Abstract

AbstrakPembuktian adanya tindak pidana kekerasan seksual, khususnya dengan korban anak kerapkali menghadapi sejumlah kendala, yaitu tidak atau sulit adanya saksi karena dilakukan tersembunyi dan di wilayah privat dan korban masih di bawah umur.  Salah satu terobosan dalam bidang ini muncul dalam  putusan Nomor 159/Pid.Sus/2014/PN.Kpg, di mana hakim memutus terdakwa tindak pidana kekerasan seksual terhadap anak bersalah dengan menggunakan ketentuan pembuktian seperti yang diatur dalam Undang-Undang Kekerasan Dalam Rumah Tangga. Tulisan ini akan menelaah pertimbangan dan penalaran hakim dari sudut pandang teori pembuktian. Metode penelitian yang digunakan adalah yuridis normatif dan antisipatif, dengan pendekatan penafsiran progresif. Kajian menemukan terkait penerapan sistem pembuktian terdapat penafsiran progresif hakim dalam memutus perkara kekerasan seksual terhadap anak. Kata kunci: teori pembuktian, kekerasan seksual terhadap anak, penafsiran progresif AbstractProving before the Court of Law that a child has been sexually abused is a difficult task. It is made hard by a number of factors, i.e.  eyewitnesses are hard to come by as the crime more often than not is committed within a private, closed, sphere, and by the fact that the victim is underage.  One breakthrough had been made by a judge who decided in a case (No. 159/Pid.Sus/2014/PN. Kpg) to use evidentiary ruling from the Domestic Violence Act.  This article shall explore, from an evidentiary theory, what legal consideration and reasoning has been utilized to support the decision. The research method used is normative and anticipative juridical, with approach of interpretation and reasoning of progressive law. This study found progressive interpretation has been applied by the judge to the case. Keywords: evidentiary theory, sexual violence directed against a child, progressive interpretation

Abstract

Kewajiban negara di bawah CEDAW, antara lain, adalah untuk menghilangkan diskriminasi terhadap perempuan dalam perkawinan menurut Pasal 16 dan menjamin hak-hak perempuan pedesaan menurut pasal 14. Penelitian ini mencoba untuk menemukan diskriminasi terhadap perempuan dalam hukum adat perkawinan  Nias dan kewajiban Negara berdasarkan Konvensi CEDAW.  Hasil penelitian menunjukkan bahwa persyaratan dan pelaksanaan Nias perkawinan hukum adat telah melanggar UU Perkawinan di Indonesia dan berdampak pada adanya diskriminasi terhadap hak-hak perempuan dalam perkawinan.

Abstract

Abstract

The term Human Rights Defenders (Pembela HAM in Indonesia) stands for any people or group whose activities revolve around the defense and promotion of human rights and other basic freedoms. In the course of their work, human rights defenders often experience verbal threats, attacks and even physical acts of violence that seriously hamper their activities.Women human rights defenders are an important part of human rights activism. However, they are a vulnerable group because of their position and status as women.  Being vulnerable, the bodies, sexuality and identity of women human rights defenders have been violently attacked through the exploitation of gender stereotypes biased against women. However, it is apparent that women human rights defenders in Indonesia are not adequately protected. This paper employs normative analytical descriptive research methods by looking at the specificity of women human rights defenders as a vulnerable group facing specific attacks and violence, as well as examining various norms of protection. The Government of Indonesia through the existing legal norms has an obligation to fulfil the protection of women human rights defender, considering the vulnerability of women human rights defenders.

Abstract

Pancasila and Human Rights are a concrete form of implementing the constitution and protecting citizens in accordance with the goals of the nation as stated in the Preamble to the 4th paragraph of the 1945 Constitution of the Republic of Indonesia. In its implementation, Pancasila and Human Rights guarantee equality of all levels and groups of society in service and participation as citizens. The process of entering Chinese ethnicity into the civilization of Indonesian society certainly cannot be separated from various aspects, including history. Ethnic Chinese migrated to Indonesia through trade routes and gave birth to cultural acculturation. Over time, the influence of the presence of ethnic Chinese in Indonesia experienced upheavals, resulting in various discriminatory practices against them. The existence of discriminatory practices that occur shows that between the indigenous people and the Chinese there are gaps and various problems. Examples of discriminatory cases or practices that occurred include Riots during the reform era, restrictions on participation and political rights, expulsions, rapes, and others that are still happening today. In this case, the indigenous people feel competitive economically and in other aspects.

Abstract

Trafficking in Persons (TPPO) is a complex transnational crime with significant impacts on victims, both economically and psychosocially. Batam City, as a major transit area in the TPPO network in Indonesia, faces major challenges in the implementation of restitution for victims in accordance with Perma No. 1 Year 2022. This study aims to analyze the effectiveness of restitution provision in Batam City, identify the main obstacles in its implementation, and evaluate the role of law enforcement officers in ensuring victims' rights are fulfilled. Using both qualitative and quantitative approaches, this study collected data through in-depth interviews and surveys with victims, lawyers, and relevant stakeholders. The results show that although regulations on restitution have been established, its implementation still faces obstacles in legal, administrative, and social aspects. The low fulfillment of restitution is caused by the ineffectiveness of legal mechanisms, weak law enforcement against TPPO intellectual actors, and lack of public awareness of victims' rights. This study recommends policy reform, strengthening the capacity of legal apparatus, and increasing victims' access to restitution in order to create a more effective and equitable protection system for victims of TPPO.

Abstract

Ecocide constitutes a major environmental crime driven by power dynamics and carries significant consequences for human life. In the Indonesian context, several environmental incidents, such as river pollution by palm oil industries, the Lapindo mudflow disaster, and gold mining operations in Intan Jaya, Papua, demonstrate the severe and direct impact of environmental harm on communities. This research explores whether such cases in Indonesia can be classified as ecocide and examines whether ecocide should be treated as a serious human rights violation or recognized as a distinct criminal offense. Utilizing a normative-empirical juridical approach, the study concludes that environmental crimes in Indonesia have the potential to be categorized as ecocide and, thus, may qualify as gross human rights violations. Accordingly, two possible regulatory paths are proposed: first, the urgency of ratifying the Rome Statute, should ecocide be included under its jurisdiction as a gross human rights violation; and second, the incorporation of ecocide into Indonesia’s Human Rights Court Law, acknowledging both the potential benefits and challenges of such a legal reform.
