Abstract

Social media are growing so rapidly now, besides having a positive impact on society, it also has negative impacts such as hoaxes, pornography, and defamation. Some cases that are closely related to social media are criminal defamation in violation of the Information and Electronic Transactions Law, as experienced by Prita Mulyasari, a case that was initiated by sending a complaint email for Omni Hospital to her friends, so She was charged violating No. 11 of Information and Electronic Transactions Law year 2008, in this study the author uses the Doctrinal or Normative Juridical research methodology by discussing court decision No. 225 PK / PID. SUS / 2011 where in this case Prita Mulyasari was dismissed by the Tangerang District Court, but was found guilty at the Supreme Court level and finally was released free at the Judicial Review level.Keywords: Prita Mulyasari; RS. Abstract

In the era of information explosion through information technology and communication by means of the internet, information and self-identity is very easy, it can be obtained both for the benefit of the owner of personal data and business interests. One of the cases is the case of the personal data of a Lion Air passenger that has been hacked. The personal data of Lion Group's passengers, namely Marindo Air, Lion Air, Thai Air which covers 7.8 million personal data of passengers from countries including Indonesia, have been hacked by groups of irresponsible people. Legal consequences for victims of Lion Group passengers by hacking of personal data written in Article 26 of the ITE Law which regulates the protection of personal data, but in Article 26 of the Law ITE does not contain a criminal threat that can be imposed on someone when using other people's personal data information without the relevant consent. Abstract

This research discusses the power of unilateral execution carried out on state-owned collateral objects. There is a lot of gossip or uncertainty related to the status of state assets, in the sense that there are many legal rules that still intersect or overlap in defining state assets themselves. This overlapping of legal regulations has resulted in various interpretations regarding the extent to which the existence and definition of state assets can be applied, one of which is related to BUMN assets, whether they are included in state assets or not state assets. BUMN is a state-owned business entity which of course operates like a business entity in general, so that it carries out various legal and non-legal actions like business entities such as PT, CV, and so on. One of the BUMNs in the form of Persero took legal action by entering into a credit agreement in the form of cash collateral credit at BCA Bank, where it was discovered that the performance of the BUMN was starting to decline and of course this had an impact on the finances of the BUMN Persero itself, so this research will aim to provide a perspective on what the Bank can do if the state-owned company experiences default based on the applicable regulations. This research is using ‘normative-juridical’ as research type where the approach to the processing of legal materials is carried out by means of a literature review. Normative-juridical approach in this research used to analyse the power of unilateral execution of state-owned (BUMN) deposits in credit agreements with a cash collateral credit scheme at Bank X.

Abstract

Implementasi proses pengambilan putusan oleh hakim dalam sistem peradilan pidana merupakan bagian penting dari pelaksanaan hukum yang harus mencerminkan keadilan, kepastian hukum, dan kemanfaatan. Penelitian ini bertujuan untuk menganalisis implementasi proses yang mendasari pengambilan keputusan oleh hakim dalam perkara pidana berdasarkan sistem peradilan yang berkeadilan. Fokus utama penelitian adalah memahami bagaimana hakim mempertimbangkan prinsip keadilan dalam setiap putusan, termasuk aspek hukum positif, moral, dan nilai-nilai sosial. Serta penelitian ini diharapkan memberikan manfaat teoritis berupa kontribusi terhadap pengembangan ilmu pengetahuan di bidang hukum, khususnya terkait pengambilan keputusan oleh hakim dalam perkara pidana. Secara praktis, penelitian ini diharapkan dapat menjadi pedoman bagi para hakim dalam memberikan pertimbangan hukum yang matang dan berkeadilan, sehingga putusan yang dihasilkan mencerminkan kepastian hukum, keadilan, dan kemanfaatan bagi masyarakat. Dengan memahami faktor-faktor yang memengaruhi putusan hakim, diharapkan sistem peradilan dapat terus berkembang menuju penerapan keadilan yang lebih baik dan holistik. Abstract

In Indonesian law, both individuals and legal entities such as corporations are recognized as legal subjects. Corporations, which are governed by civil law, are now increasingly associated with crime, particularly Corporate Crime. Although initially disputed, it is now accepted that legal entities can be involved in criminal acts and that corporations should be held accountable for their unlawful actions. Corporate Crime encompasses situations where corporations break the law for their benefit, often in disregard of applicable regulations and norms. This development marks a shift in criminal law from targeting individuals to also holding corporations accountable. Therefore, principles such as Vicarious Liability and Strict Liability become the basis for establishing legal liability for corporations. These principles ensure that corporations are responsible for their actions, similar to the liability imposed on individuals. Since the legal construction in Perma RI No. 13 Year 2016 is different from individuals, corporations require specific legal principles to regulate their liability. Concepts such as Vicarious Liability, Strict Liability, and others become important pillars in imposing responsibility on corporations. Recognizing corporations as perpetrators of criminal acts shows the evolution of the legal system to adjust to the complexity of modern business practices and uphold justice in an ever-changing society.
