental emotional intelligence plays a crucial role in maintaining children's emotional stability, thereby reducing the negative effects of divorce on their psychological, social, academic, and financial well-being. Additionally, the application of Maqāṣid al-Sharī‘ah introduces a religious and spiritual dimension to emotional intelligence, emphasizing the protection of life, intellect, and lineage. Parents with high emotional intelligence are not only able to manage conflicts healthily but also create an environment that supports the emotional and social development of their children. This research contributes to the academic discourse by integrating psychological and spiritual aspects into post-divorce parenting and offers practical implications for parents to enhance their emotional intelligence for the future well-being of their children.

Abstract

Komunikasi dan keterbukaan dalam keluarga merupakan fondasi penting bagi tumbuhnya kelekatan emosional dan kepercayaan antarpersonal. Namun tidak sedikit anak justru merasa lebih nyaman berbicara kepada orang lain daripada kepada orang tuanya sendiri. Penelitian ini bertujuan untuk mengungkap alasan-alasan mengapa komunikasi dan keterbukaan anak terputus dari orang tua serta menganalisis fenomena tersebut dalam perspektif Sadd adz-dzarī’ah, yaitu prinsip dalam fikih Islam yang bertujuan menutup jalan menuju kerusakan. Metode yang digunakan adalah studi kepustakaan dengan pendekatan kualitatif yang bersifat deskriptif-analitik-eksploratif, di mana data dikumpulkan melalui pencarian literatur kredibel dari jurnal, buku dan sumber daring melalui teknik boolean search. Hasil penelitian menunjukkan bahwa keterputusan komunikasi dan keterbukaan bukan semata disebabkan oleh niat buruk melainkan akibat akumulasi pola interaksi yang keliru, seperti tekanan komunikasi, respon menghakimi, absennya dialog emosional dan kelelahan psikologis orang tua. Di sisi lain, anak pun kerap mengalami kesulitan dalam mengungkapkan perasaan akibat minimnya tradisi komunikasi terbuka dalam keluarga. Analisis dengan teori Sadd adz-dzarī’ah menunjukkan bahwa bentuk-bentuk komunikasi yang tampak netral namun terus berulang secara tidak tepat dapat menjadi dzarī’ah, yakni sarana menuju keretakan relasi. Tekanan verbal, budaya diam, ketimpangan nilai antar generasi hingga keletihan emosional dibaca sebagai jalan-jalan kecil menuju mafsadah relasional yang perlu ditutup secara preventif. Temuan ini menegaskan bahwa membangun kembali komunikasi yang sehat tidak cukup hanya mengandalkan niat baik melainkan membutuhkan upaya sadar menciptakan ruang aman dan manusiawi agar keterbukaan dapat tumbuh kembali secara utuh dan bermakna.
