Abstract

Medicine is something that is very important in human life because humans are not always healthy, medicine is something that is consumed by consumers so that human medicine can be healthy and can return to activity because it must be remembered that a body that is physically and mentally healthy can contribute to the State, society and family. This research is a descriptive and empirical normative, where the data collection is carried out by observation, interviews, the results of which are assessed qualitatively and quantitatively so that it can provide an idea of how the actual application of protection to consumers who consume contaminated drugs that can trigger cancer. It turns out that even though there is Law No. 8 of 1999 on Consumer Protection.

Abstract

Marriage is something that is considered very sacred in human life and it is as a family for humans to continue their offspring, every human tries to fight to maintain the plume of his household in order to survive, but in terms of the fact that many households have many problems due to many factors. The government in its position as a supervisor and to maintain the presence of community members establish PERMA NO 1 2016 which regulates that every case submitted to the Religious Court must be carried out with mediation. This research is descriptive empirical which data is sourced from primary and secondary data, data collection is done by conducting field research, observations and interviews. The results of the study shows that mediation is failed because: a. the lack of human resources in the Lubuk Pakam Religious Court because there are only 5 Judges, it is not comparable with the current cases and not all Judges can also act as Mediators. b. Unprofessional Attorney who only wants the case to be settled by litigation. c. The parties have unanimous their decision to divorce because they hold too long a longstanding grudge.

Abstract

Each country strives to achieve what is the goal of the Nation and State which for Indonesia is stated in the 4th paragraph of the 1945 Constitution, namely to achieve public welfare, one way is to improve transportation facilities, this is very important to support the activities of the daily community. . This research is socio-juridical, looking at how an existing legal regulation is applied in society. Data collection was carried out by means of observation, interviews and questionnaires consisting of online motorcycle taxi drivers and office staff of online motorcycle taxi institutions and consumers.From the results of the research that the legal relationship between online motorcycle taxi drivers is only a partnership relationship and also as a liaison between partners and consumers, however the partnership relationship is made with a separate role and it is written that the partner frees PT Paket Global Semesta in criminal and civil lawsuits, because each agreement it must comply with Article 1320. Based on the provisions of the law that online motorcycle taxi drivers are not appropriate as partners because this is only an individual and in the standard agreement entered into by PT. Paket Global Semesta which regulates the rights and obligations of both parties, in fact it provides more benefits than the producer and as if the entrepreneur is transferring the risk to the partner, this is still a dilemma about the legal consequences that will occur in the implementation of all activities offered by producers to consumers, there are still many discrepancies.

Abstract

Abstrak Penelitian ini menganalisis keabsahan hak katas tanah terhadap objek tanah yang didapat dari tukar menukar, untuk menganalisis problematika yang terjadi pada pelaksanaan kepemilikan tanah dalam tukar menukar tanah obyek sengketa dan menganalisis pertimbangan hakim dalam putusan Nomor 92/PDT/2021/PTKPG mengenai tukar menukar tanah obyek sengketa menukar dengan objek hak atas tanah. Penelitian ini menelesuri keabsahan hak katas tanah terhadap objek tanah yang didapat dari tukar menukar, bagaimana problematika yang terjadi pada pelaksanaan kepemilikan tanah dalam tukar menukar tanah obyek sengketa, bagaimana pertimbangan hakim dalam putusan Nomor 92/PDT/2021/PTKPG mengenai tukar menukar tanah obyek sengketa menukar dengan objek hak atas tanah. Metode Penelitian ini menggunakan yuridis normatif. Adapun temuan hasil penelitian yakni keabsahan tukar menukar dengan objek hak atas tanah diatur KUHPer dan UUPA. Terjadinya tukar menukar tanah yakni menguasai objek tanah sengketa. Penyelesaian sengketa sudah diputusan melalui perkara Nomor 92/PDT/2021/PTKPG mengenai tukar menukar tanah dengan obyek sengketa adalah milik dari Pembanding semula Penggugat yang diperoleh dari tukar menukar antara orang tua Pembanding semula Penggugat dengan orang tua Para Terbanding semula Para Tergugat. Rangkuman dalam penelitian ini adalah pemberian tanah sengketa dari ayah penggugat yaitu Penehas Sakbana, almarhum dan ibu penggugat Rosalin Sakbana Mesakh kepada penggugat adalah sah. Tetapi menurut hukum perbuatan Para Tergugat menguasai tanah sengketa tanpa ijin Penggugat merupakan perbuatan melawan hak, melanggar hukum dan merugikan Penggugat. Kesimpulan dari penelitian ini adalah keabsahan tukar menukar dengan objek hak atas tanah diatur Pasal 1541 s/d Pasal 1545 KUHPer dan Pasal 20 ayat (2) UUPA. Problematika yang terjadi pada tukar menukar tanah diantaranya menguasai tanah sengketa tanpa ijin pemilik dan mengalihkan tanah sengketa kepada orang lain. Pertimbangan hakim dalam putusan Nomor 92/PDT/2021/PTKPG mengenai tukar menukar tanah dengan obyek sengketa bahwa Pembanding semula Penggugat yang diperoleh dari tukar menukar antara orang tua Pembanding semula Penggugat dengan orang tua Para Terbanding semula Para Tergugat. This research method uses normative juridical. As for the findings of the research results, namely the validity of the exchange with the object of land rights is regulated by the Civil Code and the UUPA. There is an exchange of land, that is, controlling the disputed land object. The settlement of the dispute has been decided through case Number 92/PDT/2021/PTKPG regarding the exchange of land with the object of the dispute belonging to the original plaintiff's comparator obtained from the exchange between the plaintiff's comparator's parents and the parents of the appellant, originally the defendants. The summary in this study is that the awarding of the disputed land from the plaintiff's father, Penehas Sakbana, the deceased and the plaintiff's mother Rosalin Sakbana Mesakh to the plaintiff is legal. However, according to the law, the actions of the Defendants in controlling the disputed land without the Plaintiff's permission were an act against their rights, violated the law and harmed the Plaintiff. The validity of the exchange with objects of land rights is regulated in Article 1541 to Article 1545 of the Civil Code and Article 20 paragraph (2) of the UUPA. Abstract

This study offers a sociological and normative analysis of the persistent stigmatisation of former drug offenders and its implications for the implementation of restorative justice and Islamic ethical values in the contemporary Indonesian context. Employing a qualitative approach through field research and literature review, the study investigates the socio-cultural dynamics, public perceptions, and institutional obstacles that hinder the effective reintegration of ex-offenders into society. The findings indicate that former drug offenders often face multilayered stigma—manifesting in social exclusion, limited employment opportunities, and distrust within their communities—which significantly undermines the objectives of restorative justice. These challenges prolong the cycle of marginalisation and contradict the restorative principles of reconciliation, rehabilitation, and social healing. Moreover, the study reveals a gap between legal-normative frameworks and community practices, where punitive attitudes prevail over rehabilitative intentions. From the perspective of Islamic ethics, values such as rahmah (compassion), tawbah (repentance), and islah (reconciliation) serve as essential moral foundations that advocate for the acceptance and reintegration of reformed individuals. These values emphasise the potential for personal transformation and the collective responsibility of society to facilitate restorative outcomes. This study recommends a holistic synergy between restorative justice mechanisms, Islamic ethical values, and public education initiatives to dismantle stigma, promote inclusivity, and foster a more humane justice system. The academic contribution of this research lies in its integrative framework that combines socio-legal theory with Islamic moral philosophy to critically assess the structural and cultural barriers to reintegration, offering a contextualised model for human-centred restorative justice in Muslim-majority societies.
