Abstract

AbstractThe purpose of this article  to determine the judge’s considerations using penal mediation in the settlement of Domestic Violence (KDRT) cases and its formulation in the future. This is a normative study with case approach, comparative approach and conceptual approach. The legal matterial of this research are primary legal matterial and secondary legal material with deductive analystic mind. Reffering the research above, Showed that there is a difference of judges consideration using the result of penal mediation in the form of peace between offender and victim who still have relationship of husband and wife in the settlement of case of domestic violence for offense. First, it is based on the benefit and recovering of the relationship of the offender and the victim, to the exclusion of the legalistic rules, so that the Judge arrives at the decision of the prosecution otherwise unacceptable. Second, based on expediency, but the legal process continues with the imposition of a conditional penalty. The existence of differences in consideration and judgment because the mediation of penal itself is not yet regulated in positive criminal law in Indonesia. However, with the starting point on the principle of benefit and the theory of pragmatic realism, the Judge should not worry or hesitate to use the results of peace in penal mediation as a way of resolving a domestic violence case by  stopping the proceedings, although considered to be contrary to the principle of legal certainty. This has implications for the achievement of substantial justice for offender and victim, a quicker settlement of cases and avoid the accumulation of cases in the Court. Therefore the future needs to be formulated for mediation of penal entry into inseparable part in the procedure of settling the case of domestic violence, especially for offense complaints, ranging from the level of investigation, prosecution and court.Keywords: Penal Mediation; Domestic Violence; Judge’s DecisionAbstrakTujuan artikel ini adalah untuk mengetahui pertimbangan Hakim menggunakan mediasi penal dalam penyelesaian perkara Kekerasan Dalam Rumah Tangga (KDRT) dan formulasinya di masa mendatang. Penelitian ini merupakan studi normatif dengan pendekatan  kasus, pendekatan komparatif dan pendekatan konseptual. Bahan hukum yang digunakan berupa bahan hukum primer dan bahan hukum sekunder dengan pola analisis deduktif. Hasil penelitian, menunjukkan bahwa adanya perbedaan pertimbangan Hakim menggunakan hasil mediasi penal berupa perdamaian antara pelaku dan korban yang masih ada hubungan suami istri dalam penyelesaian perkara KDRT untuk delik aduan. Pertama, mendasarkan pada kemanfaatan dan pulihnya hubungan pelaku dan korban, dengan mengenyampingkan aturan yang bersifat legalistik, sehingga Hakim sampai pada putusan berupa penuntutan dinyatakan tidak dapat diterima. Kedua, mendasarkan pada kemanfaatan, namun proses hukum tetap dilanjutkan dengan penjatuhan pidana bersyarat. Adanya perbedaan pertimbangan dan penjatuhan putusan tersebut karena mediasi penal sendiri memang belum diatur dalam hukum positif pidana di Indonesia. Akan tetapi dengan bertitik tolak pada asas kemanfaatan dan teori realisme pragmatis, semestinya Hakim tidak khawatir atau ragu menggunakan hasil perdamaian dalam mediasi penal sebagai jalan penyelesaian perkara KDRT dengan menghentikan proses perkara, meski dianggap bertentangan dengan asas kepastian hukum. Hal tersebut berimplikasi pada tercapainya keadilan substansial bagi pelaku dan korban, penyelesaian perkara yang lebih cepat dan menghindari penumpukan perkara di Pengadilan. Kedepannya perlu diformulasikan agar mediasi penal masuk menjadi bagian tidak terpisahkan dalam prosedur penyelesaian perkara KDRT, khususnya untuk delik aduan, mulai dari tingkat penyidikan, penuntutan dan pengadilan.Kata kunci: Mediasi Penal; Kekerasan Dalam Rumah Tangga; Putusan Hakim.

Abstract

AbstractThis article aims to explain the causes of the rejection of child immunization and efforts should be made so that the implementation of the childhood immunization program is well received in the protection of the rights of children in Karanganyar. This type of research is empirical. Form of research is exploratory. The data used are primary data and secondary data collection methods of documentation and interviews. Analysis of data using qualitative analysis. Based on the description of the results of research and discussion in connection with the considered problem with the theory of the legal system and application of the theory of law, it can be concluded that the factors that led to the rejection of immunization is: (a) the legal structure has not been able to implement the rules contained in the law; (b) legal norm or rule can not be implemented fully in society; (c) Most people do not understand the law and legal content community do not know the benefits of the existing law. Efforts should be made so that the implementation of the childhood immunization program is well received by all communities in Karanganyar district are: (a) the legal structure should be addressed; (b) The public policy context with the real conditions in the field or community legal norms or rules that can be applied; (c) promoting positive law and the laws governing the contents of the immunization program to the public so that people understand them. As for the consequences of the legal system are not addressed, then the rejection of child immunization will still occur and may tend to increase. The rights of children to be immunized and the rights of children born to avoid the diseases that threaten the survival and/or cause disability unprotectedKeywords: Legal Protection; Rights of the Child; Immunization Program.AbstrakArtikel ini bertujuan menjelaskan faktor penyebab terjadinya penolakan imunisasi anak dan upaya yang harus dilakukan agar pelaksanaan program imunisasi anak dapat diterima dengan baik dalam upaya perlindungan hak-hak anak di Kabupaten Karanganyar. Jenis penelitian adalah empiris. Bentuk penelitian adalah eksploratif. Data yang digunakan adalah data primer dan data sekunder dengan metode pengumpulan data dokumentasi dan wawancara.  Analisis datanya menggunakan analisis kualitatif. Berdasarkan deskripsi hasil penelitian dan pembahasan sehubungan dengan masalah yang dikaji dengan teori sistem hukum dan teori  penerapan hukum, dapat disimpulkan bahwa faktor yang menyebabkan terjadinya penolakan imunisasi adalah : (a) Struktur hukumnya belum mampu melaksanakan aturan yang ada dalam hukum; (b) Norma atau aturan hukumnya belum dapat diterapkan sepenuhnya di masyarakat; (c) Sebagian masyarakat belum memahami hukum dan isi hukum sehingga masyarakat belum mengetahui manfaat dari hukum yang ada. Upaya yang harus dilakukan agar pelaksanaan program imunisasi anak dapat diterima dengan baik oleh semua masyarakat di Kabupaten Karanganyar adalah : (a) struktur hukumnya harus dibenahi; (b) Adanya kebijakan publik yang lebih kontekstual dengan kondisi riil di lapangan atau masyarakat sehingga norma atau aturan  hukumnya dapat diterapkan; (c) mensosialisasikan hukum positif dan isi hukum yang mengatur tentang program imunisasi kepada masyarakat sehingga masyarakat memahaminya. Adapun konsekuensi apabila sistem hukumnya tidak dibenahi, maka penolakan imunisasi anak akan tetap terjadi dan mungkin cenderung meningkat. Hak anak untuk mendapatkan imunisasi dan hak anak yang lahir terhindar dari penyakit yang mengancam kelangsungan hidup dan/atau menimbulkan kecacatan belum terlindungi.Kata kunci: Perlindungan Hukum: Hak Asasi Anak; Program Imunisasi.

Abstract

AbstractThe sole objective of this article for finding out the urgention of the non punitive action implementation for the civil aviation accident and serious incident and the steps to accomply it. This research is normative study research with statute approach and comparative approach study in national and international level. The legal matterial of this research are primary legal matterial and secondary legal material with deductive analystic mind. Reffering the research above, showed that Indonesia as contracting state of Chicago Convention 1944 through joining with International Civil Aviation Organization, Indonesia need implemented the non punitive action in accident and serious incident of civil aviation through mandatation in Annex 13 ICAO. The mandate of that annex base on just culture principle and it said that everyone especially the aviation personel do not given punishment from the regulator reffered by the violation valued, so base on that act, the personel must be punished, because the just culture principle not recognize the punishment of the safety act that reffered on their experience and training. If the punitive culture still on hand, it can implicated to the contraproductive of corrective action from the accident and serious incident happening and unjust feeling of the personel affected by the punishment by the consequent of accident and serious incident. For realize the non punitive action culture for created safety culture, need the following action as recomendation in this research, such as determination of unsafe act, evaluation of national law which inconsistent with just culture principle, and the estabilished the pilot proffesion councilKeywords: Non Punitive Action; Just Culture; Civil Aviation Accident and Serious IncidentAbstrakTujuan penelitian ini  adalah  mengetahui urgensi penerapan non punitive action terhadap kecelakaan dan insiden serius pesawat udara sipil dan langkah upaya untuk mewujudkannya. Penelitian  ini  merupakan  studi  normatif  dengan  pendekatan  perundang-undangan  dan perbandingan. Bahan hukum yang digunakan berupa bahan hukum primer berupa peraturan perundang-undangan ditingkat nasional maupun internasional dan bahan hukum sekunder yang digunakan berupa pendapat ahli, jurnal, dan literatur non hukum dengan pola analisis deduktif. Dari hasil penelitian, menunjukan bahwa Indonesia sebagaicontracting state terhadap Konvensi Chicago 1944 melalui bergabungnya Indonesia pada International Civil Aviation Organization, Indonesia perlu menerapkan prinsip non punitive action terhadap pilot akibat kecelakaan dan insiden serius pesawat udara sipil, yang diamanatkan melalui Annex 13 ICAO. Amanat tersebut didasarkan pada prinsip just culture yang berprinsip bahwa setiap manusia khususnya personel penerbangan tidak dapat diberi penghukuman terhadap tindakan yang dinilai salah sehingga atas perbuatan tersebut personel tersebut harus dihukum, karena dalam prinsip just cultureyang merupakan bagian dari safety culture, tidak mengenal penghukuman atas sebuah tindakan maupun keputusan yang merupakan yang diperoleh dari pengalaman dan pelatihan personel tersebut, akan tetapi just culture juga tidak memberikan toleransi akibat kesalahan yang bersifat intentional violation. Apabila budaya punitive action tetap terpelihara, maka berimplikasi pada terhambatnya upaya corrective action dari peristiwa kecelakaan maupun insiden serius serta rasa ketidak adilan terhadap personel yang diberi sanksi akibat kecelakaan maupun insiden serius. Untuk mewujudkan budaya non punitiveaction agar terciptanya safety culture tersebut, diperlukan upaya-upaya yang mengikutinya sebagai rekomendasi dalam penelitian ini, antara lain pendeterminasian terhadap unsafe act, evaluasi hukum nasional yang inkonsisten dengan just culture, serta pembentukan majelis profesi penerbang.Kata Kunci: Non Punitive Action; Just Culture; Kecelakaan dan insiden serius pesawat udara sipil

Abstract

AbstractThis Articel to analyze the implementation of policy on the prevention and combat of Human Immunodefisiency Virus and Aquired Immune Deficiency Syndrome (HIV/AIDS) in Surakarta City. This type of research in writing this is a non-doctrinal/empirical, with basing on the concept of the law of the 5th. The form used is the research diagnostic analysis. The data type of the data source, and the primair include primary and secondary legal materials. Data analysis using qualitative analysis. Based on the results of research and discussion with respect to issues that are examined, it can be summed up as follows : (1) Factors that become the cause of inadequate response to the HIV and AIDS amongst others caused the problem of HIV and AIDS has not been considered a priority issue by the health sector as well as the development of related sectors; (2) the political support that has not been adequately against the program; (3) yet uncoordinated Commission Response AIDS (KPA) and the SKPD of Surakarta City either the direction of development, planning and implementation of policies and programs regarding the Decree despite various efforts for tackling even the financing has been issued; and (4) the still inadequate dissemination of information and access to health services and the availability of VCT services, ARV existence for sufferers and those at high risk with HIV/AIDS. The steps that must be performed in order to cope with HIV/AIDS in Surakarta, among others : (1) Aspects of the substance of the law with further strengthen runway operations mainly technical instructions and guidelines that govern the start of planning, implementation, evaluation, monitoring, sanctions; (2) Aspects of structure/function and by improving the institutional tasks of KPA either in quality, as well as institutional manegement KPA. (3) Aspects of culture either by increasing the involvement of the population of Key Non Governmental Organizations (NGOs) care about HIV/AIDS and high risk groups in planning the program and run the program as well as an evaluation of the program as a Field Officer (FO), Counselor, Case Manager. The establishment of culture/culture done by influencing the attitudes and behavior of continuously/routine so that you can understand, addressing the process of countermeasure and empathy, so as to minimize the discrimination against People Living with HIV/AIDS (ODHA).
