Abstract

Abstrak - Berdasarkan Pasal 18 Ayat (1) huruf a Undang-Undang Nomor 31 Tahun 1999 jo Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi bahwa Selain pidanatambahan dimaksud dalam Kitab Undang-undang Hukum Pidana adalah perampasan barang bergerak yang berwujud atau yang tidak berwujud barangtidak bergerak yang digunakan untuk yang diperoleh dari tindak pidanakorupsi, termasuk perusahaan milik terpidana di mana tindak pidanakorupsi dilakukan, begitu pun harga dari barang yang menggantikan barang tersebut. Tujuan penulisan skripsi ini untuk menjelaskan bagaimana pelaksanaan pidana denda dalam tindak pidana korupsi, bagaimana penerapan denda pengganti kurungan dan bagaimana terpidana memilih Pidana Denda dan akibat hukum bagi yang tidak membayar denda.Data dalam penulisan skripsi ini diperoleh dengan cara penelitian kepustakaan dan penelitian lapangan. Penelitian kepustakaan dilakukan untuk memperoleh data yang bersifat teoritis, sedangan penelitian lapangan dilakukan guna memperoleh data primer melalui wawancara dengan responden dan informan.Berdasarkan hasil penelitian bahwa pelaksanaan pidana denda dalam tindak pidana korupsi dilakukan oleh jaksa dan eksekusi dapat dilakukan apabila panitera sudah mengirimkan salinan surat putusan kepada jaksa.Pidana Denda pengganti Kurungan dilaksanakan pada waktu dijatuhkan pidana denda oleh hakim yang diputus sekaligus dan ditentukan berapa hari pidana kurungan yang harus dijalani sebagai pengganti apabila pidana denda tidak dibayar. Dan bilamana terpidana tidak dapat membayar pidana denda maka dapat digantikkan dengan kurungan Maksimum 1 Tahun.Disarankan Denda jangan dikonversi dengan kurungan tapi dilakukan saja perampasan barang agar pada akhirnya denda terbayar,karena filosofi denda bukanlah untuk memperkaya negara maupun memiskinkan terpidana, hanya sebagai penjera.Kata Kunci : Penerapan pidana, denda pengganti kurungan. Abstract - Based on article 18 section (1) of  Undang-Undang Nomor 31 Tahun 1999 and  Undang-Undang Nomor 20 Tahun 2001 about The Eradication of Corruption, it states that besides  the additional criminal law mentioned in Kitab Undang-undang Hukum Pidana, there  is confiscation of tangible or intangible property which is obtained by corruption act, including the convict's corporation where the corruption is done, and also the price of propertyas replacement.The purpose of this essay is to explain the execution of criminal penalties for corruption, the implementation of fines as substitute to imprisonment and how the convict chooses the criminal fines and legal consequences for those who do not pay fines.Data in this essay is obtained by library research and field research. The library research was conducted to obtain data that is theoretical, while the field research was conducted in order to obtain primary data through interviews with respondents and informants.Based on the research, the implementation of criminal penalties for corruption committed by the prosecution and execution can be carried out by the prosecutor if the clerk had sent a copy of the decision letter to the prosecutor. The fines as subtitute for imprisonment carried out at the time imposed by the  judge who terminatesand at the same time determines how many days imprisonment will be served in casethefines  penalty is not paid. And if the convict can’t pay the fine, it can be subtituted with a imprisonmentfor maximum 1 year.It is advised to not convert the fines toimprisonment penalty but rather conduct confiscation until the convict eventually pays off the fines, because the philosophy of imposing fines is not to enrich or impoverish the state nor to impoverish the convict. Abstract

In light of the arrangements of Article 143 section (2) letter B of the Criminal System Code that the material necessities of the public prosecution should portray cautiously, obviously, and the criminal demonstration that is being accused of referencing the overall setting of the wrongdoing being perpetrated. Notwithstanding, in the choice No.55/PID.B/2015/PN-BNA and the Surakarta Locale Court Choice Number 79/PID.B/2013/PN.SKA the unmistakable components alluded to in the article have not been satisfied just as in the legitimate contemplations of the adjudicator's choice. , which doesn't plainly hold back the juridical realities uncovered at the preliminary. Since the appointed authority can't choose a case outside of the public investigator's prosecution. This composing plans to see and discover how the appointed authorities' contemplations in these 2 cases made the adjudicators just interested in 1 criminal demonstration and how the adjudicator settled on concursus. To accomplish this objective, the scientist utilizes a regulating legitimate exploration technique that leaves from lawful issues with a similar strategy. This review utilizes optional information sources comprising of essential lawful materials, auxiliary lawful materials that incorporate authority archives, books, and examination brings about the type of reports. The information was examined by subjective strategies. Similarly, the appointed authority in giving his choice. It is trusted that the appointed authority in giving the choice should contain juridical realities by considering the realities uncovered at the preliminary, so the choice given by the adjudicator doesn't contain blunders in settling on the choice, so nobody is hurt and upsets the general population by the appointed authority's choice.
