Abstract

This article intends to describe the position of qiyas in Islamic law. Based on this library research we know that qiyas which is the fourth source of Islamic law after al-Qur'an, sunnah and Ijma, is important in exploring the legal source texts al-Qur'an and sunnah) that can be used in determining the legal basis of a case nash of which is not available. With qiyas, the problems that are not covered by the Qur'an, sunnah and ijma' finally get the solution in realizing the benefit of the people. Therefor saying that qiyas is limiting theory is not appropriate considering the rules which are stated in the sources of Islamic law, especially Qur'an, are universal, general and global mostly. Since qiyas is a interpretation of two source texts, then it is dhanny. Thus, the possibility of ideas difference among muslim scholars is really huge.Keywordsqiyas, Islamic law, al- Qur'an, alternative Artikel ini bermaksud untuk mendeskripsikan posisi qiyas dalam hukum Islam. Dari penelitian pustaka ini diketahui bahwa qiyas yang merupakan sumber hukum keempat setelah al-Qur'an, sunnah, dan ijma', merupakan piranti penting dalam mengeksplorasi teks-teks sumber hukum (al-Qur'an dan sunnah) yang bisa digunakan dalam memutuskan dasar hukum sebuah persoalan yang tidak terdapat nashnya. Dengan qiyas, berbagai problem yang tidak terakomodasi oleh al-Qur'an, sunnah dan ijma' akhirnya bisa ditemukan solusinya yang bermanfaat bagi masyarakat. Karena itu mengatakan bahwa qiyas merupakan teori yang justru membatasi tidaklah tepat. Ini mengingat bahwa kebanyakan aturan yang dinyatakan dalam sumber-sumber hukum Islam, khususnya al-Qur'an, bersifat umum dan global. Karena qiyas merupakan penafsiran terhadap kedua sumber hukum tadi, maka dia bersifat dhanny. Dengan demikian, sangat terbuka terjadinya perbedaan pendapat di kalangan para ilmuwan Islam.

Abstract

The dynamics surrounding the determination of the beginning of the Hijri calendar remain a persistent and relevant issue within the Indonesian Muslim community. One notable example is the public resistance that emerged in response to the government’s decision regarding 1 Shawwal, which was perceived to neglect input from various stakeholders. This study aims to explore the forms of resistance and identify the underlying factors contributing to this phenomenon. Using a qualitative descriptive approach, data were collected from online news sources and other relevant materials, then categorized and analyzed. The findings reveal that resistance occurs not only at the organizational and group levels but also at the individual level. Furthermore, the study highlights that an individual's level of literacy and mastery of scientific knowledge significantly influences their understanding and acceptance of the calendar decision. By applying Social Representation Theory, this study offers a novel contribution to the literature by shifting the focus from legal-astronomical debates to the sociocultural meanings and identities that shape public responses. This perspective fills a gap in previous studies and provides a more holistic understanding of calendar-related conflicts. The study recommends a more extensive public education effort by the government, including the integration of related knowledge into formal school curricula, as a strategic investment for fostering greater social harmony in the future.
