Abstract

The perspective of Islamic constitutional law, The Unitary State of the Republic of Indonesia is in harmony with the principles of Islamic state administration, because the system of government implemented has embraced the principles of Islamic constitution such as; al-Musâwah (equality), al-‘Adâlah (justice), al-Syûrâ (democration), al-Hurriyyah (freedom). The principle is contained in the five precepts of the Panacaila. HTI's efforts to establish a khilafah government according to its version in the Unitary Republic of Indonesia can disrupt the system, basis and philosophy of the State, can result in national disintegration, can eliminate religious tolerance which is substantially the principle in Islamic state administration. The birth of Perppu Number 2 of 2107 has implications for the closure of opportunities (Sadd al-Dzarîah) Community Organizations that have teachings or understandings contrary to Pancasila grow within the Unitary State of the Republic of Indonesia and HTI becomes a prohibited organization living in Indonesia. According to the consequentialist approach, the existence of HTI threatens the sovereignty of the State, so that being included in the category of levels of sadd al-dzarîah which has the effect of causing harm and danger therefore, to avoid alternative declarations dissolving HTI is the right choice that must be put forward.

Abstract

This paper examines the changing process of unlawful (haram) materials into a lawful (halal) product according to both International Islamic Fiqh Academy standard and Malaysian standard. To harmonize those two halal standards on certain products, the subdiscipline of fiqh which determines lawful product standardization has put some fundamental sharia laws to clearly distinguish between halal and haram. The changing process is based on so called istihalah, referring to the merge among halal and haram and istihlak or possibility to take rukhshah (legal relief) and easiness to cope with any difficult condition using darurat (emergency causes) and umum al-balwa (common disaster). However, critical points of the standardization method need to well described, mainly on its composition based on shariah rules of halal product. The discussion covers difference opinions on the sharia law to the weak political policy on the Islamic law arrangement for halal product standardization that it is recommended to consider clear and more careful concepts (instead of istihalah, istihlak, darurat and umum al-balwa) in formulating the law.

Abstract

The Islamic Sharia that primarily originates from the Qur'an and Hadith has the concept of Maqashid Sharia to realize benefits and prevent mafsadat. Every text of the Qur'an and Hadith implies realizing benefits and prevent mafsadat. Najmuddin Al-Thufy attempts to contrast the holy text with the concept of maslahat. He attempts to separate the concept of maslahat from the Qur'an and Hadith. In this study, the researchers intend to criticize Al-Thufy's thoughts about the contradiction of the Maslahat and the Qur'an as the holy text.

Abstract

Islamophobia is a global issue, leading to discrimination, violence, and hatred against Muslims in the Netherlands. In response to this, the Special Branch of Nahdlatul Ulama of the Netherlands (PCINU of the Netherlands) is among the Indonesian diaspora campaigning for the moderation of “Islam Nusantara” through multi-track diplomacy fiqh, a holistic approach emphasizing interdependence in politics, economics, and socio-culture. This paper discusses the  multi-track  diplomacy  fiqh  of  PCINU  of  the  Netherlands  in  fighting against Islamophobia in the country. As a non-governmental socio-religious organization, PCINU of Netherlands play a role and strategy in assisting the diplomacy of the Ministry of Foreign Affairs of the Republic of Indonesia in spreading  the  “Islam Nusantara”  idea  to  counter  Islamophobia.  This  article is  based  on  empirical  research  with  fiqh  al-siyāsah and maqāṣid  al-sharī’ah analysis.  This  study  finds  that,  in  countering  Islamophobia,  PCINU  of  the Netherlands  uses  a  multi-track  diplomacy  strategy  that  successfully  spreads friendly, anti-terror, tolerant and moderate Islam. Even though PCINU has not  fully  employed  all  Multi-track  fields,  it  has  successfully  encountered islamophobia and promoted peaceful Islam through Islam Nusantara.Keywords: multi-track Diplomacy Fiqh; Moderation; Islamophobia; Islam Nusantara; world peace AbstrakIslamofobia  menjadi  isu  global  yang  menimbulkan  diskriminasi, kekerasan,  dan  kebencian  terhadap  Muslim,  termasuk  di  Belanda.  Dalam merespons  hal  ini,  Pengurus  Cabang  Istimewa  Nahdlatul  Ulama  Belanda (PCINU  Belanda)  sebagai  diaspora  Indonesia  mengampanyekan  moderasi Islam  Nusantara  melalui  fikih  diplomasi  multitrack. Tulisan ini mendalami strategi  fikih  diplomasi  PCINU  Belanda  dalam  memerangi  Islamofobia  di Belanda. Sebagai organisasi sosial keagamaan non pemerintah, PCINU Belanda memiliki peran dan strategi dalam membantu diplomasi Kementerian Luar Negeri  Republik  Indonesia  dalam  menebarkan  moderasi  “Islam  Nusantara” merespons Islamofobia. Studi ini adalah penelitian empiris dengan pendekatan fikih siyasah dan maqāṣid al-sharī’ah. Dalam merespons Islamofobia, PCINU Belanda menggunakan strategi diplomasi multitrack yang berhasil menebarkan Islam  yang  ramah,  anti  teror,  toleran,  dan  moderat.  Meskipun  PCINU belum sepenuhnya menggunakan semua bidang multitrack, namun berhasil menghadapi  islamofobia  dan  mempromosikan  Islam  yang  damai  melalui Islam Nusantara.Kata Kunci: multi-track diplomacy; moderasi; islamfobia; Islam Nusantara; perdamaian dunia

Abstract

Ending child marriage is a global strategy to protect children’s rights. However, in some places, this agenda faces resistance. This study explores public resistance to child marriage prevention efforts in Indonesia and Malaysia. This study employs a comparative legal approach between Indonesia and Malaysia by comparing laws and regulations in both countries and the public response to them. It is found that three social factors cause the resistance against child marriage prevention in Indonesia and Malaysia. These are the desacralization of law; failure of negotiation between sharia and legal culture; and the synergy disfunction between the government, society and religious leaders. A deep understanding of these factors is important to formulate a more effective strategy to protect children from harmful child marriage practices.  Abstrak: Mengakhiri perkawinan anak adalah strategi global yang bertujuan untuk melindungi hak-hak anak. Namun, upaya ini seringkali menghadapi resistensi dalam beberapa masyarakat. Studi ini bertujuan untuk mengeksplorasi resistensi yang terjadi dalam masyarakat terhadap upaya pencegahan perkawinan anak di Indonesia dan Malaysia. Pendekatan hukum komparatif digunakan dalam studi ini dengan membandingkan peraturan perundang-undangan di kedua negara dan merujuk pada respon masyarakat terhadapnya. Dalam penelitian ini, tiga faktor sosial yang menjadi penyebab utama penolakan terhadap pencegahan perkawinan anak di Indonesia dan Malaysia diidentifikasi. Faktor-faktor ini meliputi desakralisasi hukum, kegagalan negosiasi antara syariah dan budaya hukum, serta adanya disfungsi sinergis antara pemerintah, masyarakat, dan tokoh agama. Pemahaman yang mendalam tentang faktor- faktor ini sangat penting untuk merumuskan strategi yang lebih efektif dalam melindungi anak-anak dari praktik perkawinan anak yang merugikan.

Abstract

This paper aims to portray a practice called ‘amal masjid’ which is very popular at Madura. It is performed at the street to get donation for mosque(s) construction. However, local MUI (Majelis Ulama Indonesia; Indonesian Ulama Council) issued a legal regulation to forbid it. This condition comes to a problem because the practice is the real solution for funding source. On the other hand, its existence is problematic as it disturbs even endangers street users as well as the amal men. The primary data of this research is from observation and interview at two location of amal masjid in Pamekasan and Sumenep. This paper is going to answer three questions. First, to what extent does the amal masjid represent the identity of local Maduresse Moslems? Second, how do the Maduresse Muslim negotiate the amal masjid to the local government and other stakeholders? Third, how can the amal masjid be located as a distinctive local Muslim philanthropy and the blueprint on ideal philanthropy to the world?

Abstract

Increasing the minimum age for marriage has increased the community's efforts to obtain a marriage dispensation permit in court. Generally, this application is made by children who are not old enough and not yet married, but the facts on the ground state that there are widows and widowers under age who also apply for a marriage dispensation for the second time, this raises a new problem, namely legal uncertainty for the applicant. This study will explore the problems of an underage widow and widower in registering his second marriage and the contestation of authority in the marriage of underage widows and widowers. The study was conducted by looking at and analyzing several cases of application for dispensation for the marriage of underage widows and widowers in several Religious Courts (juridical normative) and mapping related documents (library research). Three important points are noted. First, when a widow and widower under the age of 19 applies for marriage registration at the Office of Religious Affairs but is refused and directed to apply for a dispensation to marry, while in the Religious Court, there are differences of opinion among judges in the application for dispensation to marry a second time, some reject, and some accept. Second, there is contestation between the Office of Religious Affairs and the Religious Courts in viewing dispensation for widow and widower marriage because of the different legal basis used. Third, despite the contestation between the two institutions, the Religious Courts, as justice-seeking agencies, must accept the application submitted to ensure legal certainty for its citizens, namely widows and widowers under age. Thus, this article recommends two actions: namely, the need for communication between the two executive and judicial institutions to discuss the issue of marriage dispensation for underage widows and widowers so as not to contradict each other and legal certainty for underage widows and widowers who want to marry is essential.

Abstract

Although in substance Istishhâb has existed since the era of the Prophet, Istishhâb is still included in the category of Islamic legal propositions that are mukhtalaf fîh (there are differences among scholars). The construction of the new Istishhâb theory began in the fifth hijri adad in a clear and detailed manner. This paper wants to further discuss Istishhâb as a theory of Islamic law, from a historical perspective. From this point of view, it can later be concluded whether Istishhâb can be considered as a theory of Islamic law or just a method of Islamic law istinbath.
