Abstract

President of the Republic of Indonesia, Joko Widodo said that, based on a number of calculations, Indonesia would perch as one of the five countries with the strongest economy in the world in 2045, when it entered Indonesia 100 years with millennial generation at the peak age of 40-51 years, and this is a productive age. Indonesia has the potential to be shared. 263 million population, who live on more than 17,000 islands consisting of 34 provinces and 514 cities / districts. This community is plural and part of 714 tribes with 1,100 more local languages. Although the majority of the population adheres to Islam, there are many residents of other religions too. No less important to note, that the implementation of decentralization in Indonesia shows the fate and quality of 2/3 (two thirds) of the citizens’ lives, in practice, is largely determined by local government performance of services, ranging from environmental sanitationissues, such as waste management, school quality and health services. Everything depends on the high-low of public services quality in the area. The economic development in Indonesia, especially the legal matters, there is something that needs to be considered, that the law in Indonesia moretowards criminal sanctions against companies, thus carrying the image that, if you want to be an entrepreneur, be prepared to be in prison. And this give opportunities for the officials trap in the abusement of power. A series of datas, regional officials arrested, 24 governors and 115 regents /mayors by the Corruption Eradication Commission (KPK) in 2004-2019. The majority of cases are related to bribery and gratification.

Abstract

The responsibility of the shipping company in reimbursing losses suffered by consumers in the delivery of goods resulting from damage to goods or loss of goods then looking for evidence that damage and loss of goods occur due to transportation of goods to the detriment of the consumer in accordance with Article 188 of Law No. 22 of 2009 concerning Road Traffic and Transportation and Article 1 number 1 of Law No.8 of 1999 concerning Consumer Protection. From the results of the study it can be concluded that first, if the goods transported are lost / stolen or damaged due to the fault of the transporting company, then he must be responsible. Second, the legal efforts undertaken by the consumer, namely the resolution of disputes outside the court, the peaceful settlement of disputes by the parties to the dispute is a legal remedy that was first attempted by the parties to the dispute, before the parties chose to settle the dispute through the Consumer Dispute Settlement Agency. The results of the study the authors provide advice to protect consumers, shipping companies responsible for compensation for goods / or services must be replaced with the actual price of goods in accordance with the law by looking at a written contract that is agreed between the business actor and the consumer.

Abstract

Provisions regarding business competition law in Indonesia are regulated in Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition which regulates various prohibitions on actions that cause unfair business competition from activities or agreements between business actors, one of which is cartels. This study aims to analyze the use of indirect evidence by KPPU in the process of proving allegations of cartel practice and to analyze the factors that hamper the use of indirect evidence by KPPU in the process of proving alleged cartel practices. The use of research as a contribution to knowledge in the field of legal science, especially business competition law related to indirect evidence in cartel evidence and to add insight to legal practitioners, legal consultants, especially in the field of law regarding indirect evidence by the KPPU. This research is a normative legal research using the approach method in this research is a statutory approach and a case approach.

Abstract

The Covid-19 pandemic has a very big impact in the industrial world, many companies have terminated employment (PHK) for workers, both PKWTT and PKWT. In the Manpower Act No. 13 of 2003 and the Job Creation Act No. 11 of 2020 concerning labor and termination of employment. Regarding termination of employment, termination of employment to outsourced workers, the author discusses 2 (two) problem formulations, namely: First: How is the responsibility of outsourcing companies to outsourcing workers / laborers who were terminated during the Covid-19 pandemic; Second, what is the comparison of the forms of legal protection for outsourcing workers / laborers who have experienced termination of employment according to Law no. 13 of 2003 concerning Manpower and Law no. 11 of 2020 About Job Creation. The research method used in this thesis is the Normative-Empirical method. The conclusion of this decision is First, that the outsourcing company is still in charge of the implementation of termination of employment, this can be seen in the PT SIS PKWT; Second, in terms of comparison between UUK No. 13 of 2003 with UUCK No.11 of 2020 not much has changed, only in UUKC regarding labor Outsourcing is more discussed.

Abstract

Penelitian ini ditujukan untuk memahami penerapan business judgement rule pada direksi yang menjalankan fungsi pengurusan Perseroan dan Perlindungan Hukum terhadap direksi dalam pengurusan perusahaan melakukan kebijakan yang merugikan perusahaan dikaitkan pada Undang-Undang No. 40 Tahun 2007 tentang Perseroan Terbatas. Penelitian ini merupakan penelitian yuridis normatif dengan metode pendekatan penelitian terhadap pendekatan perundang-undangan. Sumber data berdasarkan data primer, sekunder dan tersier yang dianalisis secara yuridis deskriftif. Hasil penelitian menunjukkan bahwa penerapan Business Judgement Rule memberikan perlindungan hukum bagi direksi dan pejabat perseroan dari pertanggungjawaban atas setiap kebijakan atau keputusan bisnis atau transaksi yang mengakibatkan kerugian bagi perseroan, selama kebijakan atau keputusan bisnis atau transaksi tersebut dilakukan dengan itikad baik, penuh kehati-hatian, serta dalam lingkup tanggung jawab dan wewenangnya

Abstract

Korupsi adalah satu kata yang telah menjadi istilah yang populer di Indonesia sebagai suatu tindakan yang merugikan pemerintah dengan mengambil uang negara yang semestinya untuk kepentingan rakyat. Penyuapan atau suap adalah salah satu masalah yang sudah sangat lama terjadi dalam masyakat. Pada umumnya suap diberikan kepada orang yang berpengaruh atau pejabat agar melakukan atau tidak melakukan sesuatu yang berhubungan dengan jabatannya. Tujuan dalam penulisan ini bertujuan untuk mengetahui pertanggungjawaban pidana oleh pelaku tindak pidana korupsi dalam bentuk suap kepada pejabat penyelenggara negara yang melakukan penyalahgunaaan jabatan dan untuk mengetahui dasar pertimbangan hakim dalam menjatuhkan pemidanaan terhadap pelaku tindak pidana korupsi dalam bentuk penyuapan aktif. Penelitian ini menggunakan penelitian hukum normatif (Normative law research) yang dilakukan dengan cara meneliti bahan-bahan pustaka, yaitu buku, jurnal, artikel-artikel resmi, menelusuri doktrin-doktrin dan teori hukum dari berbagai literatur dan peraturan perundang-undangan yang berlaku dan berkaitan dengan permasalahan yang dibahas. Hasil dari penelitian ini menunjukkan bahwa Pertanggungjawaban pidana terhadap pelaku tindak pidana korupsi suap dijatuhi pidana oleh Pengadilan Negeri Surabaya dalam Putusan Nomor 195/Pid Sus/TPK/2017/PN Sby dengan pidana penjara selama 2 (dua) tahun dan denda sebesar Rp 50.000.000 (lima puluh juta rupiah).

Abstract

Label Informasi Nilai Gizi pada produk pangan mempunyai peranan penting dalam terwujudnya keamanan pangan bagi konsumen dan jaminan atas informasi yang benar. Tujuan penelitian ini adalah untuk mengetahui tanggung jawab produsen terhadap konsumen atas produk pangan olahan yang tidak sesuai dengan janji yang dinyatakan dalam label gizi dan untuk mengetahui perlindungan hukum bagi konsumen terhadap pemberian label gizi yang tidak sesuai dengan mutu produk pangan olahan. Metode yang digunakan dalam penelitian penelitian ini adalah metode kepustakaan (Library Reaserch). Pendekatan masalah yang digunakan adalah pendekatan normatif. Pelaku usaha sebagaimana tertulis dalam Pasal 19 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen bertanggungjawab memberikan ganti rugi atas kerusakan, pencemaran, dan atau kerugian konsumen akibat mengkonsumsi barang dan atau jasa yang dihasilkan atau diperdagangkan berupa pengembalian uang atau penggantian barang dan/atau jasa yang sejenis atau setara nilainya, atau perawatan kesehatan dan/atau pemberian santunan yang sesuai dengan ketentuan peraturan perundang-undangan yang berlaku. Dalam hal konsumen yang merasa dirugikan dapat melakukan upaya hukum sesuai dengan Pasal 54 ayat (2) yaitu penyelesaian sengketa melalui pengadilan atau diluar pengadilan.

Abstract

Pada hakikatnya CSR adalah nilai yang melandasi aktivitas perusahaan, dikarenakan CSR menjadi pijakan komperhensif dalam aspek ekonomi, sosial, kesejahteraan dan lingkungan perusahaan. Karena pada prinsipnya kedudukan Perda CSR dalam peraturan perundang-undangan adalah bertentangan dengan peraturan yang lebih tinggi (Lexsuperior derogat legi inferior). Undang-Undang PMA, Undang-undang Minyak dan Gas Bumi dibuat oleh DPR bersama Pemerintah Pusat. Sedangkan peran pemerintah daerah adalah melakukan monitoring dengan perangkat Analisis Mengenai Dampak Lingkungan dan Sosial (Amdalsos) dan mengkaji sejauh mana perusahaan mampu memberikan manfaatnya kepada stakeholder dalam hal ini masyarakat setempat. Implementasi hukum yang dilakukan pemerintah daerah terhadap pelaksanaan dan pengawasan CSR pada Perseroan Terbatas tidak merupakan wewenang daripada pemerintah daerah. Akan tetapi pemerintah daerah dapat melakukan monitoring terhadap penerapan CSR ditengah masyrakat mengenai dampak lingkungan yang diakibatkan perusahaan serta manfaat yang diberikan perusahaan bagi masyarakat setempat.

Abstract

Workers at work and when entering retirement age, that in everyday life it is difficult to deny the condition of workers categorized as marginalized (groups), this can be seen through Government Regulation concerning retirement age Number: PER-02/1995 retirement age 55 years and Government Regulation No: 45 of 2015 the retirement age is 56 years and can be extended to 60 years. Whereas in daily reality there are still many workers who work in the formal sector, generally in private companies are employed over the age of 60 years. Whereas according to the labor law, namely Law no. 13 of 2003 article 167 (currently has been removed) the retirement age is not regulated explicitly and only refers to the pension benefit which is regulated by the amount of the pension benefit according to the working period of the worker/laborer. Whereas according to the Job Creation Law, Number 11 of 2020 Cluster IV concerning Employment does not refer to the Government Regulation regulating the retirement age, and the Cluster IV Job Creation Act Number 11 of 2020 only regulates pensions and the nominal value of pension benefits is regulated by Government Regulation Number 35 of 2021.

Abstract

Living law is an inseparable part of the Indonesian criminal law system. However, in perspective of legality principle, living law causing pros and cons. The idea of regulating the living law in Indonesian, as the basis for criminal prosecution, for unregulated act is still debated. The issue that will be analysed in this article is how to apply living law/adat law as a basis for prosecuting criminals related to the existence of legality principle and, how to measure the enforcement of living law in criminal process. Based on the analysis using the principle of legality, it can be concluded that living law, as basis for prosecution, is contrary to principle of legality and protection of human rights. The enactment of living law can potentially create legal uncertainty and abuse of power by the government. Law enforcement against living law is also difficult to implement, because it is tied to the four indicators. Therefore, the living law provision better not be placed as part of general principles in the Indonesian Penal Code Bill. Keywords: Code Bill: Legality principle; Living law.
