Abstract

AbstrakPeminjaman dana pada lembaga pembiayaan merupakan alternatif yang dapat di tempuh oleh masyarakat yang membutuhkan, pinjaman dana dengan pengajuan jaminan hak tanggungan di dalamnya memberikan keuntungan timbal balik bagi masyarakat mapun pihak perbankan. Tujuan penelitian ini adalah untuk menganalisis Kewenangan PPAT dalam pembuatan akta pemberian hak tanggungan sebagai bukti pengikatan agunan kredit bagi perbankan, serta menjelaskan tanggungjawab hukum PPAT terhadap akta pemberian hak tanggungan yang dibuat dihadapannya sebagai jaminan kredit. Penelitian ini merupakan penelitian normatif dengan menggunakan pendekatan berdasar undang-undang, karya ilmiah, buku-buku, jurnal yang berkaitan dengan tema penulisan. Penelitian ini menggunakan bahan hukum primer, sekunder dan tersier. Hasil penelitian ini menegaskan bahwa tugas dan wewenang PPAT dalam membuat akta pemberian hak tanggungan di dahului dengan pembuatan akta perjanjian kredit, kemudian sebagai asccesoirnya maka di buatkanlah hak tanggungan sebagai jaminan pengikat untuk memberikan perlindungan hukum bagi pihak perbankan untuk menghindari kemungkinan terburuk apabila kreditur cidera janji. Setelah itu, PPAT akan membuatkan akta pemberian hak tanggungan dan surat kuasa membebankan hak tanggungan dan kemudian di daftarkan pada BPN. PPAT harus menjalankan tugas jabatannya dengan teliti dan hati-hati karena apabila tidak berlaku demikian maka bisa jadi perbuatannya tersebut berpotensi menjadi sumber permasalahan di kemudian hari dan dapat menjerat notaris dalam pusaran permasalahan. PPAT dapat di tuntut pemenuhan tanggung jawab berupa sanksi pidana, perdata maupun administrasi apabila terbukti secara sah dan meyakinkan telah melakukan kesalahan dan ataupun turut serta dalam melakukan perbuatan yang bertentangan dengan ketentuan yang ada. Kata Kunci: Akta Autentik; Kredit; Hak Tanggungan; PPAT AbstractBorrowing funds from financial institutions is an alternative that can be taken by people in need, loan funds with the application of mortgage guarantees in it provide mutual benefits for the community and the banking sector. The purpose of this study is to analyzing the authority of a PPAT in making a deed of granting mortgage rights as evidence of binding credit collateral for banks, as well as explaining the legal responsibilities of a PPAT for the deed of granting mortage made before him as credit guarantees. This research is a normative research using a law-based approach, scientific works, books, journals related to the theme of writing. This study uses primary, secondary and tertiary legal materials. The results of this study confirm that the duties and authority of a PPAT in making a deed of granting mortage are preceded by making a credit agreement deed, then as an accesoir then a mortgage is made as a binding guarantee to provide legal protection for banks to avoid the worst possibility if the creditor breaks his promise. After that, the PPAT will make a deed of granting mortage and a power of attorney for encumbering mortgages and then register them with BPN. PPAT must carry out their duties carefully and carefully because if this is not the case, then their actions could potentially become a source of problems in the future and can ensnare the PPAT in a vortex of problems. PPAT can be required to fulfill their responsibilities in the form of criminal, civil and administrative sanctions if they are legally and convincingly proven to have made mistakes and or participated in committing acts that are contrary to existing provisions. Keywords: Authentic deed; Credit; Mortgage right; Land deed maker’s office

Abstract

Immaterial compensation is compensation that cannot be calculated with money, such as pain, loss, and psychic, but the compensation can be replaced with some money. The existence of immaterial compensation aims to protect victims of loss of life from other people such as children and wives, families, and parents. Based on the Criminal Code, hereinafter referred to as the Criminal Code, the regulation of the crime of taking life is regulated in Articles 338 to 340. The most severe threat of punishment is contained in Article 340 of the Criminal Code, namely the death penalty, or can be said to be life imprisonment, or for a while. certain period, with a maximum period of 20 (twenty) years. Therefore, the existence of liability for compensation from the defendant to the victim can reduce the defendant's sentence or can replace the main sentence of the defendant.T he  research  method uses  a  type  of  qualitative  research  sourced  from the various  scientific  literature.

Abstract

A state is said to be democratic if it provides a neutral public space for all citizens to express their opinions and ideas, including criticizing injustices committed by those in power. The purpose of this study is to describe, from a democratic standpoint, the restoration of the function of the press as a medium of social control in Indonesia, particularly in the context of the new press. A normative approach was used in this study’s research method. The study’s findings indicate that the new internet-based press can help to restore the function of the press as a medium of social control in a democratic context. The new press’s cyber public space can provide guarantees and expand public participation in all aspects of government and state life. The cyber public space, which is technically public and is linked to the National Cyber Parliament via the national press website, will serve as media control for the government so that it does not abuse its authority.

Abstract

Legal personhood is undergoing a profound conceptual shift as private law confronts claims involving nature and artificial intelligence. This article reconsiders legal personhood not as an ontological category but as a functional institutional device for allocating rights, duties, powers, liabilities, and immunities. It conceptualizes personhood as a point of attribution through which bundles of Hohfeldian legal incidents become operational in private-law relations and are translated into standing, enforceability, liability, and remedies. This article employs a doctrinal legal research method with a conceptual and analytical-jurisprudential orientation, combining Hohfeldian analysis with a structured comparative assessment. It examines the Atrato and Whanganui River models according to representational effectiveness, enforceability, remedial performance, and accountability allocation, and evaluates three design options for artificial intelligence: no personhood, limited personhood, and full personhood. Although centered on Indonesian private law, the analysis also considers transjurisdictional doctrinal and regulatory developments, particularly in Malaysia and the broader ASEAN region. The comparison indicates that personhood for nature operates effectively only when supported by workable representation, enforceable duties, and a concrete remedial architecture. For artificial intelligence, personhood is normatively justified only where it strengthens attribution and remedies without severing liability from the human and organizational actors who design, deploy, control, or benefit from AI systems. The article concludes that any expansion of legal personhood in Indonesian private law requires rigorous institutional justification and must not operate as a symbolic designation or liability shield.
