Abstract

The lack of job opportunities in the country has pushed thousands of Indonesian citizens to seek work abroad. The Indonesian Migrant Workers Protection Agency (Badan Pelindungan Pekerja Migran Indonesia, BP2MI) released the placement of Indonesian Migrant Workers (Pekerja Migran Indonesia, PMI) in 2018 (April) period as many as 23,431 people and 2019 as many as 25,489 people. Meanwhile, the Central Statistics Agency (Badan Pusat Statistik, BPS) stated that 520 Indonesian Migrant Workers had problems in 2018 (April) period and 846 people in 2019. This study aims to determine the protection of Indonesian Migrant Workers who have problems abroad and the government's obstacles in protecting Indonesian Migrant Workers who have problems abroad. This study uses a normative juridical approach. That is the approach taken to legal materials, both primary, secondary, and tertiary legal materials by examining theories, concepts, legal principles, and laws and regulations related to this research. The results of this study are first, protection for Indonesian Migrant Workers who have problems abroad, namely technical protection in the form of providing shelter, juridical protection in the form of legal assistance to PMI who are in a legal process, and political protection in the form of bilateral agreements. between Indonesia and recipient countries regarding the placement and protection of PMIs. Second, the obstacles faced by the government in protecting PMIs are the lack of legal awareness of PMI candidates, the weakness of the supervisory system, the difficulty of registering PMIs in the destination country, and the difficulty of providing lawyers to assist PMIs who conflict with the law. To reduce problematic PMI cases abroad, local governments must realize the existence of a Migrant Workers Care Village (Desa Peduli Migrant Workers, DESBUMI) in every village.Keywords: Protection, Migrant Workers, Problems

Abstract

AbstractForgery of letters/documents can be interpreted as an act that has the aim of imitating, creating an object that is no longer original or making an object lose its validity. Mixed marriages are regulated in Article 57 of Law Number 16 of 2019 concerning amendments to Law Number 1 of 1974 concerning Marriage. For the marriage to be registered, the conditions such as marriage documents must be met. If there is a forgery of mixed marriage documents, the marriage can be annulled. The cancellation of mixed marriages has an impact on the legal status of the marriage and the parties involved. Cases of falsification of mixed marriage documents that have occurred in Indonesia are those of the artist Jessica Iskandar who falsified her mixed marriage documents. The purpose of this study is to find out the legal consequences of falsifying mixed marriage documents in Indonesia (case studies of Jessica Iskandar and Ludwig Franz Willibald) and legal protection for children born. The research method used is normative juridical, namely through literature studies which examine mainly secondary data in the form of laws and regulations, agreements or contracts, other legal documents, research results, study results, and other references.Keywords: Document Forgery, Mixed Marriage

Abstract

Abortion is prohibited except on the basis of indications of medical emergencies and pregnancy due to rape as regulated in Article 75 paragraph (2) of Law Number 36 the Year 2009 Concerning Health. Nevertheless, there are some cases where rape victims who abort their womb are found guilty of violating Article 346 of the Criminal Code. This study discusses the legal protection of abortionists in pregnancy due to rape. The purpose of this study was to analyze the legal protection of victims of rape who had an abortion (abortion provokes). The research method used is a normative juridical approach that is through literature studies that examine secondary data in the form of legislation and other legal documents, research results, results of studies, and other references. The results of this study are that rape victim who did an abortion were not convicted in accordance with Article 75 paragraph (2) of Law Number 36 of 2009 concerning Health and the existence of pre and post-abortion counseling in accordance with Article 37 of Government Regulation Number 61 of 2014 concerning Reproductive Health.Keywords: Legal protection, Abortion, the rape victim

Abstract

The Indonesian Child Protection Commission (Komisi Perlindungan Anak Indonesia, KPAI) found an increase in the involvement of children in the narcotics trade. In 2018, 5.9 million children in Indonesia were exposed as narcotics addicts, 27 percent of them or 1.6 million became narcotics dealers. This study aims to determine the criminal responsibility of children in narcotics trafficking cases in Decision Number 31/Pid.Sus.anak/2015/PN.BKS. The method used in this research is normative juridical. Based on the results of the study, the criminal responsibility of children in narcotics trafficking cases was legally and convincingly proven guilty of violating Article 111 paragraph (1) in conjunction with Article 132 paragraph (1) of Law Number 35 of 2009 concerning Narcotics and sentenced to imprisonment for 7 months taking into account that the Defendant's actions are contrary to the government's program which is actively eradicating narcotics trafficking, the Defendant regrets his actions and promises not to do it again, the Defendant is still underage and lacks attention from his parents, the Defendant has never been punished. So that narcotics cases against children do not grow rapidly, an anti-narcotics ambassador program is held in each school regularly every year so that school students are always reminded not to abuse narcotics and in the RT/RW/Village community a task force for handling narcotics abuse is formed to prevent abuse as early as possible. narcotics in the environment are still. Keywords: Criminal Liability, Children, Narcotics Circulation

Abstract

Setting scores in football matches often occur whether coaches, players, or match officials do it. Several countries such as Italy, the Netherlands, and Indonesia already have regulations containing legal sanctions for these practices. This study used a normative juridical method obtained through a literature review, then analyzed qualitatively normative. This study aims to determine the law enforcement of scoring cases in soccer matches in Indonesia, the Netherlands, and Italy. The results showed that scoring arrangements in Indonesia could be acted upon under Law No. 20 of 2001 on amendments to Law No. 31 of 1999 concerning the Eradication of Corruption, while in the Netherlands, it used Wetboek van Strafrecht (Criminal Code) article 326, and in Italy regulated in Legge 13 dicembre 1989 n.401: truffa sportiva.Keywords: Score Setting, Football.

Abstract

Bom Bali I is one of the terrorist incidents that occurred in Indonesia. Government Regulation in Lieu of Law (Perppu) Number 1 of 2002 and Perppu Number 2 of 2002, which relate to the enactment of Perppu Number 1 of 2002, were subsequently issued as a result of the terrorist incident known as the Bali Bombing. The Minister in Charge of Political, Legal, and Security Matters asked the House of Representatives to amend Government Regulation in Lieu of Law (Perppu) Number 1 of 2002 into Law Number 15 of 2003, but terrorist attacks persisted until President Joko Widodo changed it into Law Number 5 of 2018 concerning the Amendment of the Previous Law. Terrorism causes significant losses, so the government is responsible for protecting victims and fulfilling their rights among which is by offering compensation. Chapter VI of Law Number 5 of 2018 on Law Number 15 of 2003 Amendments regulates the protection of terrorism victims, including information on the payment of compensation of damages to terrorist victims, ranging from economic losses, disabilities, to death. This research uses the Normative Juridical method by analyzing laws, legal documents, and other materials related to the implementation of compensation. Regulations governing the rights of victims have begun to take into consideration the protection of terrorist victims' rights. The government established the National Counter-Terrorism Agency and the Witness and Victim Protection Agency to protect and defend the rights of terrorist victims as intermediaries. The amount of terrorist compensation is also decided by the extent of the victim's loss; in this instance victims' rights terrorism crimes are fulfilled through the interdependence of justice, legal protection, and legal certainty.

Abstract

Kekerasan seksual merupakan pelanggaran hak asasi manusia yang berdampak multidimensi terhadap korban, baik secara fisik, psikis, maupun sosial. Pengesahan Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) menandai komitmen negara dalam memperkuat perlindungan hukum bagi korban, termasuk melalui kewajiban pembentukan Unit Pelaksana Teknis Daerah Perlindungan Perempuan dan Anak (UPTD PPA) di tingkat daerah. Penelitian ini bertujuan untuk menganalisis implementasi perlindungan hukum terhadap korban kekerasan seksual di Kabupaten Banyumas pasca berlakunya UU TPKS serta peran partisipasi masyarakat dalam optimalisasi perlindungan tersebut. Penelitian ini menggunakan metode sosio-legal dengan pendekatan kualitatif melalui studi kepustakaan dan penelitian lapangan. Hasil penelitian menunjukkan bahwa UPTD PPA Kabupaten Banyumas berperan aktif dalam memberikan layanan pengaduan, pendampingan, dan pemulihan korban melalui mekanisme litigasi dan nonlitigasi. Selain itu, partisipasi masyarakat turut mendukung efektivitas perlindungan korban melalui sosialisasi, pelaporan, dan penghapusan stigma terhadap korban kekerasan seksual.

Abstract

Dewasa ini lingkungan perlu mendapat penanganan serius dari pemerintah khususnya .Hal ini perlu dilakukan mengingat lingkungan hidup di sekitar kita akan menunjang kelangsungan pembangunan seperti yang tertuang dalam Pasal 1 angka (3) Undang undang Pengelolaan Lingkungan Hidup,termasuk sumber daya ke dalam proses pembangunan untuk menjamin kemampuan, kesejahteraan dan mutu hidup generasi masa kini dan generasi masa depan. Badan Llingkungan Hidup (BLH) Kabupaten Banyumas adalah lembaga daerah yang bersifat non teknis membantu bupati dalam penanganan maupun usaha pelestarian fungsi lingkungan hidup di Kabupaten Banyumas, khususnya dalam hal persampahan, penanggulangan pencemaran akibat sampah di TPA Gunung Tugel yang secara teknis ditangani oleh Bidang Pengendalian Pencemaran Lingkungan yang mempunyai peran melakukan pencegahan dan penangulangan yang bersifat monitoring, pengintegrasian program, koordinatif, konsultatif serta pengawasan dan pengendalian dalam rangka pelaksanaan pembangunan yang berwawasan lingkungan. Abstract

Kelautan dan perikanan meruapakan salah satu sektor pendapatan nasional dalam bidnag ekonomi. Pengelolaan sumber daya ikan secara benar pada hakikatnya adalah amanat Undang Undang Dasar 1945. Hasil eksplorasi kelautan dan perikanan merupakan salah satu sumber kas daerah yang dapat membantu pembangunan pemerintah daerah terutama pada daerah daerh yang memiliki wilayah pesisir pantai. Optimalisasi sektor kelautan dan perikanan juga sudah digalakan akan tetapi belum optimal. Salah satu kendala yang dihadapi nelayan adalah pola bagi hasil antara nelayan dan pemilik kapal.perjanjian bagi hasil antara nelayan DPCHNSI Kota Nelayan dengan memiliki kapal Bintang Mas berdasarkan pada adat kebiasaan dengan presentase 50:50 dengan tidak melanggar ketentuan perundang undangan yaitu undang undang no. 16 tahun 1064 tentang hasil bagi perikanan. Hal ini dikarenakan dalam ketentuan undang undang tersebut memberikan kelonggaran pada hukum adat setempat tentang bagi hasil asalkan angka pembagiaanya tidak kurang dari 40:40 dengan pengawasan walikota dan gubernur. Sedangkan sengketa yang timbul adalah keadaan dimana biaya operasional dan hasil lelang tidak imbang sehingga pemilik kapal harus memberikan kebijaksanaan untuk memberikan uang kepada ABK dan nahkoda. Selain itu juga nahkoda berbuat curang yaitu menjaul tangkapannya di tengah laut dan hasilnya masuk ke kantong pribadi. Prosedur penyelesaian apabila terjadi sengketa antara nelayan dengan pemilik kapal yaitu melalui musyawarah mufakat. Apabila penyelesaian tersebut tidak mencapai mufakat maka penyelesaian dilakukan di Pengadilan Negeri Pekalongan Kata Kunci :Bagi Hasil Nelayan dan Pemilik Kapal
