Abstract

The Indonesian Child Protection Commission (Komisi Perlindungan Anak Indonesia, KPAI) found an increase in the involvement of children in the narcotics trade. In 2018, 5.9 million children in Indonesia were exposed as narcotics addicts, 27 percent of them or 1.6 million became narcotics dealers. This study aims to determine the criminal responsibility of children in narcotics trafficking cases in Decision Number 31/Pid.Sus.anak/2015/PN.BKS. The method used in this research is normative juridical. Based on the results of the study, the criminal responsibility of children in narcotics trafficking cases was legally and convincingly proven guilty of violating Article 111 paragraph (1) in conjunction with Article 132 paragraph (1) of Law Number 35 of 2009 concerning Narcotics and sentenced to imprisonment for 7 months taking into account that the Defendant's actions are contrary to the government's program which is actively eradicating narcotics trafficking, the Defendant regrets his actions and promises not to do it again, the Defendant is still underage and lacks attention from his parents, the Defendant has never been punished. So that narcotics cases against children do not grow rapidly, an anti-narcotics ambassador program is held in each school regularly every year so that school students are always reminded not to abuse narcotics and in the RT/RW/Village community a task force for handling narcotics abuse is formed to prevent abuse as early as possible. narcotics in the environment are still. Keywords: Criminal Liability, Children, Narcotics Circulation

Abstract

Setting scores in football matches often occur whether coaches, players, or match officials do it. Several countries such as Italy, the Netherlands, and Indonesia already have regulations containing legal sanctions for these practices. This study used a normative juridical method obtained through a literature review, then analyzed qualitatively normative. This study aims to determine the law enforcement of scoring cases in soccer matches in Indonesia, the Netherlands, and Italy. The results showed that scoring arrangements in Indonesia could be acted upon under Law No. 20 of 2001 on amendments to Law No. 31 of 1999 concerning the Eradication of Corruption, while in the Netherlands, it used Wetboek van Strafrecht (Criminal Code) article 326, and in Italy regulated in Legge 13 dicembre 1989 n.401: truffa sportiva.Keywords: Score Setting, Football.

Abstract

Justice Collaborator is often interpreted as “Crown Witness”. The case of the premeditated murder of Brigadier Nofriansyah Yosua Hutabarat in 2022 became a hot topic of conversation among the Indonesian people, involving high-ranking police officers and their aides, one of the perpetrators, namely Richard Eliezer, then ventured to volunteer to become a Justice Collaborator to reveal the facts about the premeditated murder incident. the. Justice Collaborator usually reveal certain crime cases that are categorized as extraordinary crimes or extraordinary crimes in Indonesia, where Justice Collaborator play an important role, especially assisting law enforcers such as investigators and public prosecutors, from the process of investigation, investigation, to examination at trial, witnesses play a role is so important that it is often the determining reason when uncovering the case. The type of research used in this study is Normative Juridical research which bases its analysis on Law Number 31 of 2014 Concerning the Protection of Witnesses and Victims, Article 340 of the Criminal Code, and Supreme Court Circular Letter Number 4 of 2011 which is valid and relevant to the legal issues that become focus of research Legal protection for Justice Collaborator in premeditated murder cases. Legal protection is a form of service that must be provided by the government to provide a sense of security to every citizen. LPSK provides full protection for Richard Eliezer in protecting Richard Eliezer during the trial process. all the things he knows about a problem, be it who is the main actor and so on, so that the case becomes clear. Keywords: Justice Collaborator, Witness And Victim Protection, LPSK Justice Collaborator sering diartikan sebagai “Saksi Mahkota”. Kasus pembunuhan berencana terhadap Brigadir Nofriansyah Yosua Hutabarat pada tahun 2022 lalu menjadi perbincangan panas masyarakat Indonesia, melibatkan perwira tinggi polri dan para ajudannya, salah satu pelaku yaitu Richard Eliezer kemudian memberanikan diri untuk mengajukan diri menjadi Justice Collabolator untuk mengungkapkan fakta-fakta atas peristiwa pembunuhan berencana tersebut. Justice Collabolator memiliki peran yang sangat penting dalam membantu para penegak hukum dalam mengungkap suatu tindak kejahatan tertentu yang dikategorikan sebagai extra ordinary crime atau kejahatan luar biasa. Justice Collaborator akan berperan sebagai saksi yang membantu penyidik dan penuntut umum mulai dari proses penyelidikan, penyidikan, sampai pemeriksaan pada persidangan. Penilitian ini bersifat Yuridis Normatif dengan Undang-Undang Nomor 31 Tahun 2014 Tentang Perlindungan Saksi dan Korban, Pasal 340 KUHP, serta Surat Edaran Mahkamah Agung Nomor 4 Tahun 2011 sebagai dasar analisis yang berlaku dan relevan dengan permasalahan hukum yang menjadi fokus penelitian dalam kasus pembunuhan berencana ini. Setiap masyarakat wajib mendapatkan pelayanan oleh pemerintah dalam bentuk perlindungan hukum agar tercipta rasa aman dalam proses hukum. LPSK memberikan layanan sepenuhnya untuk melindungi Richard Eliezer beserta keluarganya selama proses persidangan. Hal tersebut dikarenakan status Richard Eliezer sebagai Justice Collaborator atau saksi yang bekerja sama. Status Justice Collaborator akan didapat oleh orang yang berkenan memberikan fakta hukum atau semua hal yang diketahuinya terkait sebuah peristiwa hukum hingga kasus tersebut menjadi lebih jelas dan mencapai hasil yang memiliki nilai keadilan. Abstract

Bom Bali I is one of the terrorist incidents that occurred in Indonesia. Government Regulation in Lieu of Law (Perppu) Number 1 of 2002 and Perppu Number 2 of 2002, which relate to the enactment of Perppu Number 1 of 2002, were subsequently issued as a result of the terrorist incident known as the Bali Bombing. The Minister in Charge of Political, Legal, and Security Matters asked the House of Representatives to amend Government Regulation in Lieu of Law (Perppu) Number 1 of 2002 into Law Number 15 of 2003, but terrorist attacks persisted until President Joko Widodo changed it into Law Number 5 of 2018 concerning the Amendment of the Previous Law. Terrorism causes significant losses, so the government is responsible for protecting victims and fulfilling their rights among which is by offering compensation. Chapter VI of Law Number 5 of 2018 on Law Number 15 of 2003 Amendments regulates the protection of terrorism victims, including information on the payment of compensation of damages to terrorist victims, ranging from economic losses, disabilities, to death. This research uses the Normative Juridical method by analyzing laws, legal documents, and other materials related to the implementation of compensation. Regulations governing the rights of victims have begun to take into consideration the protection of terrorist victims' rights. The government established the National Counter-Terrorism Agency and the Witness and Victim Protection Agency to protect and defend the rights of terrorist victims as intermediaries. The amount of terrorist compensation is also decided by the extent of the victim's loss; in this instance victims' rights terrorism crimes are fulfilled through the interdependence of justice, legal protection, and legal certainty.
