Abstract

Man in fulfilling his various interests perform various ways, one of them by making a covenant. It is therefore necessary to understand important matters relating to a treaty, such as: What is the agreement, the terms of the agreement, the principles of the agreement, the object of the agreement, the terms of the agreement, the form of the agreement, the parties involved, the right and the obligations of the parties, the structure and the anatomy of the agreement, the settlement of disputes and the termination of the agreement. Article 1313 of the Civil Code states: The Covenant is an act by which one or more persons commit themselves to one or more persons. In general, the agreement is: The parties' agreement on something that gives birth to a legal relationship, creates rights and obligations, if not executed as the promised will impose sanctions. In order for what is promised to run well then required a regulating rule, called the law of agreement. The purpose of the treaty is to protect the parties in the event of future problems, order, is used as the basis for its settlement or legal certainty so as to create justice for the parties. In the making of the treaty, several important matters must be considered, among others: the terms of the validity of the agreement, the principles of the contractual law, the consequences of the law of agreement and the termination of the agreement. One of the most important principles in the agreement is the principle of equilibrium. However, in practice it is often not in accordance with the objectives of the agreement, among others: The existence of protection for the parties, the creation of justice, order, and legal certainty. The discussion in this research is about: What things should be considered or fulfilled to realize the achievement of the purpose of the agreement and How the role of the principle of balance in realizing the purpose of the agreement. The method used is normative juridical. In the event of a dispute concerning the treaty, it should be settled not only based on what is written in the agreement but taking into account the principles contained in the treaty law, especially the principle of equilibrium. Abstract

Paten adalah hak eksklusif yang diberikan oleh negara kepada inventor atas hasil invensinya di bidang teknologi, yang untuk selama waktu tertentu melaksanakan sendiri invensinya tersebut atau memberikan persetujuannya kepada pihak lain untuk melaksanakannya. Hampir semua bidang kehidupan telah menggunakan teknologi yang maju, baik teknologi yang berasal dari dalam negeri maupun teknologi yang berasal dari luar negeri. Untuk itu diperlukan adanya peraturan di bidang paten yang didalamnya mengatur tentang: Istilah dan definisi yang berhubungan dengan paten, syarat-syarat, prosedur, jangka waktu, bentuk-bentuk perlindungan,  hak dan kewajiban pemegang paten, lisensi, berakhirnya lisensi, ketentuan tentang royalty, dan lain-lain. Hal ini dijadikan sebagai acuan dalam menjalankan kegiatan yang berhubungan dengan paten di Indonesia sehingga dapat memberi perlindungan hukum terhadap inventor. Perlindungan dibutuhkan sebagai: Wujud penghargaan, pengakuan, jaminan berdasarkan rasa keadilan dan kelayakan atas segala kemampuan serta usahanya, sehingga termotivasi untuk terus berkarya demi masa depan  bangsa dan negara yang lebih baik. Meskipun Indonesia sudah memiliki peraturan perundang-undangan di bidang paten dan telah meratifikasi perjanjian-perjanjian internasional menyangkut paten, namun masih tetap terjadi permasalahan-permasalahan. Terjadinya permasalahan tersebut dipengaruhi berbagai faktor, antara lain: yang berkaitan dengan struktur hukum, substansi hokum dan budaya hukum.Kata Kunci  :  Peraturan, Perlindungan Hukum, Paten

Abstract

Salah satu latar belakang lahirnya Undang-undang Nomor  13 Tahun 2003 Tentang Ketenagakerjaan adalah karena beberapa peraturan perundang-undangan yang berlaku selama ini menempatkan pekerja pada posisi yang kurang menguntungkan dalam pelayanan penempatan tenaga kerja dan sistem hubungan industrial yang menonjolkan perbedaan kedudukan dan kepentingan sehingga dipandang sudah tidak sesuai lagi dengan kebutuhan masa kini dan tuntutan masa yang akan datang. Lahirnya Undang-undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan ini diharapkan dapat: Menegakkan masalah  perlindungan dan jaminan terhadap tenaga kerja; Melaksanakan berbagai instrumen internasional  tentang hak-hak tenaga kerja yang telah diratifikasi; Sebagai anggota Perserikatan Bangsa-Bangsa (PBB) menjunjung tinggi dan melaksanakan Deklarasi Universal tentang Hak Azasi Manusia (HAM). Perlindungan hukum telah diatur pada: Pembukaan UUD 1945 yaitu berdasarkan  Pancasila; UUD 1945 yaitu: Pasal 27 ayat 2, Pasal 28 D ayat 1, ayat 2 , Pasal 33; Undang-undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan, dan peraturan lainnya. Secara yuridis kedudukan pekerja adalah bebas dan seimbang, namun pada praktek sering dalam keadaan tidak seimbang sehingga menimbulkan masalah. Untuk mengatasinya dibutuhkan suatu solusi agar dapat diterima semua pihak dengan baik, dirasakan ada manfaatnya, mempunyai kepastian hukum dan memberi perlindungan bagi  semua pihak. Pembahasan dalam penelitian ini adalah: 1. Bagaimana pelaksanaan perlindungan hukum terhadap hak-hak pekerja dalam hubungan ketenagakerjaan di Indonesia. 2. Hambatan dan upaya yang harus  dilakukan dalam memberikan perlindungan hukum terhadap hak-hak pekerja dalam hubungan ketenagakerjaan di Indonesia.  Metode yang digunakan adalah yuridis normatif. Perlindungan hukum diberikan sesuai dengan Pancasila dan UUD 1945.Kata kunci : Perlindungan Hukum, Hak-Hak Pekerja.

Abstract

Health development is very important according to the Preamble to the 1945 Constitution of the Republic of Indonesia. Health as a human right is manifested in various efforts, including through the implementation of medical practice where the role of doctors is very important. In its implementation sometimes causes problems that lead to medical disputes. The formulation of the problem in this research are: How is the arrangement of medical dispute resolution between patient/patient's family and doctor based on applicable regulations and How is the process of fair medical dispute resolution between patient/patient's family and doctor based on law number 29 of 2004 concerning medical practice. The method used in this research is normative juridical. Used to find out and get a comprehensive picture by looking at the facts related to the problem so that it can prove the problem in order to get a scientific answer. The results of this study indicate that: The existing medical dispute resolution arrangements are still scattered in various laws and regulations, resulting in overlapping medical dispute resolution arrangements which in the end have the potential to cause ambiguity and uncertainty in their resolution. And in terms of a just settlement of medical disputes between patients/patients' families and doctors based on Law Number 29 of 2004 concerning medical practice, it begins with the medical professional institution, namely the Medical Ethics Honorary Council (MKEK) or the Indonesian Medical Discipline Honorary Council (MKDKI). . If it is not completed, the settlement can be continued with non-professional institutions in the form of: Civil (non-litigation and litigation); criminally or administratively/state administration. Settlement of non-litigation or litigation can be chosen in accordance with the availability of evidence and the case position or legal facts.
