Abstract

Murabahah yaitu suatu perjanjian antara bank dan nasabah dalam bentuk pembiayaan pembelian atas sesuatu barang yang dibutuhkan oleh nasabah. Jenis-jenis Penyelesaian Sengketa Ekonomi Syari’ah yaitu: Perdamaian(Sulhu),Arbitrase Syari’ah (Tahkim) dan Lembaga Peradilan Syari’ah (Qadha)

Abstract

This study aims to analyze how the consequences of the weaknesses of the contract concept as stated in the KHES, and how the solutions to the weaknesses of the contract concept are. This research is a qualitative research library research (literature review) with a descriptive-analytical approach which is strengthened by primary and secondary data sources, while the data analysis techniques used are inductive, deductive, and comparative. The results showed that the consequences of the weaknesses of the contract concept in KHES were; Different interpretations, Sharia economic disputes are not resolved, the parties are harmed and do not provide massive information. While the solution to the weakness of the concept of the contract in article 25 paragraph (2) is that the solution to the clarity of the meaning of sighat al aqd is to provide a comparison with the sighat al-aqd that is in muamalah fiqih as KHES absorption adheres to these rules. More precisely, the contract must be carried out clearly, in oral, written and/or art form, and for the harmony of the mudharabah agreement Article 232 it is customary to add the object of the contract, and the main purpose of the contract as one of the pillars in the contract, as well as adding the provisions of the qardul hasan contract to book II. in chapter XXVII, also provides limitations in article 607, while article 347 must provide clarity in detail.

Abstract

AbstrakGeliat perkembangan ekonomi syariah di indonesia semakin pesat, hal ini tidak lepas dari prinsip spiritualis idealis yang diusung oleh sistem perekonomian ini, Berbicara tentang ekonomi syariah berarti memperbincangkan persoalan harta, benda, dan transaksi, sehingga diskurs itu tidak akan pernah lepas dari gesekan atau sengketa yang diakibatkan oleh Wanprestasi. Tulisan ini berusaha mengupas tuntas persoalan dualisme kewenangan peradilan Agama atau Negeri dalam menyelesaikan sengketa Ekonomi Syariah, dan kemungkinan diperbolehkan atau tidaknya Non Muslim menyelesaikan sengketa ekonomi syariah di Pengadilan agama yang nota bene hanya diperuntukan bagi pemeluk agama Islam saja. Kesimpulannya Penyelesaian sengketa ekonomi syariah boleh dilakukan melalui 2 jalur, yaitu  litigasi (sidang di pengadilan) dan non litigasi (diluar sidang pengadilan atau dengan jalan ADR). Pengadilan Agama memiliki kewenangan mutlak untuk memeriksa, mengadili, dan memutuskan, segala bentuk penyelesaian sengketa di bidang ekonomi syariah. Non Muslim diperbolehkan untuk menggunakan sistem ekonomi berbasis syariah dan bilamana terjadi gesekan atau perkara, maka harus diselesaikan melalui jalur peradilan Agama dengan syarat kumulatifnya, harus mau menundukan diri (Asas Penundukan diri) dengan sukarela terhadap ketentuan dan tata cara penyelesaian Hukum Islam. Sekalipun terkesan saling bertentangan, Asas Personalitas Keislaman tidak bertolak belakang dengan Konsep Kewenangan Absolut Pengadilan Agama, bahkan justru keduanya saling melengkapi menyesuaikan pada pola konteks persoalan.AbstractThe progress of the development of the Islamic economy in Indonesia is increasingly rapid, this is inseparable from the idealist spiritualist principles promoted by this economic system, Talking about Islamic economics means discussing the issues of property, objects and transactions, so that the exchange rate will never be separated from friction or disputes. caused by Default. This paper seeks to thoroughly examine the dualism of the authority of the Religious or State courts in resolving Sharia Economic disputes, and whether or not it is permissible for non-Muslims to resolve sharia economic disputes in religious courts which are nota bene, only for Muslims. In conclusion, sharia economic dispute resolution can be done through 2 channels, namely litigation (trial in court) and non-litigation (outside court proceedings or by means of ADR). The Religious Courts have absolute authority to examine, try and decide all forms of dispute resolution in the field of sharia economics. Non-Muslims are allowed to use a sharia-based economic system and if there is friction or a case, it must be resolved through the religious court with the cumulative conditions, must be willing to submit (the principle of submission) voluntarily to the provisions and procedures for settling Islamic Law. Even though it seems contradictory to each other, the Principle of Islamic Personality does not contradict the Concept of Absolute Authority of the Religious Courts, in fact both of them complement each other according to the pattern of the context of the problem.

Abstract

Some of the women often wear clothes that tend to show. Tattoos can make them have a positive impression wherein it makes them feel sexy, cool or attractive in appearance. The reason for using a tattoo is because they like the image on the other hand because they prefer to have an image in their body which is their characteristic in their socializing. The purpose of this study was to determine the gender construction in the Tatoart community in Gorontalo City. The method used in this research is a qualitative method with data collection through observation, interviews, and documentation. The results of the research are; Gender construction in the Tatoart Community as a style to beautify one's appearance. Tattoos are also used as a measure of association, meaning that the more tattoos the woman is assessed for the extent of her association. So that some women admit that the use of tattoos is considered more slang in front of their friends. Women who have tattoos are those who also have playmates who have tattoos, so they are influenced to get tattooed. And some women who have tattoos also reason to put tattoos because of identity. The meaning for each tattoo is different. This depends on the selection of the tattoo motif and the placement of the tattoo on the body. Women put on permanent tattoos, which are tattoos that can last a lifetime on the skin, and for placement, women who are tattooed in Gorontalo City are generally more daring to put it around the body that is not covered to make it easier to show off. is considered positive when the use of tattoos is used as art or decoration that aims to beautify the body or appearance. The self-concept of tattooed women belonging to the Gorontalo Tattooart Community (GTC) is a concept where they act in accordance with the views of themselves and others towards themselves. The tattooed woman, a member of the Gorontalo Tattooart Community (GTC), considers tattooing as an art that everyone is free to wear, and they think that they can learn a lot after using tattoos because of the many negative views from outsiders that make them even stronger individuals in carrying out the day.
