Abstract

In principle, the improvement of information and technology systems that are currently developing in the global community, turns out to have a very significant impact on the social and legal system in Indonesia as a whole. This study uses a descriptive method with a qualitative approach and data triangulation analysis, the results of the study explain that the existence of the ITE Law as a new legal product that applies in Indonesia is actually enough to bring changes in the positive legal justice system in Indonesia, although in principle the use of this law is still considered taboo and has not had a tremendous impact on various actions related to the use of information and communication in a very broad scope, advances in information and communication technology also have an impact on the development of legal interactions and social interactions. In addition to making a positive contribution to users, this information technology media also creates a negative side. For this reason, through law number 11 of 2008 concerning information and electronic transactions, various policies and legal justice can be realized evenly and can provide the fairest legal protection for all Indonesian people.

Abstract

The imbalance between job seekers and job recipients makes it difficult for some Indonesians to find work. This study aims to determine the handling of the crime of begging in public based on Article 504 Paragraph (1) of the Criminal Code and also to determine the termination of the crime of begging in public in connection with the Tulungagung District Court Decision Number 69/Pid.C/2022/PN. In addition, to determine the suitability of the crime of begging in public based on article 504 of the Criminal Code with article 429 of the new Criminal Code and whether the handling of the crime of begging in public is effective or not. The research method used in this study is descriptive-analytical with a normative juridical approach. The conclusion of this study is that the handling of the crime of begging in public based on Article 504 paragraph 1 of the Criminal Code associated with the Tulungagung District Court Decision Number 69/Pid.C/2022/PN Tlg has been implemented appropriately. This is manifested in Tulungagung District Court Decision Number 69/Pid.C/2022/PN Plg where the judge ruled that the perpetrators of the crime of begging in public are punishable in Article 504, article 1 (one) of the Criminal Code. So that Article 504 paragraph 1 (one) has not been effectively implemented in the community and the punishment is in accordance with applicable laws and regulations. To reduce similar crimes, the government must intervene to deal with the poverty rate in Indonesia so that the level of begging in Indonesia is reduced.

Abstract

Sejalan dengan perkembangan globalisasi dimana batas-batas negara menjadi kabur, perjalanan antar negara sudah lazim dilakukan. Pelanggaran keimigrasian yang sering terjadi adalah penyalahgunaan izin tinggal keimigrasian yang dilakukan oleh Warga Negara Asing. Permasalahan dalam penelitian ini adalah bagaimana bentuk perbuatan untuk memperoleh visa izin tinggal Undang-Undang Nomor 6 Tahun 2011 Tentang Keimigrasian dan bagaimana kendala dalam penegakan hukum atas perbuatan dengan memberikan visa izin tinggal Dihubungkan Dengan Putusan Mahkamah Agung Nomor 3919 K/Pid.Sus/2022. Metode yang digunakan dalam penelitian ini adalah hukum normatif, yaitu metode penelitian hukum kepustakaan yang dilakukan dengan cara meneliti, mengkaji dan menggali berbagai sumber. Hasil dari penelitian ini menyimpulkan bahwa bentuk perbuatan untuk memperoleh visa izin tinggal Undang-Undang Nomor 6 Tahun 2011 Tentang Keimigrasian yaitu berupa paspor adalah past atau izin melewati, yang berasal dari kata pass yaitu melewati dan port yaitu pelabuhan atau pintu masuk. Paspor atau dokumen perjalanan yang sah dan berlaku berfungsi sebagai dokumen perjalanan antar negara.

Abstract

This study discusses the imposition of suspended prison sentences (conditional sentences) in cases of violence against children based on the Bangka Belitung High Court Decision Number 33/Pid.Sus/2020/PT BBL. The study focuses on the judges' considerations underlying the imposition of suspended sentences and their compatibility with the principles of child protection in Law No. 35 of 2014. The results of the study show that the judges used Article 14a of the Criminal Code, which allows for suspended sentences if the penalty is not more than one year and the defendant has no previous convictions. Mitigating considerations included the defendant's confession, remorse, and his profession as a teacher. However, from a child protection perspective, this verdict poses a dilemma because it risks reducing the deterrent effect and has the potential to set a precedent that violence against children can be tolerated. Legal and sociological analysis shows that although suspended sentences are legally valid, their application is not fully in line with the principle of the best interests of the child and the objectives of criminal punishment, which emphasise justice and victim protection. Therefore, a more assertive legal policy is needed so that all forms of violence against children are treated as serious crimes that cannot be compromised.
