Abstract

At this time, during the COVID-19 pandemic, the government's role in meeting the community's needs for housing is urgently needed in providing funds and providing initiatives in housing development efforts. The presence of the Home Ownership Credit system is very much needed by people whose economic income is in the small and medium levels. During this pandemic, banking is one of the sources for obtaining funds which is considered easy and fast for some people in terms of needing funds to meet their needs, such as in utilizing funding from banks in the Home Ownership Credit facility. Each granting credit, there will be rights and obligations. Banks can only consider granting credit if the applicant is a legal subject, because the legal subject is a supporter of rights and obligations, meaning that they can receive rights and be charged with obligations. This study describes the legal arrangements in Home Ownership Loans during the covid 19 pandemic, to find out the rights and obligations of the parties in the Home Ownership Loan agreement, as well as to find out efforts to settle defaults in the Home Ownership Loan agreement. This research was obtained from secondary data, namely library research, namely by collecting references related to the object or research material. Article 1754-1769 is one of the forms of loan-borrowing agreement. By the agreement that has been stated in the credit agreement, each party will obtain its rights and obligations. What is the right of the debtor is the obligation of the bank, and what is the obligation of the debtor is the right of the bank. The implementation of the Home Ownership Credit agreement is made based on a free agreement with the meaning that the agreement can be made freely. Any form of agreement is made between two parties who capable of acting by law to carry out an achievement that does not conflict with the applicable legal rules, morality, and public order, in agreeing to the provision of credit loans, the bank needs to pay attention to the restrictions regulated by the applicable laws and regulations.

Abstract

The environmental problems can no longer be said to be purely natural problems, because humans provide a very significant causative factor for environmental events. The purpose of this research is to find out and analyze environmental criminal law enforcement based on Pancasila justice, which is a legal concept that upholds the values of justice, equality and humanity. the approach method used in this study uses a normative juridical approach, the resulting research results state that the 2009 Environmental Protection and Management Law defines a crime as an act that can result in exceeding ambient air quality standards, water quality standards, seawater quality standards, or standard criteria for environmental damage. Enforcement of environmental criminal law based on Pancasila justice is a legal concept that upholds the values of justice, equality and humanity.

Abstract

Penelitian ini bertujuan untuk mengetahui penelitian ini mengeksplorasi Deviant Behavior atau perilaku menyimpang pada anak usia dini dan dampaknya terhadap perkembangan sosial dan emosional mereka. Dengan metode deskriptif kualitatif, penelitian ini mencermati bentuk-bentuk perilaku menyimpang seperti kekerasan fisik (mencubit, memukul), dan faktor-faktor yang mempengaruhinya seperti lingkungan sosial desa, latar belakang pendidikan, dan pekerjaan. Hasil penelitian menunjukkan dampak negatif perilaku menyimpang terhadap perkembangan sosial dan emosional anak, termanifestasi dalam ketidakpercayaan diri, sifat pemalu, kecenderungan untuk diam, dan perkembangan kognitif yang tidak optimal. Penelitian ini menekankan bahwa perilaku menyimpang adalah hasil dari diferensiasi hubungan dalam keluarga dan berdampak signifikan terhadap perkembangan anak usia dini. Hal ini menunjukkan pentingnya intervensi dini dan pendukung dalam mencegah dan menangani perilaku menyimpang ini.

Abstract

Keterkaitan hukum antara tenaga medis dengan pihak pasien dalam menjalankan pelayanannya sebagai tenaga kesehatan tidak jarang hal tersebut dilalui dengan adanya peristiwa dimana tenaga kesehatan mengabaikan secara sengaja ataupun tidak hak pasien hingga timbulnya sebuah masalah atau sengketa. Mediasi merupakan salah satu sarana dalam penyelesaian sengketa alternatif di luar pengadilan. Malpraktik medis merupakan tindakan yang dilakukan oleh tenaga kesehatan mengenai praktek jahat ataupun tidak dalam hal tersebut tidak terpenuhinya suatu standar yang awalnya telah di tentukan oleh profesi. Pengaturan mengenai penyelesaian sengketa medis melalui mediasi diatur dalam Pasal 29 Undang-Undang Nomor 36 Tahun 2009 terdapat kekaburan norma didalamnya dimana dalam pasal tersebut diatur tentang mediasi tetapi tidak menjelaskan secara jelas mengenai mediasi apa yang di maksud, lebih khususnya tidak dijelaskan mengenai upaya mediasi penal yang mengakibatkan implisit dalam pengaturannya, sehingga perlu untuk diteliti. PP No 47 Tahun 2021 BAB III Kewajiban Rumah Sakit Pasal 27 ayat (1) poin r mengamatkan bahwa “menyusun dan melaksanakan peraturan internal Rumah Sakit”. Artinya Undang-undang telah mengamanatkan kepada Manajemen Rumah sakit membuat dan menetapkan sendiri aturan tentang menyelesaian sengketa pabila terjadi kemudian hari sengketa medik. Metode penelitian yang dipakai dalam penelitian ini ialah metode penelitian yuridis normatif dimana hal ini dilakukan dengan cara penelitian bahan pustaka atau yang sering di katakan dengan data sekunder berupa hukum positif. Hasil pembahasan ini menunjukan bahwa manajemen rumah sakit telah menetapkan mekanisme penyelesaian sengketa medik tahap awal adalah mediasi. Sebagai Alternatif penyelesaian permasalahan dengan sangat baik dan terstuktur.

Abstract

The purpose of this research is to analyze the legal protection of child victims of physical violence by biological parents. This research uses a literature review approach by looking for theoretical references that are relevant to the case or problem found. Based on the results and discussion, it is found that the forms of violence experienced by children are physical violence such as: being kicked, hit, thrown with wood, slapped and even hung, resulting in children feeling depressed by the violence they experience and children who experience this rarely communicate with their friends. The sources that trigger physical violence against children are poverty, violence also occurs because the parents are stressed or have complicated problems. Abstract

Online gambling has become a significant phenomenon in the current digital era, giving rise to various implications and legal aspects that need to be considered. Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE) is one of the relevant legal foundations in regulating online gambling activities. The legal implications of online gambling according to the ITE Law include recognition of electronic evidence, law enforcement against violations that occur online, and protection of consumers involved in online gambling transactions. Legal aspects that need to be considered include determining legal sanctions for online gambling players, the obligation of organizers to comply with the provisions of the ITE Law, and efforts to prevent and overcome harmful online gambling practices. By understanding the implications and aspects of this law, it is hoped that a safer and more orderly digital environment can be created for people in their online activities.

Abstract

Health is a human right and one element of prosperity that must be realized in accordance with the ideals of the Indonesian nation. As intended in the 1945 Constitution of the Republic of Indonesia (UUD 1945) contained in Article 28 H paragraph (1) and Article 34 paragraph (2) and to provide comprehensive social security, the state is developing a National Social Security System for all people Indonesia by establishing Law Number 40 of 2004 concerning the National Social Security System (UU SJSN). As a form of implementation of the SJSN Law, the government issued Law Number 24 of 2011 concerning the Social Security Administering Body (UU BPJS) to accelerate the implementation of the national social security system as a whole, including National Health Insurance (JKN) which will be administered by BPJS Health. This research adopts a normative juridical method, which focuses on analysis of statutory regulations, policy documents, and legal literature relevant to legal protection for hospitals against delays in payment of claims by BPJS. This research discusses Late Fines, Supply Chain Financing (SCF), Dispute Resolution, Termination of Claim Payment Agreements by BPJS. Hospitals have an obligation to provide services to BPJS participating patients and BPJS Health's obligation is to pay hospital claims according to the agreement. The delay in payment of claims by BPJS Health will of course affect the hospital's cash flow. One way to protect hospital interests is to provide legal protection against delays in claim payments by BPJS Health. The first legal protection provided is to use a complaint mechanism. Apart from that, more specific legal protection is also regulated, namely the existence of late fines for BPJS Health which refers to Presidential Regulation Number: 82 of 2018 and cooperation agreements, the SCF program to maintain hospital cash flow, dispute resolution carried out by deliberation and termination of the agreement if it is wrong. one party is proven to have defaulted as stipulated in the cooperation agreement.
