Abstract

The mechanism of foreign cooperation by the Regional Government in cooperation in economic, social culture, and other forms of cooperation, namely economic cooperation and social cultural cooperation carried out by the region with foreign parties, including border cooperation by the Regional Government (Province / District / City) bordering the territory of a foreign country. Abstract

ABSTRACT Mining business activities in the area of ​​indigenous peoples in recent decades have caused quite a number of problems which are considered to be detrimental to their interests, only in terms of the recognition and protection of indigenous and tribal peoples so far they have not been recognized and protected optimally in implementing communal management rights, both land rights , territories, cultures and natural resources obtained from generation to generation as well as those obtained through other mechanisms that are valid according to local customary law. Not yet optimal recognition and role of indigenous and tribal peoples in mining business activities will lead to conflicts in the mining business activities In the Oil and Gas Law, Law No. 4 of 2009 concerning Mineral and Coal Mining (UU Minerba) does not provide specific provisions regarding indigenous peoples, in the Minerba Act the regulation is more general in nature regarding the role and involvement of the community than a more specific category of indigenous peoples. Protection of indigenous peoples in mining business activities are only contained in Article 11, Article 33 and Article 34 of Law no. 22 of 2001 concerning Oil and Gas

Abstract

ABSTRACT The state controls the natural resources but the State does not try to monopolize the natural resources. This is because it will result in commercial government. In order for the government to run well, the State established a State-Owned Enterprise (BUMN) to exploit the natural wealth for the welfare of the people. The making of this research uses a normative research methodology, namely through the search and analysis of secondary legal materials. The problems that arise are the role of SOEs in the rule of law and the legal position of SOEs in state finance. SOEs in the rule of law play a role in carrying out activities in the economic and trading where the Government can own all or part of the shares or capital in a company. While the legal status of SOEs in state finance is the inclusion of state assets in SOE capital as a result of the separation of state assets as determined in Act Number 19 of 2003 concerning SOEs.

Abstract

The growing attention to regional autonomy is not only associated with the failure of centralized planning and the popularity of growth with equality strategies, but also the awareness that development is a complex and uncertain process that cannot be controlled and planned easily from the center. There are six stages in the regional economic development planning process, including (1) data collection and analysis, (2) selection of regional development strategies, (3) selection of development projects, (4) preparation of action plans, (5) determination of project details, and (6) preparation of overall planning and implementation. In the implementation of regional planning, it turns out that many problems arise, including: Propenas (RPJMN) and Propeda (RPJMD) are not sustainable plans because they are only prepared every five years, it is still unclear how and when top-down and bottom-up planning are integrated, there is a large gap in calculating financial capacity, and the planning focuses too much on the development project budget rather than on the overall budget.

Abstract

ABSTRACT Divorce can happen to anyone, including civil servants. According to Marsono, civil servants are civil servants who are full of loyalty to Pancasila, the 1945 Constitution and the government who are united, have good mentality, are highly disciplined, authoritative, efficient, have high quality and are aware of their responsibilities as the first element of the state apparatus. The method used in this paper is a normative method with a statutory approach, meaning that the approach is carried out by examining all relevant laws and regulations in accordance with the law being handled. The results obtained from this study are. To Civil Servants who do not report their divorce based on Article 15 paragraph (1) Government Regulation no. 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants which reads: Civil servants who do not report their divorce within a period of no later than one month from the date of the divorce, are subject to one of the severe disciplinary penalties

Abstract

DPRD merupakan lembaga perwakilan rakyat daerah dan berkedudukan sebagai unsurpemerintahan daerah yang memiliki fungsi legalisasi, anggaran dan pengawasan. Fungsi penganggaran mempunyai peranan penting dalam mewujudkan kesejahteraan rakyat dan meningkatkan daya saing. Anggaran pada tingkat daerah (APBD) mempunyai hubungan yang signifikan dengan anggaran pada tingkat nasional (APBN), yaitu sebagai alat untuk mengatasi persoalan ketimpangan fiskal secara vertikal (proporsionalitas pendapatan lukratif). Selain itu juga mengatasi persoalan ketimpangan fiskal horizontal (membandingkan antara kebutuhan fiskal (fiscal needs) dengan kemampuan fiskal (fiscal capacity) untuk menentukan/menghitung celah fiskal (fiscal gap). Selain itu juga untuk mengatasi persoalan-persoalan yang timbul dari menyebar atau melimpahnya efek pelayanan publik dan pelayanan sipil, yakni efek menyebar atau eksternalitas ke daerah-daerah lainnya.
