Abstract

Traffic accident often happens and involved underage child as driver of the vehicle and might lead to fatal consequences, such as the death casualities. In Indonesia, it is stipulated in Act No. 22 Year 2009 concerning Traffic and Road Transportation. The result shows that M’s illegal underage driving caused the death of K. Thus, M and his family are obliged to give compensation to the K’s family as stipulated in of Act No. 22 Year 2009 throughout Juvenile Justice System as the case procedur using Diversion case is stipulated in Act No. 11 Year 2012 regarding Juvenile Justice System

Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan asas-asas umum pemerintahan yang baik (AAUPB) sebagai dasar bagi penyelenggara pemerintahan untuk menjamin terwujudnya kesejahteraan warga negara. Pendekatan masalah dalam penelitian ini menggunakan Statute Approach dan Conceptual Approach. Hasil Penelitian menunjukan bahwa AAUPB dapat diibaratkan sebagai rambu lalu lintas dan pedoman perjalanan dalam rangka memperlancar hubungan pemerintahan yaitu antara pemerintah dan yang diperintah atau warga masyarakat. Apabila penyelenggara negara bertindak bebas tanpa harus terikat secara sepenuhnya kepada undang-undang maka akan membuka peluang bagi penyalahgunaan kewenangan. Di dalam penyelenggaraan negara membutuhkan adanya pembatasan kekuasaan pemerintah (negara) dengan tujuan untuk memberikan perlindungan terhadap hak-hak individu. Penyelenggara negara yang dilaksanakan oleh pemerintah sebagai unsur utama penganyom dan pelayan masyarakat mempunyai peran penting dalam mewujudkan kesejahteraan warga negaranya/masyarakat. Setiap tindakan penyelenggara pemerintah harus selalu dilaksanakan berdasarkan hukum yang berlaku, baik hukum yang tertulis maupun hukum yang tidak tertulis. Namun asas-asas umum pemerintahan tetap memiliki arti dan fungsi yang penting dalam praktik penyelenggaraan pemerintahan. Oleh karena itu, sebagai tolok ukur untuk menilai penyelenggara negara telah sesuai dalam menjalankan tindakannya dalam negara hukum, maka dapat menggunakan asas-asas umum pemerintahan yang baik.This study aims to determine the implementation of Good Governance Principles (AAUPB) as the basis for the government in performing its duties as a form of guarantee for the welfare of the citizens. This is a normative research with Statute and Conceptual Approach. Research results show that AAUPB can be likened to traffic signs and travel guidelines in order to facilitate government relations between the government and the citizens. If the state organizer acts independently without having to be fully bound by the law it will open up the opportunities of authority abuse. That’s why the state administration requires such restriction of government power (state) with the aim to provide protection against the individual’s rights. State organizers in this case is the government as the main element that is caring, and as a public servants have an important role in realizing the welfare of its citizens/community. Every act of government organizer shall always be carried out in accordance with the applicable law, both written law and unwritten law. However, the general principles of governance still have important meanings and functions in the governance practice. Therefore, as a benchmark to assess whether the state organizers are appropriate in carrying out their actions within the rule of law, it can use the general principles of good governance.

Abstract

This research aims to evaluate and compare the legal framework and tax policies of peer-to-peer lending (P2P lending) in various countries, using a normative juridical research approach. This research explores the tax implications and regulatory treatment of financial technology, particularly P2P lending platforms. The normative juridical research method focuses on the study of legal norms, principles, and doctrines. The results of this study show that there are significant similarities and differences in the VAT tax policies on P2P lending services in countries such as the European Union, Australia, Canada, and New Zealand. Each country recognises contributions under the P2P lending model as the provision of credit, which is generally exempt from VAT. However, there are differences in the treatment of the credit itself, eligibility for input tax credits, and the application of the principle of fiscal neutrality. From an Indonesian perspective, it is important to adapt tax regulations to digital innovations in the financial sector, considering the unique characteristics of technology-based financial services such as P2P lending. This policy should be able to address the complexity of services provided by P2P lending platforms and ensure fair and equitable tax treatment

Abstract

This research aims to analyse the conditions and obstacles faced by both groups in the context of human rights violations, as well as provide practical suggestions to improve their protection. The research method used is normative legal methodology, which involves the examination and analysis of legal standards in the literature. A conceptual approach was taken through an exploration of ideologies and teachings that generate legal terminology. Primary and secondary legal materials were collected through inventory, classification, and systematics, with a deduction method for analysis. The results emphasise the need for a comprehensive strategy that considers legal, social, cultural and psychological aspects. The research also suggests the need for cooperation between the government, civil society and relevant institutions to create an environment conducive to the protection of women's and children's rights. The implication of this research is the need for a comprehensive approach in legal policy formulation, which not only focuses on legal aspects but also considers social, cultural, and psychological factors. The research emphasises the importance of increasing public awareness and understanding of human rights, as well as the need to strengthen legal and policy institutions. There is a need to improve the competence of law enforcement and the judiciary, as well as to involve various stakeholders in formulating policies that are more in line with gender issues and the needs of children.

Abstract

The company as a place for providing employment, requires accepting workers the detention of the employee's original diploma as a guarantee so that employees cannot violate the rules in the company. Withholding of diplomas is a form of human rights violations that are often ignored by job providers. The purpose of writing this study is to determine the role of the government in handling cases of withholding original diplomas carried out by employers and protecting the human rights of employees to recover original diplomas withheld. The need for legal protection for employees who experience diploma withholding. The research method used by the author in this thesis is using normative research methods with literature research which is research on laws and regulations (Statute Approach) and literature or reading materials and obtained experts and scholars (Conceptual Approach) related to the material discussed. Based on research conducted in the results of the study, there are still many entrepreneurs holding diplomas. Although employers and workers enter into an employment agreement that does not include a clause withholding diplomas, but the original diplomas are still withheld on the basis of mutual trust between employers and employees. The actions of employers have been included in human rights violations, this results in employees not being able to apply for jobs elsewhere that are better in accordance with their abilities. There is a conclusion that there is a legal vacuum, there is no specific law prohibiting the withholding of diplomas.

Abstract

Health is a human right and is an element of welfare because health is a community need and must be realized. One of the health supports is medicine, the function of medicine is prevention, healing, recovery, health improvement, and contraception, for humans. Based on its function and the dangerous consequences of drug consumption, its manufacture and distribution must be under the supervision of the Food and Drug Monitoring Agency, by Presidential Regulation Number 80 of 2017 concerning the Food and Drug Monitoring Agency.Under his supe rvision, illegal drugs remain widespread and consumed in inappropriate doses by the public, including hard drugs and narcotics. As a result of dependence, many drug traffickers are caught and repeat the same actions (recidivists). Drug recidivism is regulated in Law Number 5 of 2009 concerning Narcotics Article 144 paragraph (1). However, the distribution of narcotics continues to occur. From the results of this research, the author found that BPOM's efforts as a supervisory body need to be increased, not only collaborating between agencies but also inviting the community, this is also to realize Chapter XIII concerning Community Participation, Law Number 35 of 2009 concerning Narcotics. Also, apply the most severe sanctions to create a deterrent effect so that there is no repetition of criminal acts of narcotics trafficking.

Abstract

Vocational training in Indonesia is organised based on cooperation or mutual agreement between educational institutions and companies. This research highlights the unavailability of legal regulations that specifically protect vocational trainees. The lack of specific regulations causes the implementation of existing labour regulations to be limited to companies where vocational training is held. Through this normative jurisprudence research, it can be seen that the vacuum legis condition, namely the existence of a vacuum of specific legal rules, has begun to have a solution. The Indonesian government has actually started to improve the quality of human resources through vocational education and training by making three new regulations related to vocational training. There are three new regulations that have been issued, namely: Presidential Regulation No. 68 of 2033 concerning Revitalisation of Vocational Education and Vocational Training issued on 27 April 2022. Coordinating Minister for Human Development and Culture Regulation No. 5 of 2022 governing the Organisation and Working Procedures of the National Coordination Team for Revitalising Vocational Education and Vocational Training, promulgated on 14 September 2022. Coordinating Minister for Human Development and Culture Regulation No. 6 of 2022 on the National Strategy for Vocational Education and Vocational Training, also promulgated on 14 September 2022. It is expected that these regulations can be implemented to protect the individual rights of prospective workers in vocational training in Indonesia.

Abstract

Foreign nationals who enter Indonesia for work must be filtered and their use limited, especially in placement in structural positions in companies, bearing in mind the mandate of the Manpower Law which must prioritize Indonesian citizens in all available positions or positions. This research uses a normative juridical research type, research is carried out through literature study using a statutory approach and a conceptual approach. This research aims to find out the truth regarding the placement of foreign workers in personnel positions in a company along with the legal consequences for foreign workers themselves and companies who abuse their positions based on statutory regulations. The results of the analysis in this research show that the placement of foreign workers in personnel positions is not justified because it violates the provisions of Law Number 13 of 2003 concerning Employment, Government Regulation Number 34 concerning the Use of Foreign Workers, and the Job Creation Law. The legal consequences of violations for companies are in the form of criminal sanctions or administrative sanctions, while for foreign workers there are no statutory regulations that specifically regulate the legal consequences.

Abstract

Posisi perbankan dalam lalu lintas keuangan memberikan arti penting bagi pembangunan ekonomi suatu negara, begitu pentingnya sehingga kelancaran aktifitas lalu lintas keuangan menentukan ketahanan ekonomi sebuah negara yang berujung pada ketahanan nasional. Melihat penting sektor lalu lintas keuangan ini maka negara yang diwakili oleh pemerintah mengambil langkah membentuk sebuah lembaga tinggi negara yang melakukan pengawasan, pembinaan dan pembuat regulasi baik dibidang moneter, lalu lintas pembayaran, dan perbankan. Lembaga ini adalah Bank Indonesia. Bank Indonesia memiliki fungsi menyeluruh dalam menjaga kelancaran dan stabilitas ekonomi Indonesia secara menyeluruh dan terpadu. Namun sejak tahun 2011, Bank Indonesia diambil sebagian kewenangannya dalam melakukan pembinaan dan pengawasan perbankan dengan beridirinya Otoritas Jasa Keuangan. Dengan berkurangnya kewenangan yang dimiliki oleh Bank Indonesia oleh Otoritas Jasa Keuangan, maka diperlukan cara bagi Bank Indonesia agar tetap dapat menjalankan fungsinya sebagai penjaga stabilitas ekonomi negara, terutama dalam menghadapi permasalahan – permasalahan yang timbul didalam ruang lingkup kewenanganhnya, maupun diluar lingkup kewenangannya. Metode penelitian yang digunakan adalah yuridis normatif yakni upaya mencari penyelesaian masalah dengan meneliti dan mengkaji norma hukum positif dengan melakukan studi perpustakaan. Hasil penelitian menunjukkan bahwa Bank Indonesia dan Otoritas Jasa Keuangan tidak saling tumpang tindih dalam menjalankan kewajibannya, melainkan secara sinergi dan terintegrasi antar lembaga dengan melakukan koordinasi dalam segala lini agar dapat menjangkau bidang – bidang maupun pihak – pihak yang terlibat dalam lalu lintas keuangan dan ekonomi, baik dengan sisi regulasi maupun pengawasan dan pembinaannya.
