Abstract

ABSTRAK Sanksi bagi pelaku kekerasan seksual terhadap anak mengalami perkembangan, yaitu munculnya pengebirian kimia. Namun keberadaannya mengalami pro dan kontra.. Penelitian ini mengkaji masalah regulasi kebiri kimia, melihatnya dalam pandangan Hak Asasi Manusia dan Hukum Pidana Islam. Menggunakan metode penelitian hukum normatif yang didasarkan pada data sekunder. Hasil yang diperoleh, ketentuannya terkandung dalam Peraturan Pemerintah Pengganti Undang-undang No. 1 tahun 2016 Pasal 81 (7), (8), (9) dan 81 A. Perspektif Hak Asasi Manusia, pengebirian kimia dipandang sebagai hukuman tidak manusiawi yang berdasarkan dari regulasi internasional seperti  Deklarasi Universal Hak Asasi Manusia  dan lain-lain. Perspektif Hukum Pidana Islam, pemberian hukuman kebiri pada terpidana pedofilia bisa memberikan efek jera (zawajir) terhadap pelaku. Dalam hal ini penetapan sanksi hukuman kebiri dapat dikategorikan sebagai hukuman ta’zir (hukuman tambahan) yaitu hakim dapat berijtihad menemukan dan menetapkan suatu hukum yang tidak ada hukumannya baik dalam al quran maupun hadis dengan pertimbangan zawajir (efek jera). Kata Kunci: Kebiri Kimia, Kekerasan Seksual, Anak, Hak Asasi Manusia, Hukum Pidana Islam ABSTRACT Sanctions for perpetrators of sexual violence against children have developed, namely the emergence of chemical castration. However, its existence has pros and cons. This study examines the issue of chemical castration regulation, looking at it from the perspective of Human Rights and Islamic Criminal Law. Using normative legal research methods based on secondary data. The results obtained, the provisions are contained in Government Regulation in Lieu of Law no. 1 of 2016 Articles 81 (7), (8), (9) and 81 A. Human Rights Perspective, chemical castration is seen as an inhuman punishment based on international regulations such as the Universal Declaration of Human Rights and others. From the perspective of Islamic criminal law, the punishment of castration on pedophile convicts can provide a deterrent effect (zawajir) against the perpetrators. In this case, the stipulation of castration punishment can be categorized as ta'zir punishment (additional punishment), namely the judge can ijtihad to find and determine a law that has no punishment in both the Qur'an and Hadith with consideration of zawajir (deterrent effect).Keywords: chemical castration, sexual violence, child, human rights, islamic criminal law Keywords: Chemical Castration, Sexual Violence, Child, Human Rights, Islamic Criminal Law

Abstract

This study explores the integration of Islamic law (sharia) and local customs through the analysis of the Pa'bitte Passapu dance, a cultural expression of the Ammatoa community in Tanah Toa Village, Kajang District. Utilizing field research and Roland Barthes' cultural semiotic theory, this research reveals the denotative and connotative symbols within the dance movements. Data collection methods included observation, interviews, and documentation. The subjects of this study were the dancers of the Pa'bitte Pasapu dance, their trainers, and local government officials. The findings indicate that the Pa'bitte Passapu Dance embodies elements of harmony between sharia and da'wah, guiding society towards harmonious living. Denotatively, the dance features physical movements and visual symbols, such as spinning movements, fighting simulations, and the use of symbolic elements like chickens, which are part of the aesthetic performance. Connotatively, the dance conveys complex messages encompassing moral, social and ideological values. The study argues that the Pa'bitte Passapu Dance serves as a medium that connects sharia and art, providing entertainment while also reinforcing cultural identity and religious values within the Ammatoa community. This research highlights the importance of preserving local cultural expressions as a relevant and adaptive platform for preaching, while at the same time addressing local communities’ needs
