Abstract

Sebagai negara kepulauan, batas perairan kepulauan Indonesia terdiri dari batas laut teritorial, batas Zona Ekonomi Eksklusif (ZEE) dan Batas Landas Kontinen. Posisi Negara Indonesia berbatasan langsung dengan banyak negara lain, berbatasan darat dengan Malaysia, Papua Nugini (PNG), dan Timor Leste, sedangkan berbatasan laut dengan 10 negara, yaitu India, Malaysia, Singapura, Thailand, Vietnam, Filipina, Republik Palau, Australia, Timor Leste dan Papua Nugini (PNG). Perairan Indonesia yang berbatasan langsung dengan negara tetangga tersebut sering kali menjadi akses terjadinya kejahatan transnasional, antara lain illegal fishing. Walaupun telah ada beberapa peraturan perundang-undangan yang mengatur kegiatan illegal fishing, namun masih saja sering terjadi kegiatan illegal fishing yang dilakukan oleh negara-negara tetangga tersebut. Luasnya wilayah perarian Indonesia sehingga pengawasan pemerintah di kawasan perbatasan perairan belum optimal, minimnya fasilitas teknologi pengamanan perbatasan yang baik dan masih minimnya pelibatan peran serta nelayan-nelayan tradisional, menjadi faktor-faktor penyebab terjadinya illegal fishing. Kegiatan ilegal fishing tidak semata-mata menjadi persoalan Indonesia, tetapi juga menjadi persoalan lintas negara karena para pelaku dan kegiatannya lintas negara. Oleh karena itu penanganan persoalan ini harus dilakukan secara lintas negara, baik dengan menetapkan langkah-langkah strategis maupun melalui kerja sama bilateral.

Abstract

Indonesia is an agrarian country. Indonesia's forests are very large, but now there is a lot of forest destruction such as forest fires. The formulation of the problem is whether the amount of compensation for forest fires due to land clearing based on decision number 171/Pdt/G/2020/PN.Jkt.Pst is in accordance with the Forestry Law? and how is the analysis of forest fire law enforcement in decision number 171/Pdt/G/2020/PN Jkt.Pst?. It is normative legal research, descriptive analytical. Using secondary data. Analyzed qualitatively by drawing conclusions deductively. The result and conclusion is that the amount of compensation for forest fires due to land clearing based on Decision Number 171/Pdt/G/2020/PN.Jkt.Pst is in accordance with the Forestry Law. Article 7 paragraph (1) letter b of PERMENLHK Number 7 of 2014 which contains this provision to carry out and determine the calculation of the amount of compensation that must be paid by the Defendant. After the calculation, it was decided that the amount of compensation to be paid by the Defendant was Rp.160,530,895,240,-. The enforcement of forest fire laws in this Decision is still inappropriate because of the sanctions regarding forest fires, namely the provisions of Article 78 paragraph (3) jo Article 80 the Forestry Law.

Abstract

The environment has an important role in human life. However, there are often environmental problems, especially regarding water pollution. The formulation of the problem studied is how to regulate water pollution in the river and the responsibility of the Sarimukti Landfill for water pollution in the Cipanawuan River. The type of research used is normative legal research, and the nature of descriptive research, then the conclusion is drawn deductively. The result research and conclusion is the water pollution caused by the Sarimukti final processing site has violated the river water quality standards set out in Article 113 paragraph (3) listed in Appendix VI of Government Regulation Number 22 of 2021. As well as violating the leachate quality standards stipulated in Article 3 paragraph (2) in Appendix I of the Regulation of the Minister of Environment and Forestry Number 59 of 2016 and UPTD PSTR as the technical implementing unit has established Standard Operating Procedures, the Sarimukti Landfill has carried out its responsibilities only technically, by article 87 of Law Number 32 of 2009 concerning Environmental Protection and Management, responsibility must be in the form of providing compensation. However, based on standard operating procedures that have been established, there is no regulation regarding compensation mechanism for water pollution.

Abstract

The conversion of forest areas to non-forestry land for horticultural tourism activities is one of the important issues in environmental policy and regional development. The formulation of the problem is how the legality of the conversion of forest areas for the development of horticultural tourism according to Law No. 41 of 1999 concerning Forestry? The research method used is normative juridical, descriptive in nature, using secondary data, and deductive inference. The results of the discussion and conclusions show that the legality of forest area conversion for the development of horticultural tourism is regulated in Article 19 of Law No. 41 of 1999 concerning Forestry. Changes in the designation of forest areas are possible through the mechanism of release or change of function, provided that they fulfil the administrative and ecological requirements determined by the government. However, in practice, this process often leads to conflicts between the interests of environmental preservation and regional economic development. Therefore, its legality is highly dependent on compliance with legal procedures as well as guarantees that it does not damage the ecological functions of the forest.

Abstract

The Jakarta Provincial Government has granted authority to the Regional Government to manage waste comprehensively, including in the Pasar Minggu District, South Jakarta. This article how law enforcement regarding waste management in Pasar Minggu District is implemented in accordance with Regional Regulation Number 3 of 2013 concerning Waste Management. The research problem focuses on identifying the obstacles in enforcing sanctions for violations of waste disposal regulations in Pasar Minggu District, South Jakarta. This study is normative juridical in nature and descriptive in character, with conclusions drawn using deductive reasoning. The findings indicate that the enforcement of sanctions often faces obstacles due to a lack of human resources, inadequate supporting facilities, and community resistance to waste management. Therefore, the Regional Government needs to optimize waste management by strengthening education, enhancing supervisory capacity, providing adequate facilities, and adopting a holistic approach to increase community participation and the effectiveness of law enforcement, in order to achieve sustainable waste management and a cleaner environment in Pasar Minggu District.

Abstract

Indonesia is a country where the majority of the population is workers in the agricultural and forestry sectors. But there are still many violations of his forestry. The problem How is the permit for the transportation of timber forest products after the enactment of Article 12 letter e and Article 83 UUCK? And How is the application of the transportation of timber forest products without being accompanied by a SKSHHK in Decision Number 9/Pid.Sus/2020/Pn.Pli?. Research methods are normative laws, descriptive properties, secondary data sources and analyzed qualitatively by drawing deductive conclusions. In conclusion, in terms of permits for the Transportation of Timber Forest Products that must be fulfilled after the enactment of the UUCK, namely the permits regulated in its implementing rules, namely Article 259 number (1) that should be fulfilled in the transportation of timber forest products by the accused ATMAWI aka AWI should be in accordance with Minister of Environment and Forestry Number 8 of 2021. It should also be noted that the SKSHHK itself can only be issued after the ATMAWI defendant is supposed to fulfill PNBP's obligation to serve forest product transportation documents.

Abstract

Penelitian ini membahas tentang integrasi Filsafat Nusantara dalam sistem hukum Indonesia, dengan fokus pada peran hukum adat sebagai manifestasi utama nilai-nilai lokal yang telah mengakar dalam kehidupan masyarakat. Pengakuan hukum adat sebagai sumber hukum yang sah tercermin dalam berbagai peraturan perundang-undangan, antara lain Pasal 18B ayat (2) UUD 1945 dan Undang-Undang Nomor 5 Tahun 1960 tentang Pokok-Pokok Agraria. Para ahli seperti Van Vollenhoven dan Satjipto Rahardjo menekankan pentingnya hukum adat sebagai refleksi nilai-nilai budaya dan norma-norma sosial yang dinamis. Selain itu, pendekatan terapeutik dan pluralisme hukum yang mencerminkan keselarasan dan keseimbangan dalam Filsafat Nusantara semakin diterima dalam menyelesaikan konflik hukum di Indonesia. Namun demikian, muncul tantangan yang signifikan dalam menyelaraskan nilai-nilai adat dengan hukum modern dan asas-asas hukum yang lebih universal dan legalistik. Penelitian ini menekankan pentingnya dialog yang berkelanjutan antara para pemangku kepentingan untuk memastikan bahwa integrasi Filsafat Indonesia bersifat simbolik dan substantif. Dengan demikian, Filsafat Nusantara dapat terus berperan sebagai pilar utama dalam pengembangan hukum yang inklusif dan berkeadilan sosial di Indonesia dengan tetap menjaga jati diri dan kearifan lokal.
