Abstract

The Islamic principle encourages people to be alert for society. To achieve the objective of sharia, Muslim has been provided the clear path to collaborate with the creatures fairly. The injustice financial practice one of the aspects that Islamic principles emphasise to not involve. On top of this, the usury (Riba) where someone charges the excess for the loan unfairly. The interest practice has been a critical topic throughout the time. Due to the unfair practice, the major religions and civilisations cursed this practice as general. Nevertheless, in practical situations, there were numbers of approaches for each religion and civilisation. Plato with among ancient philosopher criticized this and argued this is a media to squeeze poor people. In Judaism, the interest is prohibited among Jews, while in the Hinduism allowed otherwise in a lower caste in the society. In Christianity, priests in the medieval banned this practice, but it has been diluted in the 6th century due to the sovereign pressure. Islam sprightly prohibited the interest despite the diversity of its models, the value, the grade and to whom it will be exercised. This article emphasises on Islamic finance point of view towards the cross religions and civilisation. Utilised the library/literature-based research, the author delivers the main ideas in the comparative approaches of the interest issues. Abstrak: Prinsip Islam mendorong manusia agar waspada terhadap masyarakat. Untuk mencapai tujuan syariah, Muslim telah diberikan jalur yang jelas untuk bekerja sama dengan sesamanya secara adil. Praktik keuangan yang tidak adil merupakan salah satu aspek yang ditekankan agar di hindari oleh prinsip-prinsip Islam. Riba adalah praktik di mana seseorang membebankan kelebihan atas pinjaman secara tidak adil. Praktik bunga merupakan topik penting dari masa ke masa. Karena praktik ini tidak adil, agama-agama besar dan peradaban secara umum telah mengutuk praktik ini. Namun demikian, dalam situasi praktis, ada beberapa pendekatan dari setiap agama dan peradaban. Plato, kalangan filsuf kuno, mengkritik hal ini dan berpendapat bahwa praktik bunga adalah media untuk memeras orang-orang miskin. Dalam Yudaisme, bunga juga dilarang, sedangkan dalam Hinduisme, hal ini diizinkan kecuali untuk kasta yang lebih rendah di masyarakat. Dalam agama Kristen, para pendeta di abad pertengahan melarang praktik ini, tetapi praktik ini telah diizinkan pada abad ke-6 karena tekanan kedaulatan. Islam melarang praktik bunga terlepas dari apa pun modelnya, nilainya, kelasnya dan kepada siapa ia akan dilaksanakan. Artikel ini menekankan sudut pandang keuangan Islam terhadap lintas agama dan peradaban. Kata Kunci: Bunga, Riba, Peradaban

Abstract

This article is based on a critical review of the judgment in the Indonesian Islamic Court, known publicly as Mahkamah Syar’iyah, case number 18/JN/2016/MS.MBO. The tribunal process in the Indonesian legal system should present clear evidence that convinces all involved parties, including for sexual abuse cases. Unfortunately, during the tribunal process of the case, the judges had neither asked the prosecutor to show the evidence nor asked how the case had happened. After asking a few simple questions, judges have made consideration and finally a judgment. Two main research questions will be answered in this article; how is restorative justice applied for law-breaking cases in Acehnese view? Why has the punishment been imposed by the Mahkamah Syar'iyah in its legal considerations for the case? This article has used the black-letter law method and interview. The research results have indicated that the case seems weird and does not provide the due process of law principle. The tribunal procedure has not provided any sufficient evidence before the verdict had been decided. The connection between both evidence and judicial facts, in this case, is very blurred. The witness was simply based on the victim's evidence.

Abstract

Islamic kingdoms in Indonesia have played significant roles in spreading and enforcing Islamic law. Each kingdom has a judge from an Islamic school in the Islamic judiciary process. If the cases are difficult to adjudicate, the court invites other Islamic scholars from other kingdoms to give their opinion on the cases. Islamic scholars have habitually written books to be used by further Islamic scholars. Although Islamic kingdoms have shared their experiences and knowledge, the implementation of Islamic law has still been different even though decisions tended to find their way to justice. For instance, in family law cases, the verdicts could be different, considering the customary law established in each kingdom. This article utilizes a historical legal approach to analyze the data from historical documents in Indonesia. The Islamic court in Indonesia has grown from the court in the time of Islamic kingdom, including Islamic family law. However, the present-day Islamic court has developed further than it was in the time of Islamic kingdom in Indonesia. Thus, the 4.0 era has also affected the judiciary process. Abstrak: Kerajaan-kerajaan Islam di Indonesia telah memainkan peran penting dalam menyebarkan dan menegakkan hukum Islam. Setiap kerajaan memiliki hakim dari sekolah Islam dalam proses peradilan Islam. Jika kasusnya sulit untuk diadili, pengadilan mengundang ulama Islam lainnya dari kerajaan lain untuk memberikan pendapat mereka tentang penyelesaian kasus tersebut. Cendekiawan Islam memiliki kebiasaan menulis buku yang digunakan untuk sarjana Islam selanjutnya. Meskipun di antara kerajaan-kerajaan Islam telah berbagi pengalaman dan pengetahuan, penerapan hukum Islam masih berbeda, meskipun cenderung mencari jalan menuju keadilan. Misalnya, dalam kasus hukum keluarga putusannya bisa berbeda, mengingat hukum adat yang dipraktekkan dalam suatu kerajaan. Artikel ini menggunakan pendekatan hukum historis untuk menganalisis data dari dokumen sejarah di Indonesia. Peradilan Islam di Indonesia memiliki keterkaitan dengan peradilan pada masa kerajaan Islam, termasuk hukum keluarga Islam. Akan tetapi Peradilan Islam saat ini lebih berkembang dibandingkan pada masa kerajaan Islam di Indonesia; salah satu penyebabnya adalah era 4.0 juga mempengaruhi proses peradilan.
