Abstract

Since the ITE Law was enacted, public complaints about hate speech on social media have increased, one of which is the case of Gus Nur's hate speech against NU. In various cases, the process of resolving cases in the Court tends to be protracted and does not provide satisfaction for the parties, due to the monodisciplinary approach to litigation in law. Therefore, a breakthrough is needed so that such cases can be resolved quickly, effectively, and with a win-win solution. This article seeks to examine restorative justice breakthroughs with fiqh islah and psychology tools to resolve hate speech cases. To make it more operational, this article takes the case of Gus Nur vs. NU for analysis. This article is written based on empirical legal research that is qualitative in nature with the approach of sociology and legal psychology. The primary data source is a video entitled “Gus Nur & Refly Harun Part 2: Who is the Ideal President? NU Cultural Or Structural?” on the Munjiat Channel Youtube account. While the secondary sources consist of primary legal materials and secondary legal materials. The primary legal materials are Law No. 19 of 2016 concerning Information and Electronic Transactions and the Decree of the Director General of Badilum of the Supreme Court No. 1691/DJU/SK/PS.00/12/2020 concerning Guidelines for the Implementation of Restorative Justice in General Courts. Secondary legal materials are books and journal articles on restorative justice, fiqh ishlah, and anger compensation theory in psychology. After the data was collected by indirect observation and documentation, then it was analyzed using content analysis. The results showed that psychologically Gus Nur was in a state of anger when he made hate speech, thus opening the possibility that he regretted his words which tended to attack NU. While in the review of fiqh ishlah, the most relevant ta'zir sanctions are warnings and apologizing to the NU kiai he mentioned in the hate speech video. With the character of NU who really respects his kiai, when the kiai apologize to Gus Nur, then NU residents can easily forgive Gus Nur. Meanwhile, the restorative justice strategy in this case can be done by taking penal mediation and name rehabilitation.

Abstract

Covid-19 merupakan suatu wabah virus mematikan yang telah menjadi bencana dalam skala global. Berbagai upaya negara-negara di dunia telah dilakukan dalam rangka memutus penyebaran virus ini. Indonesia merupakan salah satu negara yang terdampak dari virus ini. Salah satu langkah negara Indonesia dalam menghentikan penyebaran virus corona ialah dengan memberlakukan locldown dan social distancing. Kebijakan tersebut rupanya berdampak pada setiap aspek keidupan masyarakat, salah satunya ialah pendidikan. Pendidikan yang semula menggunakan sistem tatap muka beralih menjadi sistem online di rumah. Sistem pembelajaran tersebut membuat interaksi antara anak dengan orang tua menjadi lebih intens. Maka diperlukan suatu konsep pendidikan akhlak mahmudah yang bermuara pada timbulnya kepedulian sosial seorang anak dalam menghadapi masa pandemi Covid-19. Keluarga maslahah merupakan konsep keluarga yang bukan hanya mendatangkan manfaat pada keluarga saja, namun pada masyarakat secara umum. Artikel ini mengkaji bagaimana peran keluarga maslahah dalam membentuk akhlak mahmudah pada anak dalam menghadapi masa pandemi Covid-19. Hasil penelitian menunjukkan bahwa akhlak mahmudah dalam perspektif keuarga maslahah dikonepsikan sebagai masalih usra (kemaslahatan bagi keluarga) dan kemaslahatan bagi masyarakat. Pembentukan akhlak mahmudah dalam keluarga maslahah dilakukan melalui dua instrumen, yakni melalui metode pendidikan dan pola relasinya.

Abstract

The purpose of this article is to find out the pattern of child care and protection in Muslim countries. The research method used is a documentation study of laws and regulations in Muslim countries such as Indonesia, Egypt and Tunisia. These three countries have the same pattern and orientation in child protection, which elaborates the role of the family and the state. The practical contribution of this article will provide a counter narrative to the phenomenon of violence against children that occurs in Muslim countries. The results show that child care and protection is one of the main priorities in the wheels of government in Muslim countries. The efforts made are very complex, ranging from the establishment of policies to the empowerment of formal and non-formal institutions. Partnerships and co-operation start from the family as the smallest social institution by involving all members to be actively involved in childcare, namely husband and wife. In addition, specially established government institutions also actively support the protection of children to ensure their survival and safety.

Abstract

Children are an investment for the family as well as the next generation who need guidance from both parents. Parents have an important role in childcare. Mothers and fathers have the same obligation to educate and care for their children. But it is unfortunate that currently the awareness of a father to take part in caring for his child is very low, childcare is identical to the work required for a mother alone. Whereas a child also has rights that must be fulfilled during the care period, one of which is to get care from both parents, both mothers and fathers. This type of research is field research and is descriptive in nature. Primary data sources in this research are parents and children involved in parenting in Rajabasa Lama II Village, Labuhan Ratu District, East Lampung Regency. Secondary data sources used are books and papers that are in accordance with the discussion. Data collection techniques using semi-structured interviews and observation. The results of this study indicate that the practice of childcare carried out in Rajabasa Lama II village is more dominant to a mother, while a father who should also be involved in caring for and educating children has not carried out his obligations as stated in KHI and Law Number 1 concerning marriage. The existence of the concept of mubadalah which talks about the relationship between men and women in various matters, is associated with the position of men and women in the family, especially childcare, this is in line with the regulations conveyed in KHI and Law number 1 of 1974 shows that the importance of the role of mothers and fathers in educating and caring for children, both boys and girls by fulfilling their rights and needs. Abstract

Islam wasathiyah menjadi tolak ukur normatif umat Islam dalam menjalankan moderasi beragama di tengah bangsa multikultural. Toleransi merupakan sikap yang mesti diterapkan dalam menghadapi kehidupan bangsa multi religi. Namun kenyataannya, hal tersebut sangat sulit diwujudkan akibat adanya penyebaran paham radikalisme dan ekstremisme secara masif di media sosial. Habib Ja’afar adalah salah satu pendakwah milenial yang sering melakukan dialog lintas agama di media sosial. Dialog tersebut dikemas dalam konten dakwah dan senantiasa mengedepankan prinsip Islam Wasathiyah. Artikel ini mengkaji nilai-nilai syiar Islam dalam konten Youtube “Jeda Nulis” milik Habib Ja’far dengan menggunakan pendekatan studi living hadith. Penelitian ini merupakan hasil kajian lapangan bersifat deskriptif kualitatif. Pengumpulan data menggunakan teknik dokumentasi dan observasi serta dianalisis dengan teknik content analysis. Hasil penelitian menunjukkan bahwa hadis-hadis tentang Islam wasathiyah telah hidup dalam dakwah Habib Ja’far. Melalui media Youtube, Habib Jaa’far menghidupkan nilai-nilai hadist Islam wasathiyah melalui tiga tradisi. Pertama, tradisi lisan yakni melalui konten podcast dan ceramah. Kedua, tradisi tulisan yakni quotes bertajuk moderasi beragama. Ketiga, tradisi praktik yakni melalui dialog lintas agama dengan menghadirkan berbagai sudut pandang dan perspektif. Adapun kontribusi penelitian ini ialah sebagai ikhtiar dakwah Islam wasathiyah di era digital, terutama di platform media sosial Youtube.

Abstract

The rapid development of digital technology has transformed the production, dissemination, and validation of religious knowledge, posing new challenges to traditional religious institutions in Egypt. This study examines how Al-Azhar and Dar al-Iftaʾ al-Miṣriyyah respond to the emergence of online religious actors who acquire authority through social media rather than through classical academic structures. This research is based on fieldwork and employs a descriptive qualitative design, drawing on sociological and religious-anthropological approaches. Primary data were obtained from leaders and scholars affiliated with Al-Azhar and Dar al-Iftaʾ al-Miṣriyyah, complemented by insights from socio-religious observers in Egypt who are members of the Special Branch of Nahdlatul Ulama (PCINU). Secondary data consist of fatwas and relevant scholarly literature. Data were collected through in-depth interviews and observation and analyzed using inductive qualitative techniques. The findings indicate that the digital space has democratized access to Islamic knowledge, enabling social media influencers, preachers, and informal online scholars to serve as alternative sources of fatwas and religious guidance for Egyptian Muslims. In response, Al-Azhar has prioritized strengthening its academically grounded digital presence, while Dar al-Iftaʾ has pursued a more dynamic strategy by expanding online fatwa services, launching social media campaigns, and developing multilingual outreach programs. At the same time, this study reveals that state regulation and political involvement in Egypt’s digital religious sphere significantly shape both the autonomy and public perception of official religious institutions. This article contributes to the broader discourse on Islamic authority by illustrating how classical institutions negotiate legitimacy amid algorithmic visibility, digital pluralism, and state control.
