Abstract

AbstractLand Deed Making Officials as public officials have a role in land registration and also carry out the function of creating perfect evidence. In making an authentic deed, it is necessary to practice the principles of prudence and accuracy to prevent legal defects, both formally and materially. Land may be subject to administrative sanctions in the form of a written warning or dismissal and civil sanctions in the form of compensation to the party who feels aggrieved. Keywords: Land Deed Official, Certificate, Counterfeiting, Deed, Sale and Purchase, Sanctions AbstrakPejabat Pembuat Akta Tanah sebagai pejabat umum memiliki peran dalam pendaftaran tanah dan juga menjalankan fungsi untuk menciptakan alat pembuktian yang sempurna. Dalam pembuatan suatu akta otentik perlu dipraktekkan prinsip-prinsip kehati-hatian dan kecermatan untuk mencegah terjadiya cacat hukum baik secara formil maupun materil.. Dalam praktek, apabila ditemukan bahwa terdapat  pelanggaran prosedur pembuatan akta otentik yang dilakukan oleh Pejabat Pembuat Akta Tanah maka Pejabat Pembuat Akta Tanah dapat dijatuhkan sanksi baik secara administratif berupa teguran tertulis maupun sanksi pemberhentian dan sanksi keperdataan berupa ganti rugi kepada Pihak yang merasa dirugikan. Kata Kunci: Pejabat Pembuat Akta Tanah, Sertifikat, Pemalsuan, Akta, Jual Beli, Sanksi.

Abstract

Abstract Land registration is a series of activities conducted by the government on an ongoing basis and in an orderly manner which comprise the collection, processing, recording, presentation, and maintenance of physical and juridical data in the form of maps and registers concerning lands and apartments, including the issuance of right-evidencing documents for lands on which rights have been established as well as certain rights which encumbrances it. The implementation of land registration is become essential since such land registration aims to provide legal certainties and legal protection for the holder of rights over the land as well as to keep in operations orderly land administrative procedures. This writing uses a normative juridical method, namely research conducted to examine written legal norms which apply to analyze the issuance of Certificate of Rights to Build No. 6226/Kamal Muara over Rifhts to Management No. 45/Kamal Muara by North Jakarta Land Office with secondary data types and data collection tools for document studies or library materials. The result of this writing states whereby the issuing of certificate, which is part of land registration, in the form of Rights to Build No. 6226/Kamal Muara over Rights to Management No. 45/Kamal Muara with size of the land is 3.200.000 m2 registered as PT. K which located in Kelurahan Kamal Muara, Kecamatan Penjaringan, North Jakarta is meet with land procedures as well as applicable laws so that could make legal certainty on it and protection of public rights who will make use of such of a land. Keywords: Land, Certificate, Administration, Issuing, Registration, Right. Abstrak Pendaftaran tanah merupakan rangkaian kegiatan yang dilakukan pemerintah secara terus menerus, berkesinambungan dan teratur, yang meliputi pengumpulan, pengolahan, pembukuan, dan penyajian serta pemeliharaan data fisik dan data yuridis, dalam bentuk peta dan daftar, mengenai bidang-bidang tanah dan satuan-satuan rumah susun, termasuk pemberian surat tanda bukti haknya bagi bidang-bidang tanah yang sudah ada haknya serta hak-hak tertentu yang membebaninya. Pelaksanaan pendaftaran tanah menjadi penting karena pendaftaran tanah bertujuan memberikan kepastian hukum dan perlindungan hukum kepada pemegang hak atas suatu bidang tanah serta untuk terselenggaranya tertib administrasi pertanahan. Penelitian ini menggunakan metode yuridis normatif, yakni penelitian yang dilakukan untuk menelaah norma hukum tertulis yang berlaku untuk menganalisis penerbitan Sertipikat Hak Guna Bangunan 6226/Kamal Muara oleh Kantor Pertanahan Jakarta Utara dengan jenis data sekunder dan alat pengumpulan data studi dokumen atau bahan Pustaka. Hasil penelitian menyatakan bahwa penerbitan sertipikat, yang merupakan bagian dari pendaftaran tanah, berupa Hak Guna Bangunan No. 6226/Kamal Muara diatas Hak Pengelolaan No. 45/Kamal Muara dengan luas bidang tanah 3.200.000 m2 atas nama PT. K yang terletak di Kelurahan Kapuk Muara, Kecamatan Penjaringan, Kota Jakarta Utara telah memenuhi administrasi pertanahan serta ketentuan peraturan perundang-undangan yang berlaku sehingga dapat tercipta kepastian hukum dan perlindungan hak-hak (rights) masyarakat yang akan memanfaatkan area tanah tersebut.  Keywords: Administration, Certificate, Land, Reclamation, Registration, Rights.

Abstract

This paper written to analyze the consequence of the new provision in Minister of Agrarian and spatial planning/Head of National Land Agency regulation number 16 in 2021 which changes chapter 111. The new provision stipulate that the deed of inheritance rights should be made by a notary located at the inheritor domicile when they died. Based on the new provision, if the inheritance are land rights or ownership rights to the apartment units, the Notary who has the authority to made the deed of inheritance rights is the one who domiciled in the Inheritor Domicile not the one who domiciled where the lands are located. This research is conducted to find out if there are any legal problem because of the new provisions.

Abstract

Candimulyo dipilih sebagai lokasi program pengabdian masyarakat mengingat wilayah tersebut merupakan salah satu wilayah penghasil durian terbesar di Indonesia. Varian durian dan semangat berdagang serta membudidayakan durian di wilayah tersebut menjadi peluang besar apabila dikelola secara baik. Salah satu cara memberikan nilai tambah untuk pemasaran durian tersebut adalah dengan memberikan merek atas produk yang dijual. Namun mayoritas petani belum familiar dengan perlindungan hak kekayaan intelektual padahal sejatinya kekayaan intelektual dapat memberikan nilai tambah atas produk yang dijual oleh para petani tersebut. Program penyuluhan ini merupakan salah satu upaya untuk menanamkan dan alih pengetahuan terkait kekayaan intelektual guna menjadikan masyarakat di wilayah Candimulyo melek hukum kekayaan intelektual sehingga dapat menggerakkan dan menciptakan iklim ekonomi modern dan maju baik bagi profesi petani. Metode yang digunakan adalah penyelenggaraan penyuluhan terkait hak kekayaan intelektual dan memfasilitasi pendaftaran merek. Atas program ini, masyarakat sangat antusias memahami penyuluhan dan sebagai bentuk fasilitas yang diberikan tim pelaksana pengabdian masyarakat adalah pendaftaran salah satu merek terpilih yakni Sentra Kebun Durian Candimulyo. Penyuluhan dan fasilitasi merek dagang ini diharapkan menjadi langkah awal optimalisasi hak kekayaan intelektual bagi petani.Kata kunci: Hak Kekayaan Intelektual, Pengabdian Masyarakat, Merek, Candimulyo

Abstract

The land registration system in Indonesia, which is still dominated by paper-based databases, is considered no longer capable of optimally guaranteeing legal certainty of land rights. Outdated data, weak system integration, and limited access to information open the door to abuse of authority and manipulation of land data. These conditions are exploited by land mafia to carry out illegal practices, such as document forgery and the issuance of duplicate certificates, which ultimately harm landowners and undermine public trust in the national land system. This study aims to analyze the effectiveness of land digitization and electronic land registration in minimizing the practices of land mafia in Indonesia. The research method used is normative legal research with a regulatory and conceptual approach, supplemented by an analysis of digital land policy. The results show that electronic land registration has the potential to increase transparency, data accuracy, and land administration accountability, thereby closing the loopholes that have been exploited by land mafia. However, the effectiveness of this system still faces challenges in terms of infrastructure readiness, human resource quality, and regulatory harmonization. Therefore, strengthening the electronic land registration system needs to be accompanied by institutional reform and consistent law enforcement in order to achieve legal certainty and protection of land rights.Keywords: Electronic Land Registration; Land Digitalization; Land Mafia; Legal Certainty; Land Administration

Abstract

This paper studies the complexity surrounding the Hotel Sultan dispute by examining the legal status of the building rights. The dispute holds tension between PT Indobuildco as the HGBs (building rights) holder and the State Secretariat as the HPL (management rights) holder. Using normative-juridical analysis, this paper analyzed the application of the horizontal separation principle under Indonesia’s Basic Agrarian Law (UUPA) and Government Regulations No. 40 of 1996. This paper finds that without the HPL holder consent, the Sultan Hotel’s HGBs extension was legally invalid despite PT Indobuildco longstanding hotel development as they continuously failed to renew their HGBs after both expired in 2023. The legal situation challenges investor confidence and tenure security in the face of regulatory clarity and administrative discretion. In addition, this paper argues that this case illustrates the absence of indemnity clauses and conflict resolution further showcase Indonesia’s legal and institutional vulnerabilities in managing public assets. This case highlights the necessity of a stronger legal safeguard and standardized procedures in land governance.

Abstract

This research aims to analyze the role of the One Map Policy and the One Data Policy in enhancing the validity and accuracy of data for the issuance of electronic land certificates, as well as to examine how the implementation of electronic certificates contributes to improving legal certainty and the protection of land rights in Indonesia’s digital era. Using a doctrinal research approach supported by secondary data, including laws and regulations, books, journals, and articles, this study finds that the One Map Policy provides an integrated and standardized geospatial data foundation that ensures spatial accuracy in electronic certificates. Meanwhile, the One Data Policy ensures the consistency and validity of data related to rights holders and ownership history. The combination of these two policies is essential to creating credible electronic certificates and reducing the potential for future disputes. Furthermore, the study identifies that the implementation of electronic certificates can improve the efficiency and transparency of land administration services, thereby strengthening legal certainty and protecting land rights from risks of loss, damage, and forgery. Nevertheless, challenges such as the digital divide, the need for data harmonization, and regulatory refinement must be addressed to optimize the implementation of the electronic certificate system across Indonesia.
