Abstract

Terjadi perubahan atas eksistensi perempuan sebagai suatu subjek yang independen. Hal ini terlihat dari adanya perubahan relasi antara perempuan dengan laki-laki pada saat ini. Meskipun demikian, Undang-undang Perkawinan (UUP) ternyata belum memberikan perlindungan kepada perempuan atas kesetaraan gender. UUP masih membedakan hak serta kewajiban perempuan dengan laki-laki terkait persyaratan poligami UUP focus pada ketidakmampuan fisik perempuan sebagai alasan poligami. Ketentuan-ketentuan tersebut menempatkan perempuan pada posisi inferior. Feminisme menghendaki adanya pengakuan terhadap perempuan sebagai subjek yang mandiri dengan persamaan status, hak dan kewajiban dengan laki-laki. Oleh sebab itu perlu adanya perubahan pola pikir Negara dan pemberian pengakuan kepada perempuan sebagai suatu subjek yang independen, dari situ diharapkan negara dapat memberikan kesetaraan gender kepada perempuan.

Abstract

This research aims to analyze the legal status of marriage promises within the perspective of unlawful acts (PMH) according to the Indonesian civil law system, and to examine judicial considerations in determining legal liability and compensation in cases of marriage promise breaches in Decision Number 18/Pdt.G/2023/PN Mgg. This study employs a normative approach with a case study method. The findings demonstrate that breaking a marriage promise can be qualified as an unlawful act if it meets the elements of Article 1365 of the Civil Code (KUH Perdata), namely the presence of an unlawful act, fault, damages, and causality. In Decision Number 18/Pdt.G/2023/PN Mgg, the judge ruled that the breach of marriage promise resulting in material and immaterial losses can be sued as an unlawful act. The judge's considerations include analysis of evidence, causal relationships, and the impact of damages suffered by the plaintiff. This decision emphasizes the importance of legal protection for individuals harmed by marriage promise breaches.

Abstract

This research aims to analyze the evidentiary strength of descente in disputes over the division of joint property based on a study of decision number 4757/Pdt.G/2022/PA.Tgrs, as well as examining the judge's considerations in granting a lawsuit based on a study of decision number 4757/Pdt.G/2022/PA.Tgrs. This research uses a normative approach with a case study method. The results of the research show that the strength of descente is independent (vrij bewijsleer), but not binding (dwingend bewijsleer). This means that the results of the descente do not absolutely determine the judge's decision, the judge's decision is still based on a free assessment of all evidence relevant to the case. The judge's considerations in this case stipulate that joint property must be divided fairly, namely that each party is entitled to half of the joint property, as regulated in Article 37 of Law Number 1 of 1974 and Article 97 of the Compilation of Islamic Law. The judge's considerations also show that the principles of justice and legal certainty are a priority, with reference to legal provisions governing the fair distribution of joint property. The decision taken accommodates the interests of both parties, and confirms that the absence of one party in the trial does not prevent decision-making based on the available evidence.
